1. Information on how to enter and prizes form part of these Terms and Conditions. Any entry not complying with these Terms and Conditions is not valid. Participation in this Epic Pilbara Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions. The Promoter is Australia’s North West Tourism (“The Promoter”).
2. The prize winner will be drawn at random from the valid entries at the end of the Promotional Period. The Promoter will conduct the prize draw.
3. Entry is open to residents of Australia over 18 years of age. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
4. The promotion commences on Monday 23rd May 2016 at 12.01am AEST and concludes on Friday 10th June 2016 11.59pm AEST (The promotional period).
5. To enter, individuals must complete the following steps during the Promotional Period:
a) View the promotional Epic Pilbara Facebook Page post on their newsfeed or visit the Australia’s North West Facebook Page directly at www.facebook.com/northwestaustralia (“Facebook Page”) and submit entry form.
b) View the Epic Pilbara website page www.australiasnorthwest.com follow the Epic Pilbara prompts to the promotional application;
c) Input the required details as prompted; and
e) Submit the fully completed entry form.
6. By subscribing to our newsletter you agree to receive email from us. The subscription to our newsletter service is not mandatory, and you have the option to unsubscribe or change your subscription at any time. Your email data will never be sold or shared with another company.
7. All valid entries received during the Promotion Period will be eligible to win the prize.
8. Multiple entries are not permitted.
9. The winner will be notified via their contact details as submitted at the time of competition entry, and the winners will be posted on the Australia’s North West Facebook page within 48 hours of the conclusion of the Promotion Period.
10. a)The Pilbara Holiday Prize will consist of one (1) Engel MT45FP (40 LTR) fridge/freezer valued at AUD$1375 from Engel Distribution.
b) Up to $AUD 30 delivery is included within Australia not including residential addresses or isolated areas.
c) The Engel MT45P is not transferable or redeemable for cash.
11. a) The Pilbara Holiday Prize will consist of two (2) nights’ accommodation in a twin share executive apartment at Onslow Beach Resort in Western Australia to the value of $660 (inc GST), plus two (2) x Mackerel Islands Day Trips by Mackerel Islands in Western Australia to the value of $225 per person ($450 total, inc GST). *Valid for 12 months from date of issue. If the prize is not redeemed within this time frame, the winner forfeits their prize. Total prize value: $1,110
b) The accommodation and day trip tickets to be valid for 12 months from date of issue.
c) The accommodation and day trip tickets are not transferable or redeemable for cash
d) The accommodation and day trip tickets to be redeemed directly with Onslow Beach Resort and the Mackerel Islands respectively.
e) The accommodation is to be used in conjunction with the day trip, i.e. one night preceding the day trip and one night following the day trip, and the prizewinner and partner must travel on the same dates.
f) Check-in to the Resort is no earlier than 2pm and check-out is no later than 10am.
g) Accommodation and day trip tickets do not include food or beverages other than tea / coffee / water in the apartments – however meals are available at the Onslow Beach Club during opening hours at the expense of the prizewinner.
h) If the prizewinner is under the age of 18 years, that winner must be accompanied by a parent or guardian to collect their prize.
i) It is a condition of entry of this competition that the prizewinner and their accompanying partner / parent / guardian must execute these Terms & Conditions before being eligible for the prize.
j) All bookings are subject to availability.
k) Please note that at times during the prizewinner’s visitation, staff may be photographing specific events or activities on and around the island and / or resort for use in marketing content. Mackerel Islands and the Onslow Beach Resort staff are vigilant in taking precautions to prevent embarrassment, defamation occurrences, and acquiring consent in the instance that children may be accompanying the prizewinner. All employees assigned to collect visual content are authorised managers of such marketing activities, and have signed agreements to strict social media and marketing policies. Please contact us directly if you have any concerns or do not agree to these terms.
l) All contestants release from and indemnify the Onslow Beach Resort and the Mackerel Islands (ABN 30008728087) against all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in this competition including (but not limited to) loss of income, personal injury, accident or death and damage to property and whether direct or consequential, foreseeable, due to any negligent act or omission or otherwise.
m) The Onslow Beach Resort and the Mackerel Islands accept no responsibility for any loss, damage, accident, death or injury resulting from the promotion
12. a) The Pilbara Holiday Prize will also consist of two (2) x Day Cruises on ‘Blue Marlin’ by Discovery Cruises in Dampier, Western Australia to the value of $AUDxxxx
b) The day cruises to be valid for 12 months from date of issue.
c) The day cruises are not transferable or redeemable for cash.
d) The day cruises to be redeemed directly with Discovery Cruises in Dampier.
e) All bookings are subject to availability.
13. a) The Pilbara Holiday Prize will also consist of two (2) x Old Skool Karijini Experience by the Flying Sandgroper in Western Australia to the value of AUD$385 (inc GST) each.
b) The prize is valid on specific tour dates from April to October 2016 or April to June 2017 as specified on http://www.westozactive.com.au/flying-sandgroper/old-skool-karijini-experience/
c) The Old Skool Karijini Experience is not transferable or redeemable for cash.
d) The Old Skool Karijini Experience is to be redeemed directly with The Flying Sandgroper in Western Australia.
e) All bookings are subject to availability.
14. a) The Pilbara Holiday Prize will also consist of two (2) x Rock Art Tours by Ngurrangga Tours in Western Australia to the value of AUD$264 (inc GST).
b) The Rock Art Tours to be valid for 12 months from date of issue.
c) The Rock Art Tours are not transferable or redeemable for cash.
d) The Rock Art Tours are to be redeemed directly with Ngurranga Tours in Western Australia.
e) All bookings are subject to availability.
15. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
16. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to the utilisation of techniques to make multiple entries or for submitting an entry which is not otherwise in accordance with these conditions of entry.
17. In the case that the Promoter finds evidence of tampering by the entrant in the entry process or the verification process, in addition to declaring any or all entries made by the entrant invalid, the Promoter may in its complete discretion preclude that entrant from participation in any or all future promotions of the Promoter.
18. Entrant details become the property of the Promoter. All details will be held in accordance with Australia’s North West Tourism’s Privacy Policy which can be accessed by visiting www.australiasnorthwest.com.
19. The Promoter’s decision is final and no correspondence will be entered into.
20. If a prize remains unclaimed for 3 months after the draw, despite the Promoter’s best efforts to contact a winner, then the Promoter may conduct an unclaimed prize draw at the same time and place as the original draw to distribute the unclaimed prize. The first valid entry announced will win the prize. Any winner in such a draw will be notified via their contact details as submitted at the time of competition entry within 48 hours of the draw. The date for the redraw will be 3 months after the original draw. The redraw prize selection process will take place on 9th September 2016 if required.
21. If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
22. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
23. Entrants release Facebook from all liability in relation to the Competition. Entrants acknowledge that this Competition is in no way sponsored; endorsed or administered by, or associated with Facebook and that any information provided by entrants is provided to the Promoter and not to Facebook.
