MIRVAC – ‘YOUR VISION AT MADOX’ PROMOTION
Terms and Conditions
(1) All terms and conditions relating to this promotion including the terms relating to entry to the
promotion are as set out in this document (Terms and Conditions).
(2) Entry into the ‘Your Vision at Madox’ promotion (Promotion) is deemed acceptance of these
Terms and Conditions. Headings in this document are included for ease of reference, and do
not affect interpretation in any way.
(3) The promoter of the Promotion is Mirvac (WA) Pty Ltd (ABN 81 095 901 769) (Promoter).
Promotion Period
(4) All references to time in these Terms and Conditions are a reference to the local time in Perth,
Western Australia, Australia.
(5) The Promotion commences at 12:00pm on 1 September 2017 and closes at 11:59pm on 30
September 2017 (Promotion Period). The prize winner will be awarded on Tuesday 3 October
2017 at 5:00pm.
Eligibility to enter the Promotion
(6) Subject to clauses 7 and 8, entry is open only to individuals who are Western Australian
residents with a current Western Australian postal address and who are aged 18 or over
(Eligible Entrants).
(7) Businesses, companies and incorporated associations are ineligible to enter the Promotion.
(8) Directors, management, employees, agents, and their immediate families of the Promoter and
any of their Related Bodies Corporate (throughout this document, as defined in the
Corporations Act 2001 (Cth)) are not eligible to enter the Promotion.
Entry into the Promotion
(9) To enter the Promotion, Eligible Entrants must, during the Promotion Period, on the Mirvac
Madox website at madox.mirvac.com.au describe in 25 words or less their vision of their
lifestyle at Madox and how they would spend $5,000 towards this vision.
(10) Eligible Entrants may submit multiple entries.
(11) The time of entry is deemed to be the time an entry is received by the Promoter.
Invalid entries into the Promotion
(12) The Promoter is not responsible for any incomplete, incorrectly submitted, lost, late or
misdirected entries including any failure in telecommunications equipment or service.
(13) The Promoter reserves the right, at any time, to verify the validity of entries and whether any
entrant is an Eligible Entrant (including any entrant's identity and place of residence) and to
disqualify any entrant who, in its opinion, tampers with the entry process.
(14) The Promoter reserves the right to remove any entry to the Mirvac Madox website at
madox.mirvac.com.au if it is deemed by the Promoter and its representatives to be
inappropriate.
Drawing of winners
(15) The entries will be judged by the Promoter in its absolute discretion based on which, in the
opinion of the Promoter’s representative, is the most original and creative throughout the
Promotion Period.
(16) Chance plays no part in the selection of winners.
(17) The decision of the Promoter is final and no correspondence will be entered into.
(18) The Promoter will notify the winner by email or other contact details provided by the winner at or
around the date stated in clause 5 above for the selection of the winner.
(19) The Promoter will arrange a time with the winner to collect and redeem the prize.
Prize
(20) There will be one Promotion winner.
(21) The prize is one $5,000 pre-paid Visa Card.
(22) The prize is inclusive of GST.
(23) The prize must be taken as stated, is not transferable to another person (unless agreed by the
Promoter in its absolute discretion), cannot be exchanged for other goods or services, and
cannot be taken as cash. It is a condition of accepting each prize that the winner accepts the
conditions of use of that prize.
(24) If the prize is unavailable, the Promoter, in its absolute discretion, reserves the right to
substitute the prize with a prize up to the equal value or specification.
Prize winner
(25) As a condition of accepting the prize, the prize winner consents to the Promoter using their
name, likeness, image, voice (including photographs, film and recording of the same) and entry
to the Promotion including their vision of lifestyle at Madox, in any media for an unlimited period
without remuneration and without notice for the purpose of promoting this Promotion (including
any outcome), promoting the Promoter and promoting any products developed and sold by the
Promoter or its Related Bodies Corporate.
Replacement winner
(26) If the Promotion winner cannot be contacted within two months of the end of the Promotion
Period, has not complied with these Terms and Conditions, or forfeits their prize, the Promoter
will select a replacement winner at its absolute discretion.
Minors
(27) This Promotion is not open to entrants under the age of 18. Any entrant under the age of 18
who is selected as a winner will forfeit the prize on presentation or discovery of evidence that
they are younger than 18.
Additional documentation
(28) As a condition of accepting any prize, the Promotion winner must provide proof of their identity
to the Promoter in the form required by the Promoter.
(29) Entrants acknowledge that compliance with this clause is required in order to claim the prize.
Reservation of rights
(30) The Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or
suspend this Promotion at any time.
No waiver
(31) Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of
those rights.
Limitation of liability
(32) The Promoter and others associated with this Promotion and their respective Related Bodies
Corporate, officers, employees, contractors, and agents will not be held liable for any loss,
damage, injury or death whatsoever which is suffered or sustained (including but not limited to
direct, indirect and consequential loss and including but not limited to any loss, damage, injury
or death arising from any person’s negligence) in connection with this Promotion, the promotion
of this Promotion, or any use of any prize, except for any liability which cannot be excluded by
law (in which case the liability is limited to the minimum allowable by law).
(33) Without limiting the above clause, Eligible Entrants acknowledge that the Promoter shall not be
liable for:
a. late, lost, misdirected, incomplete or incorrect entries;
b. any financial or legal implications (or otherwise) that may arise from the prize; or
c. any defect or technical problem associated with the prize.
Use of Personal information
(34) All entries become the property of the Promoter once they are received by the Promoter.
(35) By participating in the Promotion entrants agree that the Promoter or any of its Related Bodies
Corporate may use entrants’ personal information to promote its products and services and
may also disclose personal information to third party agents and service providers. Personal
information may also be disclosed to overseas recipients who use the personal information to
assist the Promoter in the operation of its business.
(36) The Mirvac Group Privacy Policy (available www.mirvac.com/privacy-policy) contains
information about how you may request access to and correction of personal information the
Promoter holds about you, or to make a complaint about an alleged breach of the Australian
Privacy Principles. If you no longer wish to receive promotional information from the Promoter,
you may advise the Promoter of your wish. The Mirvac Group Privacy Policy contains
information about how you may send your request to the Promoter.
Tax implications
(37) The Promoter accepts no responsibility for any tax implications that may arise from accepting
the prize. Eligible Entrants should seek independent financial advice.
Force majeure
(38) If any act, omission, event or circumstance occurs which is beyond the reasonable control of
the Promoter or which prevents the Promoter from complying with these Terms and Conditions,
the Promoter will not be liable for any failure to perform or delay in performing its obligations.
Governing law
(39) These Terms and Conditions are governed by the laws of Western Australia.
