Terms and Conditions
Instructions on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is open to residents of Australia aged 18 years and over. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Competition commences on 04 January 2018 and closes on 28 February 2018 at 23:59 AEDST (“Promotional Period”).
To enter the draw, eligible entrants must during the Promotional Period complete at least one (1) of the following tasks:
Subscription: Individuals must subscribe or renew their subscription to 4x4 Australia (print, digital, or bundle subscription) for a minimum term of a twelve (12) month subscription and provide their full name, state, email address, and daytime telephone number, via either: telephone 136 116 (Mon – Fri 8am AEDST/AEST – 8pm AEDST/AEST), online at www.magshop.com.au or by renewal letter redemption during the Promotional Period.
By purchasing a subscription to 4x4 Australia the entrant will receive – 100 entries into the draw. Subscription requests are subject to the correct use of a valid credit card or, if payment is made by cheque, the cheque must be cleared for payment by the close date of the promotion. If the subscription purchased is a gift, the gift donor (i.e. person buying the subscription) will be entered into the draw. Third party subscriptions (i.e. whereby a person’s subscription is paid for by a corporate body) and free subscriptions will be deemed invalid. By subscribing to this magazine title, entrants acknowledge that they understand that ‘tip-ons’and gifts that may be available with non-subscriber copies may not be provided with subscriber copies. This determination is made at the sole discretion of the Promoter.
Magazine Reader Code: Individuals must locate the Reader Code found within specific participating issues of 4x4 Australia during the Promotional Period. Individuals must then follow the prompts on the Reader Code page to the corresponding competition page (online) and complete the entry form including their full name, daytime telephone number, state, current email address and the magazine Reader Code number found within the participating issue of the 4x4 Australia magazine and submit the entry as instructed;
By completing an entry by way of Magazine Reader Code the entrant will receive – 10 automatic entries into the draw. For the removal of doubt, a Magazine Reader Code found in any particular one (1) individual issue can only be used once (1) per person. An entrant will receive a maximum of twenty (20) entries per person, throughout the Promotional Period by way of Magazine Redemption Code.
Online: Individuals must visit www.4x4australia.com.au/ironman and follow the prompts to the competition entry page and complete the entry form including their full name, state, daytime telephone number, current email address and submit the entry as instructed during the Promotional Period.
By completing the entry form online the entrant will receive – 1 automatic entry into the draw. A limit of one (1) online entry is per person is permitted throughout the Promotional Period.
Multiple entries are permitted, subject to the number of entries awarded per completed task and subject to the following: (a) each entry task must be submitted separately and in accordance with entry requirements to gain the stipulated amount of entries; and (b) a maximum of one hundred and twenty one (121) entries per person applies during the Promotional Period.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thepromotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
The draw will take place at 11.00am (AEDST) on 9 April 2018 at Storacall Technology LTD (trading as X-on), 7 Salamander Court, Mermaid Waters, QLD 4218. The winner will be notified in writing and by telephone within two (2) business days of the draw date using the contact details given in their entry. The winner’s name will be published in the public notices section of The Australian Newspaper on 11 April 2018.
The first valid drawn entry from all valid entries received during the Promotional Period will be deemed the prize winner and will win an Ironman 4X4 Gear Gift Card valued at $10,000.00. The prize can only be redeemed at the following Ironman 4x4 owned locations in person or via email. Locations are - Dandenong South in VIC, Newcastle in NSW, Brendale in QLD and Cannonvale in WA. Email contact, for redemption by email, is marketing@ironman4x4.com. Where fitting is required, it must be installed at one of the above mentioned Ironman 4x4 owned locations. Standard Labour charges apply which can be paid using the gift card. Labour from an external supplier will not be covered. Any freight costs for delivery of goods will form part of the prize. Any items purchased will be charged at RRP pricing, no discounts apply. Only Ironman 4x4 products will be supplied. Any ancillary costs associated with redeeming the Ironman 4X4 Gear Gift Card are not included. Any unused balance of the Ironman 4X4 Gear Gift Card will not be awarded as cash. Redemption of the Ironman 4X4 Gear Gift Card is subject to any terms and conditions of the issuer including those specified on the Ironman 4X4 Gear Gift Card.
Total prize pool valued is $10,000.00 (AUD).
General:
If necessary, a draw for the prize, should it remain unclaimed, may take place on 16 July 2018 at 11.00am (AEST), at Bauer Trader, 73 Atherton Road Oakleigh, VIC 3166. The winner will be notified by telephone and in writing, within two (2) business days of the draw, using the contact details given in their entry. The winner’s name will be published in the public notices section of The Australian on 18 July 2018.
In the event that for any reason whatsoever the winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Privacy:
The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy.
