Photo Ark Competition Terms & Conditions
This document sets out the terms of participation in the Photo Ark Photography Competition (the “Competition”).

1. The promoter of this Competition is Zoos Victoria Pty Ltd (the “Promoter”) ABN 969-139-590-53, located at the address of Elliott Avenue, Parkville VIC 3052.


2. Entry to the Competition is open to all Victorian residents. An entrant must be an individual and not a company or organisation. Entrants must be 18 years of age or older. Employees of the Promoter and any person associated with the Competition, and any organisation or individual associated with the provision of the prize(s), are not eligible to enter.


3. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions on the Promoter’s website (if any) form part of these Terms and Conditions.


4. Entry into the Competition is free.


5. The Competition opens at 9:00am on Saturday 1 July 2017 and closes at 8pm on Sunday 1 October 2017 (“Competition Period”). Any entry received after the expiry of the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.


6. To enter the Competition, you must upload an image that you have taken at Melbourne Zoo to Facebook, Instagram or Twitter with the hashtag #photoarkmelbzoo. The photo must include an animal or wildlife. The photo must be uploaded between 1 July and 1 October 2017. Photos uploaded prior to 1 July and edited with the hashtag will not be accepted.


7. Each entrant may submit a maximum of three (3) photographs for the duration of the competition. The photographs must have been taken by the entrant during 2017 and are owned by the entrant. The entrant must be the sole owner of the copyright in the image(s) submitted.


8. The entrant’s profile must be set to “public” in order for the entry to be received by the Promoter.


9. All entries become the property of the Promoter and will not be returned to the entrants.


10. Photos must be uploaded in digital format, but the original photograph does not need to have been taken on a digital camera. High quality scans of transparencies or negatives will be accepted.


11. Images must not contain borders, watermarks, signatures or contact information. Digital adjustments including tone and contrast, burning, dodging, cropping, sharpening, noise reduction, minor cleaning work, HDR, stitched panoramas, focus stacking using multiple exposure taken at the same location at the same time are permitted. Adding or removing objects, animals or parts of animals, plants, people etc is not allowed.


12. Zoos Victoria reserves the right to request original, unedited photos prior to awarding prizes to the winner(s).


13. By submitting your entry to the Promoter, you grant the Promoter and its licensees and assignees a non-exclusive license to exercise all rights in perpetuity throughout the world in your entry and all other material provided by you to the Promoter pursuant to this Competition at any time. Entrants grant the Promoter permission (which Entrants understand cannot be retracted) to use their entry in any form across any media, including online and on social media, in order to conduct and promote Zoos Victoria.


14. Without limiting the rights granted to the Promoter under clause 15, you specifically agree that clause 15 grants to the Promoter the non-exclusive right to communicate your entry in whole or in part to the public throughout the world on any media platform and you grant to the Promoter all associated rights necessary to exercise the above rights.


15. The entrant whose entry is judged by the Promoter’s panel of judges to be the best photo will win the major prize (“Major Prize Winner”). The 5 entrants whose entries are judged by the Promoter’s panel of judges to be the 5 next best photos will win the runner-up prizes (“Runner-up prize Winners”). Chance plays no part in determining the prize winners.


16. The Major Prize is as follows: 2 nights accommodation at The Larwill Studio Parkville (valued at approximately $440), 1 x Nikon D3400 DSLR Camera (valued at $600), 1 x 12 month Zoos Victoria adult membership (valued at $96). If the winner already has a Zoos Victoria membership, they will receive a free renewal for the following year. Standard membership terms and conditions apply


17. The 2 nights accommodation at The Larwill Studio is for a Workspace Parkview King Room to be redeemed between 1 December 2017 and 30 June 2018, subject to The Larwill Studio availability.


18. The Runner-up Prize (x 5) is as follows: 1 x Zoos Victoria annual membership (valued at $96), 1 x Melbourne Zoo Close-up Encounter (valued at $30). The Close-up Encounter will be in the form of a 12 month voucher. The winners will need to call the Zoos Victoria Sales team to book in their encounter. Encounters and dates are subject to availability. If the winner already has a Zoos Victoria membership, they will receive a free renewal for the following year. 19. No component of the prize can be transferred or redeemed for cash. In the event that any of the prizes become unavailable, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.


20. All other costs associated with the prize, including but not limited to any travel, spending money, meals, additional accommodation, insurance and all other ancillary costs are the responsibility of the winner.


21. The Promoter will not be liable for any direct, indirect, special or consequential loss or damage caused, or suffered by the winner in relation to any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.


22. The winner and runner-ups will ne notified via email on 18 October 2017. The winner and runner-ups must claim their prizes within two weeks of being notified that they have won. Failure to claim the prize within two weeks will result in a re-judge and they will not be entitled to any supplementary prize or benefit.


23. You warrant that:(i) all details provided with your entry are true and accurate;(ii) you have all necessary rights and licenses to grant the rights set out in these Terms and Conditions;(iii) your entry is your original work;(iv) the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties; and you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.


24. You acknowledge that the Promoter is under no obligation to exercise any of the rights granted to it by these Terms and Conditions and any communication of your entry to the public by the Promoter is at the complete discretion of the Promoter.


25. You agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee being paid to you.


26. Decisions of the Promoter and its panel of judges are final and will be binding on each person who enters the Competition and no correspondence will be entered into. The name of the prize winner will be posted on the Zoos Victoria Facebook Page and website. Please allow at least 30 days from the date of notification for the delivery of the prize.


27. If there is any event that prevents or hinders the Promoter’s conduct of the Competition or the Promoter’s ability to deliver the prize/s to the prize winner/s of the Competition, the Promoter may, in its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner.


28. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.


29. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. You are providing your information to the Promoter and not to Facebook.
