TOP Parks Win a Mitsubishi Pajero Sport Promotion - Terms and Conditions
These are the terms and conditions of the Promotion. Participation in the Promotion is deemed to be acceptance of these terms and conditions.
This Promotion is conducted by Top Tourist Parks of Australia Pty Ltd (ABN 34 006 902 727) of 49 Henry Street Stepney South Australia 5069 Telephone 08 8363 1901 ("the Promoter").
All residents of Australia aged 18 and above are eligible to enter the Promotion ("Eligible Entrant") excluding the following persons: Members of the Promoter; directors, employees and contractors of the Promoter, its Members, Mitsubishi Motors Australia Limited and its authorised Dealers, advertising agencies and suppliers associated with the Promotion and their immediate families. "Immediate family" includes any of the following relationships: spouse, ex-spouse, de facto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, aunt, uncle, niece, nephew, sibling, step sibling or first cousin.
The Promotion commences at 12:01am ACST on Saturday 1 October 2016 and closes at 11:59pm ACST on Friday 30 June 2017 ("the Promotion Period").
The Prize is a 2017 Mitsubishi Pajero Exceed 8 speed Automatic Diesel. The value of the Prize (as at 12 August 2106) is $ 56,000.00. The Prize will be made available for delivery to the Winner at the Mitsubishi dealer nearest to the Winner's place of residence in Australia as specified in the winning entry. The Prize includes 12 months registration and statutory insurance and on road costs but personal insurance and any other costs and/or other legal requirements will be the responsibility of the Winner. Collection of the prize is the Winner's responsibility.
If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority
The Prize is non-transferable and there is no cash alternative in place of the stated Prize.
Eligible Entrants may participate in the Promotion by staying at a TOP Park during the Promotion Period.
Each time during the Promotion Period that an Eligible Entrant stays at a TOP Park on the basis of normal commercial terms, the Eligible Entrant shall be entitled to receive a uniquely identified Entry Card, which may be used to make one entry into the Promotion Draw.
An Eligible Entrant who is member of the TOP Parks Club during the Promotion Period may receive an additional entry for each stay, provided the membership number is quoted at the time of each entry.
Entry is by visiting the Promotion website www.TopParks.com.au/winacar during the Promotion Period and entering the information requested, including in particular: the unique identifier code specified on the Entry Card, the name of the Eligible Entrant, the address, telephone number and e-mail address of the Eligible Entrant, the name of the TOP Park where the Eligible Entrant has stayed, the type of accommodation during that stay, the date of the stay and if a TOP Parks Club member, the membership number. Entrants authorise the Promoter to contact the Park concerned to verify that there was a genuine stay at that Park for the purposes of validating the entry. For the purpose of establishing eligibility to enter the Promotion Draw, the Eligible Entrant must be the person nominated in the records of the Park in respect to that stay and a stay comprising consecutive days shall be deemed to be a single stay.
The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any entry if the Promoter reasonably considers the entry is invalid for any reason.
The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence and proof of purchase) and reserves the right in its sole discretion, to disqualify any Eligible Entrant who the Promoter has reason to believe has breached these terms and conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights, including its right to recover damages, or other compensation from such an offender are reserved.
Entries are deemed to be received at the time of receipt into the Promotion database and NOT at the time of transmission by the Eligible Entrant. Confirmation of receipt of an entry will be sent by e-mail in respect to each entry, but the sending of such e-mail shall not be regarded as conclusive evidence of the validity of an entry.
Incomplete or indecipherable entries will be deemed invalid.
Multiple entries permitted, subject to only one entry being permitted per stay during the Promotion Period. For clarity, only one entry is permitted per stay, regardless of the number of consecutive days of that stay. All entries must be received during the Promotional Period.
The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure, or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
All valid entries have a random and equal chance of winning the Prize. The Winner will be selected by random draw.
The random draw will be conducted by an independent person and shall take place at midday ACST on Friday 28 July 2017 at the office of the Promoter, 49 Henry Street Stepney South Australia 5069.
The total prize pool is $56,000.00 (as at 12 August 2016).
The Winner will be notified by post, telephone and e-mail by no later than 5:00pm ACST on Friday 28 July 2017. The Winner's name and address will be published in The Australian newspaper on Friday 6 August 2017 as well as on the Promotion website for 28 days after the Promotion Draw.
The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
If the Winner does not claim the Prize by Tuesday 31 October 2017, then the Prize shall be forfeited and the Promoter will arrange for an independent person to conduct a further draw at midday ACST on Wednesday 1 November 2017 at the same place as the original draw. The Winner as determined by this unclaimed prize draw will be notified by post, telephone and e-mail by no later than 5:00pm ACST on Tuesday 1 November 2017. The Winner's name and address will be published in The Australian newspaper on Friday 4 August 2017 as well as on the Promotion website for 28 days after the unclaimed prize draw.
The Winner agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agree that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrants; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Internet is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, contractors and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees, contractors and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
Subject to this paragraph, all personal information collected from Eligible Entrants will be handled in accordance with the Promoter's Privacy Policy which can be accessed by visiting www.topparks.com.au. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Entrant, in addition to any other use that may be outlined in the Promoter's Privacy Policy. Furthermore, such information may be provided to Mitsubishi Motors Australia Limited for promotional purposes and in particular to inform entrants regarding Mitsubishi vehicles and promotional offers. Eligible Entrants should direct any request to opt out, access, update or correct information to the Promoter. Any complaints regarding the treatment of personal information should also be directed to the Promoter using the contact details set out in these terms and conditions and will be dealt with by the Promoter in accordance with its Policy. All entries become the property of the Promoter. The Promoter will not disclose any personal information overseas.
