TERMS & CONDITIONS:
1) The #sendmetotheblue Snap to Win Instagram competition is open from 11:59pm AEST 01/03/2016 and closes 11:59pm AEST 31/05/2016.
2) Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3) Entry is only open to Australian residents aged 18 years or over.
4) Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to participate.
5) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6) Incomplete or indecipherable entries will be deemed invalid.
7) Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and not in the same month as the previous entry and in accordance with entry conditions and requirements
8) If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
9) Winners will be notified by Instagram announcement. Further communication will be performed via phone and / or email should the winner provide these details.
10) This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on: (a) image and recipe uniqueness, originality and creativity and (b) relevance to the product (in the opinion of the judge/s).
11) The Promoter's decision is final and no correspondence will be entered into.
12) Three (3) x Fiji holidays are available to win (3 different winners in total over 3 months). One winner per month
13) The holiday will include flights, accommodation and travel insurance for 2 adults (this is not an all expanses paid holiday).
- Morlife will not be held accountable for any additional costs associated with the holiday. All additional costs not expressly stated, but which may be incurred in acceptance and use of the Prize, are the responsibility of the winner and companion (if any). Such additional costs include, but are not limited to airfares, meals, accommodation, beverages, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, other transfers, missed/delayed flights, taxes including arrival and departure taxes (if applicable), insurance, passports and visas (if applicable).
14) The details of each holiday are available upon request. The detailed information on each of the holiday destinations will be provided to the Winner upon notification.
15) The holiday must be redeemed within 12 months of notification of prize.
16) Morlife are to book all aspects of the holiday (including Flights, accommodation and travel insurance).
17) Every attempt will be made to book the holiday dates around the winners request however the winner must provide a travel period of 1 month in which they are available to travel to allow for booking and hotel availability.
18) If for any reason the holiday is unable to be redeemed by the winner the holiday will be forfeited.
19) The holiday is non transferrable for cash.
20) The winner will be required to sign a legal agreement provided by Morlife before commencement of Holiday.
21) The Winner will be notified within one month of close of competition.
22) The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
23) If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
24) Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
25) All entries submitted become the property of the Promoter. As a condition of entering this promotion, each entrant licenses the Promoter to use their entry in any media, including Instagram and Facebook for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
26) Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
27) If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
28) Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
29) The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
30) Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
31) Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
32) As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
33) The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter and its affiliated bodies corporate (including its parent company(ies) may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
