Terms and Conditions
Information on how to enter the ABIA Better Reading Promotion (the Promotion) forms part of these terms and conditions of entry. Entry into the Promotion is deemed acceptance of these terms and conditions.
The Promotion commences at 9.00am (AEDST) on Tuesday 13 March 2018 and closes at 5.00pm (AEST) on Wednesday 18 April 2018 (Promotion Period).
Entry into the Promotion is open only to Australian residents who are 15 years of age or over, excluding directors, management, agents, employees (and their immediate families) of the Promoter and its related bodies corporate (Eligible Entrants). Winners who are 18 years or younger must be accompanied by an adult or guardian.
To enter the applicable competition Eligible Entrants must, during the Promotion Period:

Select one book from the list of the ABIA Book of the Year winning titles.
Describe in 25 words or fewer, why their selected book is the best ABIA Book of the Year of all time.
Multiple entries will be accepted.
Eligible Entrants acknowledge that all content provided as part of the Promotion may be used to promote the Australian Book Industry and the books, via the Australian Publishers Association, all Australian Publishing companies, the Australian Book Industry Awards and associated partners websites and social media.
The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
Competition judging will take place by the Promoter on Friday 20 April, 2018 (Judging) at Australian Publishers Association (ABN 81 003 985 313) Suite 60, 89 Jones Street, Ultimo NSW 2007.
Entries will be judged on a set of criteria as follows:
Originality
Creativity
Relative understanding of the content of the book selected
In all aspects of this Promotion, the Promoter’s decision is final and no correspondence shall be entered into.
The winners will be notified by phone and email, immediately after the winner has been selected, and their name will be published on http://betterreading.com.au from Monday 23 April 2018, for a minimum of 10 days. The Promoter takes no responsibility for inaccurate or incomplete details. The winner must confirm their availability to attend the ABIA awards event by midday on Friday 27 April, 2018.
The Promoter reserves the right, at any time, to verify the validity of entries, and to disqualify any Eligible Entrant who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. any right not to award?There will be one major prize (The Prize) awarded to the winner who will receive:

The maximum total value of The Prize is AU$3,610.00
The Promoter reserves the right to award the prize to the next best entry in the event of a Winner not confirming their availability to attend the awards event. If any prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further judging, as required, at the same time and place as the original judging, on 27 April 2018. The winner, if any, will be notified on the same date of the rejudging, and their name will be published on http://betterreading.com.au from 27April 2018.
Prizes are not transferable or exchangeable unless otherwise stated and cannot be redeemed for cash or any other form of compensation. In the event for any reason a Prize Winner does not take any element of the Prize at the time stipulated by the Promoter, then that element of the Prize shall be forfeited by the winner and neither cash nor any other form of compensation shall be supplied in lieu of that element of the Prize, unless otherwise agreed. If the prize is unavailable or unredeemable due to unforeseen circumstances, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value.
If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
Entry details remain the property of the Promoter. Generally, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available at available at https://www.publishers.asn.au/privacypolicy. However, Entrants consent to the Promoter collecting, storing and using personal information provided for the purposes of facilitating the conduct of the promotion and awarding any prizes, and for current and future marketing and publicity (including notifications about future promotions and special offers about the Promoter’s products and services). In particular, the name and entry details of all entrants may be used for promotional purposes by the Promoter, unless an entrant otherwise notifies the Promoter.
Australian Consumer Law: A winner has rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter, including that any goods will be of acceptable quality. These terms and conditions do not exclude, restrict or modify those statutory rights in any way. However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, other than the Australian Consumer Law, regarding the quality and suitability of the Prize and will not be responsible for breach of any such implied terms.
By entering the promotion, to the extent permitted by law each entrant agrees to release and hold harmless the Promoter and its related bodies corporate, and each of their directors, officers, employees, representatives, vendors, partners and agents, from any and all liability whatsoever, and waive any and all causes of action, for or related to any claims, costs, injuries, losses, liabilities, or damages of any kind (including, without limitation, personal injury, death, damage to or destruction of property, rights of publicity or privacy and defamation) arising out of or in connection with the promotion or the prize (whether under contract, warranty or tort (including, without limitation, negligence).
