TERMS & CONDITIONS
The promoter is High Performance Corporation Pty Ltd (ABN 24 191 562 983) whose registered office is at 275 Canterbury Road, Canterbury, Victoria 3126, telephone (03) 8809 2700 (Promoter).
Entry into the Competition constitutes acknowledgement and acceptance of these terms and conditions. Information on how to enter, all entry instructions, advertising material and prize information published by the Promoter form part of these terms and conditions.
To be eligible to enter you must:
a. Be an Australian resident;
b. Reside within a 50 kilometer radius from a Tint-A-Car store located in Australia;
c. Complete and submit a competition entry form (available on the Tint-A-Car website) during the Promotion Period; and
d. Comply with these terms and conditions (Eligible Entrant).
Employees or directors of the Promoter or the WorldMark Group of companies, or their immediate family members or anyone else connected in any way with the Competition or helping to set up the Competition shall not be permitted to enter the Competition.
Entries for the Competition open at 8:00am AEST on 1 July 2017 and close at 11:59pm AEST on 30 November 2017 (Promotion Period). No further entries to the competition will be permitted after the Promotion Period.
The prize for the Competition is the installation of up to 25sqm of home window tint (Prize). Excludes Enerlogic and V Series branded window film. Valued at up to $3,000.
The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
The draw will be conducted by the legal department of WorldMark Group of companies.
The draw will take place at 275 Canterbury Road, Canterbury, Victoria 3126 at 12:00pm AEST on 5 December 2017.
The first valid entry drawn will win the Prize.
The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
The Prize or any unused portion is not transferrable, exchangeable or redeemable for cash.
The winner will be notified by telephone or email within 2 days of the draw date, and will be published on the Tint-A-Car website. If the winner cannot be contacted within 2 days of the draw date, a redraw will occur at 275 Canterbury Road, Canterbury, Victoria 3126 at 12:00pm AEST on 8 December 2017.
The Promoter will notify the winner when the Prize can be delivered, the Prize is to be delivered to the residence within the 50 kilometer radius from a Tint-A-Car store.
Should the Prize remain unclaimed by 12:00pm AEST 5 March 2018, despite every reasonable effort taken by the Promoter to deliver the prize, the Promoter may conduct additional draws, as is necessary to distribute the prize, subject to permission from the relevant government authorities.
To the full extent permitted by law, the Promoter, the Promoter’s officers, employees and agents, the Promoter’s related companies and all those entities' personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense, including loss of opportunity) which is suffered or incurred by any individual in connection with the Promotion or the Prize, including but not limited to: (i) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (ii) any theft, unauthorised access or third party interference; (iii) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (iv) any variation in Prize value to that stated in these terms and conditions; (v) any tax liability incurred by the Prize winner or entrant; (vi) any Prize(s); or participation in or use of any Prize(s); (vii) any direct, indirect, economic or consequential loss; (viii) any loss arising from the negligence; (ix) any liability for personal injury or death. Nothing in these conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia.
The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct that may jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from any offender(s) are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
In the event:
a. of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster);
b. that this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter;
the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion as appropriate.
The competition and these terms and conditions will be governed by the laws of Victoria and any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
All entry details become the property of the Promoter. The Promoter may use the Prize winner’s personal details (including name, likeness, image and/or voice) for any marketing and advertising (in any form of media) for an unlimited period, unless the Prize winner notifies the Promoter otherwise when accepting the Prize. By entering the Competition entrants consent to the Promoter using their personal information provided for facilitating the Competition, awarding the Prize, and for future promotional, marketing, and publicity purposes and disclosing that information to its related entities and contractors for these purposes. The Prize winner’s personal information may be disclosed to State and Territory lottery departments as required by law. Entrants may ask the Promoter to access that personal information and request that corrections be made to it.
