The following Terms and Conditions apply to the Samsonite Australia ‘Win 1 of 10 Samsonite Lite Shock’s’ Competition (the “Competition”).

The following Terms and Conditions apply to the Samsonite Australia ‘Win 1 of 10 Samsonite Lite Shock’s’ Competition (the “Competition”).

ABOUT THE COMPETITION
1. The Competition is run by Samsonite Australia Pty Ltd (ABN 31006363248) of 5 Anzed Court, Mulgrave Victoria 3170. Telephone (03) 9549 3444.
2. The Competition opens at 10am (AEDT) on Monday 7th November, 2016 (the “Opening Date”) and closes at 11:59pm (AEDT) on Monday 21st November, 2016 (the “Closing Date”).
3. The Competition consists of 10 x major prizes. To complete an entry, individuals will need to:

5. Entry to the competition is free. Major prize winners will be decided electronically by a game of chance.

ELIGIBILITY
6. Entry is only open to residents of Australia aged 18 years and over. Employees of Samsonite and their immediate family and agencies associated with this competition are ineligible to enter.

8. The Competition consists of 10 x major prizes.
Major Prize winners:
The draw will take place at Samsonite Australia, 5 Anzed Court, Mulgrave VIC 3170 at 10.00 am (AEDT) on Wednesday 23rd November 2016. The Promoter’s decision is final and no correspondence will be entered into.
9. Samsonite Australia will contact the Winner via email and telephone with further details on how to claim their prize following the announcement. Samsonite Australia will arrange for delivery of the Prize to the winner at an agreed Australian address. The winner will be published on the Samsonite Facebook page (https://www.facebook.com/SamsoniteAustraliaNZ/?fref=ts) on Friday 25th November 2016.
10. The Winner shall be initially contacted by e-mail and telephone. The winners are given three (3) months to claim their prize. If the winners do not respond within this time, Samsonite Australia reserves the right to select another winner from the remaining eligible entries. A draw for any unclaimed, will take place at 11am on Monday 27th February 2017, at Samsonite Australia, 5 Anzed Court Mulgrave VIC 3170, subject to any directions from a regulatory authority. The winner, if any, will be notified by telephone and email. All winners will be published on the Samsonite Facebook page (https://www.facebook.com/SamsoniteAustraliaNZ/?fref=ts) on Wednesday 29th February 2017.
11. Samsonite Australia shall not be liable for any claims or complaints of any nature with respect to the Prize. There is no cash alternative and the Prize is not negotiable, transferable or returnable.
12. The Winners agree not to sell, offer to sell or use the Prize for any commercial or promotional purposes (including the Prize on an internet auction site).

GENERAL
13. The Promoter reserves the right, at any time, to verify the validity of sales and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits a sale that is not in accordance with these Terms and Conditions or who tampers with the sale & entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
14. The Promoter reserves the right, at any time, to invalidate any sales & entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information that have been submitted through the use of multiple identities, email addresses or accounts.
15. Incomplete or indecipherable entries will be deemed invalid
16. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
17. The Promoter’s decision is final and no correspondence will be entered into.
18. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
19. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) then the prize (or that element of the prize) will be forfeited.
20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
22. Entrants consent to the Promoter using their name, likeness and image in the event they are a winner (including photograph) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
24. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
25. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) participation in a prize.
26. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
27. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
28. Any personal data that you provide will be held and processed in accordance with the requirements of the 1998 Data Protection Act.
29. Subject to any written directions from a regulatory authority, Samsonite Australia reserves the right to amend these Terms and Conditions and/or cancel the Competition at its sole discretion.
