The following Terms and Conditions relate to Noritake Australia Pty Ltd. By using Noritake Australia Pty Ltd’s services, You accept these Terms and Conditions, as well as the manner in which they operate. These Terms and Conditions constitute the entire agreement between Noritake Australia Pty Ltd. and You and supersede and replace all prior commitments, undertakings or representations, whether written or oral, between You, the Entrant, and Noritake Australia Pty Ltd. with respect to Your use of this Websites.

The competition permits two categories of Entries - (i) Primary Entry, (ii) Secondary Entry.
A Primary Entry is the entry gained through the provision of a valid email address and full name by the Entrant. A Secondary Entry is any entry gained into the competition by the Entrant which is not a primary entry. Only a single Primary Entry is permitted per natural person. Multiple Secondary Entries are permitted per natural person. The term Entries, unless otherwise state, henceforth refers to both Primary Entries and Secondary Entries.
This is a game of skill. Chance plays no part in determining the winner. The Promoter and Competition Host of this game of skill is Noritake Australia Pty Ltd, hereforth referred to as Noritake Australia or The Promoter. The competition Sponsors are Noritake Australia Pty Ltd. and SMEG Australia Pty Limited. The Judges will be a panel of three individuals selected by and at the discretion of The Promoter.
Each entrant’s eligibility to win will be individually judged, based upon two actions.
The number of entries gained by each entrant, through any methods outlined by The Promoter, including but not limited to
Entering one’s personal details into the competition portal
Answering the ‘game of skill’ question listed within the competition portal
Have others sign up through their unique competition referral link
The qualitative merit of the response provided by the Entrant, as judged by The Promoter
The competition will result in a single winner
In the event that there is a single Entrant with the highest number of valid entries into the competition, said Entrant will be declared the winner, subject to their eligibility being assessed and approved by The Promoter.
In the event there are multiple Entrants with the highest number of valid entries, the winner will be chosen by The Judges based on the qualitative merit of the ‘game of skill’ responses provided by the Entrants with the highest number of valid entries.
The measure of merit will be a qualitative assessment of the responses to the ‘game of skill’ question outlined in the competition.
All entries must be an independent creation by the Entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.
Employees of The Promoter and agencies associated with this promotion (Noritake
Australia) are ineligible to enter the competition, as are their immediate families.
To enter, Entrants must successfully complete the online game of skill competition. To gain additional entries, the Entrants must follow any other steps outlined by Noritake Australia. The Promoter reserves the right to verify the validity of entries.
The Promoter reserve the right to disqualify any Entrant submitting an entry at their discretion; such as entries which, in the opinion of The Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. Entries may also disqualified if they are gain through collusion, the unauthorised or misuse of technology, the supply of false information, or any means deemed inappropriate by The Promoter. The promoter’s decision will be final and no correspondence will be entered into.
All entries become and remain the property of The Promoter and anyone nominated by Noritake Australia. Competition Hosts bear no responsibility for unauthorised submission of the Entrants’ contact information by third parties.
Winner of the competition must be 18 years old and over and residents of Australia.
The Promoter reserves the right to withdraw or amend the competition as necessary, at their discretion, without notification.
The prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all
or any part of this prize will result in an immediate cancellation of the prize. Prize cannot be
exchanged. In the event that, for any reason whatsoever, a winner do not take an element of the prize at the time stipulated by The Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the
prize. Competition Hosts & Sponsor will not be held responsible for lost or stolen products or vouchers.
The Promoter reserves the right to substitute any component of the prize of equal value at their discretion.
Competition winner’s name, image and other publicly available details may be used by Noritake Australia for purposes such as, but not limited to, marketing and promotion, at their discretion.
Once prize has been confirmed by Noritake Australia, the prize is deemed non-transferrable.
On acceptance of the competition prize, the winner acknowledges that they have read and
agreed to The Promoter’s terms and conditions.
The prize consists of:
A 20 piece Marc Newson dinner set (No. M412-G20)
An SMEG panna appliance set (toaster, kettle, and blender)
Unless expressly stated, all other expenses in relation to the prize will be the responsibility of and at the expense of the winner.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered
(including, but not limited to, indirect or consequential loss) or for personal injury which is
suffered or sustained, in connection with the prize, except for any liability which cannot be
excluded by laws.
The prize is subject to availability as determined by Noritake Australia.
Promotion commences at 9am on the 4th of November 2015. Entries close 9am on the 4th of December 2015.
By entering the competition, all Entrants will be deemed to have accepted and agreed to be
bound by these rules.
The information you are asked to provide to The Promoter is personal information and is
protected by the Privacy Act 1988. The Promoter will not disclose this information to other
parties other than in accordance with the Privacy Act 1988. All entries become the property of The Promoter, Noritake Australia. The promoter may use the Entrant's details for future purposes, including future commercial, promotional, marketing, and publicity purposes within the scope of the law.
Independent financial advice should be sought as tax implications may arise as a result of
accepting the prize.
In the event that for any reason whatsoever a winner does not accept the prize at the time
stipulated by Noritake Australia then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
The competition is to be drawn at 1pm on the 4th of December 2015 at The Promoter’s registered office at 4/153 Beauchamps Road, Matraville NSW 2063; by The Judges. The winner’s names will be published online within 72 hours of draw.
The winner will be notified in writing by email within seven (7) working days of the conclusion
of the competition.
If Noritake Australia is unable to contact the winner within 7 days of the draw and has made every effort to contact them with the information provided by the Entrant then Noritake Australia will award the prize to another valid Entrant.
All Entrants who choose to ‘opt-in’ consent to have their contact details (including but not limited to title, first name, surname, email, mobile or landline phone number, mailing address and post-code), released to Noritake Australia and any third parties nominated by and at the discretion of Noritake Australia, and receiving ongoing communication from said parties. Entrants reserve the right to unsubscribe from further communication from each authorized party, individually, by following the steps outlined in the communication.
