CONDITIONS OF ENTRY
By entering this Promotion, Entrants agree to abide by these Conditions of Entry. The Promoter is Flip TV Pty Ltd, ABN 78 600 712 230, Level 4, Suite 12, 832 Anzac Parade, Maroubra, NSW 2035, ph: 1300 354 788.
The Promotion commences at 15.00pm AEST on 22 September 2016 and closes at 16.00pm AEDT on 15 November 2016 (Promotion Period).
Entry is open to any Australian resident aged 18 years or older (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
To enter the Promotion, Entrants must visit Flip TV Facebook Page at https://www.facebook.com/FlipTVAustralia/ then accurately complete an online entry form on the Flip TV Facebook page, and submit it so that it is received during the Promotion Period (Entry).
Entrants may only enter the Promotion once during the Promotion Period. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Promotion Period.
On the Thank You Page of the entry form Entrants have the option to refer a friend to obtain an extra entry into the draw. Entrants can receive up to a maximum of 6 entries – one for sharing the competition on Facebook and up to five by referring five friends via email. Entrants will need to enter the names and email addresses of up to 5 friends via email to obtain the additional entries. Before referring friends, the entrant must first ensure they have the consent of the friend/s prior to nominating them to receive the details of the promotion. Extra entries will only be valid for referrals made via the entry form. Liking the Flip TV Facebook page will be part of the competition steps, however not mandatory for the entrants. The Promoters will not use the information received in the record of referral for any ongoing marketing communications. The Promoters will only use this information the one time in conjunction with the contest. Referred records will not be entered into the Promoter’s database.
By accepting the terms and conditions upon entering the promotion you are automatically entered into the Promoter’s email database.
No purchase is necessary to enter. Purchasing products will not help your chances of winning.
The total Prize Pool is valued at $1746.40. There is one (1) Major Prize valued at up to $1746.40. The Major Prize includes 1 x Samsung KU6000 55″ 4K UHD HDR Smart LED LCD TV (RRP $1498.00), 1 x 12 month Flip TV subscription to the Best of British TV Package (RRP $179.40), 1 x Flip TV once-off connection fee (RRP $59.00) and 1 x Flip TV box delivery (RRP $10.00). Prizes are not exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prizes. Please allow up to 28 days for delivery of prizes from being notified as a winner.
The Prize Draw will be conducted at 11:00am AEDT on 16 November 2016 at 3/145 William Street, Darlinghurst NSW 2010. The Major Prize Winner will be the first valid Entry drawn. Prizes are not transferable or exchangeable, and cannot be taken as cash.
The Winner will be notified by email within five (5) business days of the Prize Draw, and will receive written confirmation within twenty-one days and their name will be published on the Flip TV Facebook Page (https://www.facebook.com/FlipTVAustralia/) on16 November 2016. In their written confirmation, the Winner will be provided with details of how to claim their Prize and the date by which they must claim their Prize (Prize Claim Date). The Winner may need to provide sufficient identification in order to claim their Prize.
If the Prize is unclaimed by the Prize Claim Date, subject to any directions from a regulatory authority, the Promoter may conduct a further draw on 27 February 2017 at the same time and location as the Prize Draw, in order to distribute the unclaimed Prize (Unclaimed Prize Draw). In the case of a winner, they will be notified by telephone within two days of the Unclaimed Prize Draw, receive written confirmation within twenty-one days and their names will be published on the Flip TV Facebook Page (https://www.facebook.com/FlipTVAustralia/)on 28 February 2017.
By submitting content you authorise that it is your own content and that you are permitted to distribute such content.

Supplying your valid contact details are part of the conditions of entry to this promotion. All contact details entered incorrectly shall be deemed invalid.
The Promoter reserves the right to disqualify entries if the entry has violated the Terms & Conditions in any way.
The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and/or New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter´s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) use of a prize.
If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose Entrants’ personal information to companies and agencies connected with this Promotion.

In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Flip TV Pty Ltd database. The Promoter and Flip TV Pty Ltd may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Flip TV Pty Ltd Privacy Policy. i. using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion;
ii. using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including email and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and
iii. using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
