Terms and Conditions
1. Information on how to enter and prizes forms part of these conditions. By participating, entrants agree to these conditions.
2. Entry is open to Australian residents 18 years and over. Employees of the Promoter, their associated agencies and companies, and immediate families are ineligible to enter.
3. There are 2 ways to enter and WIN:
1st Way - via Instagram, by posting a photo that shows your craftsmanship including a detailed description in the post #MADEWITHSTANLEY to your public Instagram profile during the promotional period. The photo with the highest number of public votes received will be deemed the winner. If there is an equal number of votes posted to multiple entries a manual draw from those entries will take place to determine the winner. Winner will receive a Stanley Tool Pack Valued at $1000. A winner will be drawn at random and will receive a STANLEY FATMAX level set valued at $150. 4. There is a total of 2 prizes given away. Total prize pool is $1150.
5. All prizes will be drawn at Stanley Black and Decker, 810 Whitehorse Road, Box Hill, 3128, at 11.00am AEST on the Tuesday 23rd May, 2017.
6. The promotion commences 22/3/2017 and closes at 11.59pm AEST on 22/5/2017 (“Promotional Period”).
7. The Promoter reserves the right to request verification of identity, residential address of winners at the nominated prize delivery address and/or proof of entry validity and other information relevant to entry into or participation in this promotion. Verification is at the Promoter’s discretion, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way with interfering or tampering with the conduct of the promotion.
8. The 1st way winner will be notified via Instagram and the 2nd Way winners will be notified via email and all will have their name published on the Promoters website at www.madewithstanley.com.au/win on the 30 May, 2017.
9. Prize is not transferable or exchangeable.
10. Prize value is correct at time of printing but no responsibility is accepted for any variation in the value of the prize.
11. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches.
12. The Promoter is not responsible for lost, interrupted communications or unavailable network server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
13. The Promoter assumes no responsibility for any error, defect, delay, theft or unauthorised access to or alteration of entries. Subject to any written directions given under the applicable law, if for any reason, the competition is not capable of operating as planned, including infection by computer viruses, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, or proper conduct of the competition, then the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this competition.
The Promoter reserves the right, in its sole discretion, to disqualify any individual for:
a) tampering with the entry process, or any other process as determined by the Promoter that in any way affects the fairness of the promotion;
b) tampering with the operation of the competition or website; or
c) acting in violation of these terms and conditions.
14. The Promoter takes no responsibility for user generated content that is shared, published or otherwise distributed with the hashtag #MADEWITHSTANLEY. By taking part in the promotion you agree to be held responsible for any material you publish or otherwise cause to appear on the Stanley Black and Decker page www.madewithstanley.com.au/win. You agree to indemnify Stanley Black and Decker for loss or damage of any kind resulting from user generated content you have published or otherwise caused to appear on www.madewithstanley.com.au/win that infringes the intellectual property of another person. While taking part in the promotion you agree not to publish, share or distribute in any way user generated content or other material that is or could be considered to be:
a. defamatory, obscene, offensive, violent, sexually explicit, threatening, abusive, vulgar, hateful or inflammatory;
b. discriminatory on the grounds of race, sex, religion, nationality, disability, sexual orientation or age;
c. deceptive or misleading;
d. an impersonation of another person or a misrepresentation of your identity;
e. a breach of any legal duty owed to a third party, including a contractual duty or a duty of confidence;
f. a breach of another person’s privacy;
g. designed to harass or alarm;
h. designed to give the impression that the content originates from Stanley Black and Decker; and/or
i. aimed at disparaging or damaging the business reputation of Stanley Black and Decker or any of its employees.
15. In the event of any prize not being claimed after three months of the draw, the winning entry will be deemed not to fulfil the entry requirements and the promoter may, subject to relevant state authorities and Regulation 10 of the Art Unions and Public Amusements Regulations 1992 (QLD) conduct further draws as are necessary to distribute the prize. Date of unclaimed prize draw is 30th June, 2017. Time and place are the same as for the first draw. If this draw is required, the winners would be notified by phone and via email and have their name published on the Promoter’s website www.madewithstanley.com.au/win on the 4th July 2017.
16. Details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties, including the Promoter's contractor Indietech Pty Ltd (39 147 644 764), for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information including images submitted as described ("Content") and agree that the Promoter may use this information, or disclose it to other organisations that may use it (including, if necessary, to organisations located outside of Australia), in any media for future promotional purposes without any further reference or payment to the entrant. All entries become the property of the Promoter and the entrant grants to the Promoter a license to all Content in accordance with the Promoter's terms of use (as if that Content were a "User Submission" in accordance with those terms), available at: http://www.blackanddecker.com.au/en-au/legal/terms-of-service. Any personal information provided during the promotion will be dealt with in accordance with the Promoter's privacy policy available at: http://www.blackanddecker.com.au/en-au/legal/privacy-policy.
17. To the extent permitted by law, the Promoter, its employees and agents shall not be liable for any claims, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential loss) as a result of, or arising out of, or in any way connected with this competition and/or its prize or any act or omission (whether negligent or not) of the Promoter, its employees and agents.
18. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram and entrants agree to the complete release of Instagram.
