TERMS & CONDITIONS:
This competition (“Competition”) is conducted by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Chocolate Australia, of Ring Road, Wendouree VIC 3355 (“Promoter”).
Entry to the Competition constitutes acceptance of these conditions.
TERMS & CONDITIONS:
This competition (“Competition”) is conducted by Mars Australia Pty Ltd, ABN 48 008 454 313, trading as Mars Chocolate Australia, of Ring Road, Wendouree VIC 3355 (“Promoter”).
Entry to the Competition constitutes acceptance of these conditions.
The Competition is only open to Eligible Entrants. An "Eligible Entrant" is an individual who: (i) is a resident of Australia aged 13 years or older as at the time of entry; and (ii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee. An Eligible Entrant who is under 18 years of age, must obtain the permission of a parent or guardian to enter. Please also refer to additional eligibility requirements in condition 24.
Competition Entry is open from 9am on 22/08/2016 to 5pm on 21/09/2016. ("Entry Period"). All times and dates are times and dates in Melbourne which may be AEST or AEDT depending on the date.
ENTRY
To enter, an Eligible Entrant must, during the Entry Period, first make a Qualifying Purchase from a Supa IGA, IGA, IGA Express, Foodland, Foodworks or IGA Plus Liquor store supermarket anywhere in Australia. A Qualifying Purchase is the purchase, in one transaction, of any two (2), or more, MARS® products (each a “Qualifying Product”).

Subject to the other conditions, an Eligible Entrant may enter the Competition once for every Qualifying Purchase that they make during the Entry Period, with an entry limit of two (2) entries per day. IMPORTANT: If more than two (2) Qualifying Products are purchased in the same transaction, there is still only ONE Qualifying Purchase. Accordingly only ONE entry may be submitted based on that Qualifying Purchase transaction.
Entry can only be made by internet. To submit an entry, an entrant must, during the Entry Period, use a compatible browser to visit www.marsfinalsfever.com.au ("Competition Website") and follow the directions there. For each entry, the entrant must provide: (a) the last 6 digits of the bar codes on the two (2) Qualifying Products being used to enter; (b) the number of the Supa IGA, IGA, IGA Express, Foodland, Foodworks or IGA Plus Liquor listed on the store receipt that was issued when those Qualifying Products were purchased; and (c) all other details required at the Competition Website, including first and last names, postal address and e-mail address.
All entrants must ensure that their entries are received by the Promoter during the Entry Period. The Promoter takes no responsibility for any late or misdirected entry or for any delays or failures in any telecommunications service or equipment.
For each and every Qualifying Purchase that an Eligible Entrant uses to submit an entry, he/she MUST retain: (i) the original packaging of the Qualifying Products comprising the Qualifying Purchase (only the bag of any Qualifying Product that is a multipack (a pack in which individual wrapped items are packed together for sale) must be retained; the wrappers of the products inside the bag are NOT required to be retained), and (ii) a copy of the Supa IGA, IGA, IGA Express, Foodland, Foodworks or IGA Plus Liquor store receipt(s) that was issued when that Qualifying Purchase was made.
All entries to the Competition may be subject to verification by the Promoter. The Promoter will reimburse an entrant for any reasonable costs incurred in complying with this condition.
a) An entrant MUST, within 7 days of being asked, deliver to the Promoter (by a means determined by the Promoter) all of the items which condition 9 requires the entrant to retain and which are requested by the Promoter. The Promoter may elect not to return those items.
b) An entrant MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an entrant MUST also, within 7 days of being asked, allow the Promoter to inspect and copy the original of any such document.
The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: (i) fails to establish their entitlement to enter the Competition to the Promoter's reasonable satisfaction; or (ii) fails to produce items as required by condition 9 or produces items that, in the Promoter's reasonable opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or (iii) in the Promoter's reasonable opinion, tampers with the entry process or benefits from such tampering; or (iv) in the Promoter's reasonable opinion, submits an entry which is not in accordance with these Conditions.
MAJOR PRIZE DRAW AND MAJOR PRIZE
The Major Prize Draw will be held from all entries received at 12 noon on 22/09/2016 at Prime Focus, 500 Chapel Street, South Yarra VIC 3141.
The Eligible Entrant who submitted the first valid entry drawn in the Major Prize Draw will win the Major Prize. The Major Prize is valued up to RRP A$104,450 and comprises for both the winner and one (1) guest:
an opportunity for the winner only to participate in the Kick for 100k experience on the field at the 2016 Toyota AFL Grand Final (see condition 18 below);
a) return economy flights from the winner’s nearest Australian Capital City to Melbourne, Victoria for the winner and his/her guest, departing on 01/10/2016 and returning on 02/10/2016
b) one (1) night in a double/twin room in a 4-star or above hotel of the Promoter’s choice; and
c) two (2) x Grand Final ‘The Interchange’ Package tickets to the AFL Grand Final on 01/10/16 at the Melbourne Cricket Ground. Package includes:
a. Guaranteed category 6 seating at the 2016 Toyota AFL Grand Final;
b. Access to the ‘Foxtel Footy Festival Precinct’ on-site at the MCG;
c. Pre-game refreshments;
d. Live pre-game entertainment;
e. A complimentary copy of the Grand Final edition of the AFL Record; and
f. A complimentary Grand Final Souvenir
For the purposes of condition 13 the Major Cities are: Sydney, Canberra, Melbourne, Hobart, Adelaide, Perth, Darwin, Brisbane.
Major Prize winner's guest must be aged 13 years or over.
Five (5) provisional winners will be drawn and recorded during the Major Prize Draw in the event that an invalid or ineligible entry is drawn.
The flight component of the Major Prize will not be awarded to any winner whose nearest Australian Capital City is Melbourne and no additional compensation will be awarded.
KICK FOR 100K OPPORTUNITY
The Kick for 100k component of the Major Prize is the opportunity for the Major Prize winner to participate at the Kick for 100k event at the 2016 Toyota AFL Grand Final on 01/10/2016 at MCG ("Kick Event"). The exact time of the Kick Event will be provided to the Major Prize winner no later than seven (7) days prior to the Kick Event.
The Major Prize winner must kick a ball at the Kick Event in accordance with the Kick Event game rules (the "Game Rules"). The Game Rules, including the distance and placement on the field, will be disclosed to the Major Prize winner at the Kick Event.
The Major Prize winner must either wear attire provided by the Promoter or suitable attire (non-branded clothing and running shoes) that must be approved by the Promoter.
If, in accordance with the Game Rules, the Major Prize winner kicks the ball in the Kick Event and scores a goal on his/her first attempt, the Major Prize winner will win A$100,000 (the "Kick for 100k Game Prize").
Alternatively, if in accordance with the Game Rules, the Major Prize winner kicks the ball in the Kick Event and does NOT score a goal on his/her first attempt, the Major Prize winner will win a Mars Chocolate Hamper valued at A$200 (the "Kick for 100k Game Consolation Prize").
The Major Prize winner's guest is not permitted to participate in the Kick Event and must remain in his/her seat during the Kick Event.
The following entrants are NOT eligible to win the Major Prize:
d) Anyone that has ever played or been registered to play first grade level in any of the following elite competitions:
(a) Australian Rules Football - Australian Football League, Victorian Football League, South Australian National Football League, Western Australian Football League, AFL Queensland, Tasmania & Southern Football League (Tasmania), New South Wales Football League, Australian Capital Territory Australian Football League, Northern Territory Football League;
(b) Rugby League - National Rugby League, NSWRL 1st Division, QLDRL State League;
(c) Rugby Union - Super Rugby, Sydney Club Premiership, Brisbane Club Premiership, Canberra Club Premiership, Rugby Sevens (Men and Women);
(d) Soccer - A League, Victorian Premier League, New South Wales Premier League, South Australian Premier League, Southern Premier League (Tasmania), Soccer Canberra Premier League, Soccer West Coast (Western Australia), Queensland Premier League, Northern League (Northern Territory); and
e) Anyone that has ever received, or been entitled to receive, more than A$20,000 in payment or reward (including cash, goods or services) for playing in any rugby, soccer or other football competition in any one calendar year; and
f) Anyone that has ever been a member of, or played on, any international rugby, soccer or other football team (in these Conditions a "Professional").
In the event that a Professional is drawn to win the Major Prize, that entrant will automatically forfeit the Major Prize in its entirety and the Major Prize will be awarded to the next valid provisional winner.
The Major Prize winner may, if he/she wishes, decline to participate in the Kick Event and thereby reject the Major Prize. If so, that winner will forfeit the Major Prize in its entirety and the Major Prize will be awarded in accordance with condition 43.
In order to be eligible to participate in the Kick Event, the Major Prize winner must first promptly sign and return to the Promoter, prior to the Kick Event:
a) an Agreement to Participate and Standard Release, in the form provided by the Promoter;
b) a Winner's Statutory Declaration, in the form provided by the Promoter;
c) an Agreement to be filmed during the Kick Event. The Major Prize winner MUST attend the Kick Event at the specified place, date and time and personally take the kick using the ball supplied by the Promoter without any alteration, and wearing footwear and attire acceptable to the Promoter. If the Major Prize winner fails to attend the Kick Event and kick, no further opportunity to kick will be provided, and no Major Prize will be awarded.
In the event that the Major Prize winner makes any misrepresentation at any time as to their eligibility or physical ability to participate in the Kick Event, whether intentional or not, the Promoter may disqualify that Major Prize winner from participating in the Kick Event and not award the Major Prize, and if any component of the prize has been awarded, the Promoter may recover that prize from the Major Prize winner.
The Major Prize winner must disclose any pre-existing health conditions or injuries prior to accepting the Major Prize. The Promoter has an absolute discretion to allow participation in the Kick Event and may request further information from the Major Prize winner and his/her medical advisor for the purpose of exercising this discretion. The Major Prize winner agrees to provide all necessary consents for this purpose.
The timing of the delivery of the Kick for 100k Game Prize or Kick for 100k Game Consolation Prize (where applicable) is dependent upon the time it takes for the Promoter to confirm that the Major Prize winner is indeed entitled to receive the Game Prize / Game Consolation Prize. This will involve numerous steps, including the verification of the goal and subsequent confirmation checks involving insurers. It is expected that prize delivery will be made within 28 days of completion of verification of entitlement.
In the event that the Kick for 100k Game Prize is won, the prize will be awarded by a crossed cheque made out to the Major Prize winner, or via EFT if the Major Prize winner so requests.
The Major Prize winner is responsible for paying any and all taxes (excluding GST) on their prize won and the Promoter is authorised to deduct any taxes from their prize to the extent required by law.
All ancillary costs including but not limited to insurance, meals, drinks, transfers and any and all other expenses are the responsibility of the Major Prize winner.
Accommodation and flight arrangements, including suppliers, will be determined by the Promoter in its sole discretion. The Promoter may refuse any requested changes, and will not accept any request made within 72 hours of departure. If any requested change is accepted by the Promoter, change fees may be applicable.
The Major Prize winner and his/her guest may also be required to provide a credit card imprint at check-in to the accommodation that will be used as a bond in case of damage to the property.
It is a condition of accepting the Major Prize that the winner and his/her guest arrange at their own expense valid travel insurance with the highest available coverage for their period of travel. The Major Prize winner and his/her guest may be requested to provide evidence of valid travel insurance prior to the Kick Event.
$50 IGA GIFT CARDS
Each day of the Entry Period, one instant win draw time will be randomly allocated. The first valid entry received at or after each winning time randomly allocated by a computer generated draw system will instantly win a Minor Prize. There are 31 x $50 IGA gift cards to be won (each, a "Minor Prize"). The total value of the Minor Prizes is A$1,550.
The instant win draws will occur randomly each day via computer generated random instant win at Prime Focus, 500 Chapel Street, South Yarra VIC 3141. Winners will be notified immediately onscreen at time of entry.
The Minor Prizes will be distributed weekly during the Promotion and will be sent to winners by post to be received by the winner within 31 days of the relevant instant win draw, subject to any delivery delays.

WINNERS
Each winner, whenever determined, will be notified in writing sent by e-mail to the e-mail address indicated in the entry within two (2) days of the relevant draw. The notification will include instructions as to how the winner is to claim the prize and establish his/her entitlement to it.
The name of the Major Prize winner will be published on the Competition Website no later than 23/09/2016 for a period of at least 28 days.
Subject, where relevant, to any directions given under the legislation regulating the Competition, if any prize is not claimed by a winner by 9am on 27/09/2016 after Major Prize Draw a second chance draw will take place at 27/09/2016 at the same time and address as the initial Major Prize Draw to determine a replacement winner. The second chance draw winner(s), if any, will be notified by email within 24 hours of the second chance draw. If there is a second chance draw, the name of the second chance draw Major Prize winner will be published on the Competition Website no later than 28/09/2016 for a period of at least 28 days.
In order to be entitled to any prize, each winner must, if requested by the Promoter, agree to and sign and return an eligibility form confirming their compliance with the Conditions and eligibility to accept a prize. The winner will forfeit his/her prize if he/she fails to ensure that all documents relating to the prize are signed and returned in accordance with this condition, as and when required by the Promoter.
PRIZES GENERALLY
The maximum total value of all prizes is RRP A$106,200.
Each prize is valued as at 23/03/16 The Promoter takes no responsibility for any variations in value of a prize.
If a prize (or part of a prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Competition.
The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of a prize) is unavailable for any reason.
A right to receive a prize is not transferable or exchangeable and cannot be taken as a monetary payment, unless where stipulated.
Unless expressly stated in these Conditions, all expenses incurred in relation to enjoyment of a prize are the responsibility of the winner.
Multiple prizes are permitted per Eligible Entrant.
INTERNET ENTRIES
Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.
Eligible Entrants must make their internet entries manually using an internet browser. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
GENERAL
If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by inclement weather, vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition.
CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
All of the Promoter’s decisions are final and no correspondence will be entered into.
The Promoter accepts no responsibility for any tax liability incurred as a result of an entrant participating in the Competition. Entrants should obtain independent tax and financial advice.
To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or prizes, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify an entrant’s rights under the Competition and Consumer Act 2010.
If any provision of these Conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
Each winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without remuneration for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
The Promoter (Mars, we, us or our) collects your personal information via this entry form when you submit an entry to this promotion (Promotion).
We collect this personal information for the purposes of your entry into the Promotion, and to send you marketing communications about our brands, products and/or services. We may also use the personal information you give us to provide prizes, for consumer care and research purposes, and for other purposes, as described in our privacy policy.
If we do not collect the personal information you have provided in the entry form, you may not be able to submit a valid entry into the Promotion and may not be able to receive communications about our brands, products and services which may be of interest to you.
We may disclose your personal information to our family of companies and to our vendors or service providers. We require these companies to comply with the Australian privacy laws that apply to your personal information.

how you may access the personal information that is held by us and seek correction of such information; and

Any printing errors or other quality control matters outside the control of individual players shall not be used as the sole basis for refusing to award a prize.
