Terms & conditions
1. VARIABLES
1.1 The Competition is open to residents of Australia, excluding ACT, and who are at least 18 years of age.
1.2 Commencement time: 09:00am Australian Eastern Standard Time (AEST).
1.3 Commencement date: 14 August 2017.
1.4 Closing time: 11:59pm AEST.
1.5 Closing date: 13 September 2017.
1.6 Draw time: 12:00pm AEST.
1.7 Draw date: 15 September 2017.
1.8 Draw location: 19 O'Riordan Street Alexandria NSW 2015.
2. WHO MAY ENTER
The only persons who may enter into the competition and be awarded prizes are those people specified in Condition 1.1 and who are not (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition;, or (ii) members of the immediate family of such employees and contractors, including any spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee or /contractor. The competition is not open to persons under the age of 18.
3. HOW TO ENTER
To enter the promotion entrant needs to enter the required details in to the ‘Wrangler X Yours and Owls X Universal Store Festival Prize Pack ’ entry form (including their first name, surname, date of birth, gender, email, mobile and postcode) then accept the terms and conditions of entry and submit entry into the draw. This entry form can been found via wrangler.com.au.
Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction, including any telephone, telephone or computer network, telephone lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
4. LIMITATIONS ON ENTRY
One entry allowed per person (identified by email) unless ‘shared’ with friend/s whom then also enter which will grant the referrer one extra entry per additional friend who enters. Additional entries are awarded to individual entrants when the person(s) that they have referred to the same competition has successfully entered the competition. Multiple entries per household are allowed. Persons wishing to enter must comply with condition 1.1.
5. DURATION
The competition commences at the time specified in Condition 1.2 on the date specified in Condition 1.3. Entries must be received by the time specified in Condition 1.4 on the date specified in Condition 1.5.
6. SELECTION OF WINNER
There will be two (2) winners drawn from the total entrant database at the time specified in condition 1.6 on the date specified in condition 1.7, and will be conducted at the location specified in condition 1.8. The first two valid entries as per condition 1.1 drawn will win the prizes. The ‘Wrangler X Yours and Owls X Universal Store Festival Prize Pack’ competition is a game of chance, thus skill plays no part in determining the winner. Each entry has a random and equal chance of being drawn. All valid entries received during the promotion period will be entered into the draw. The Promoter retains the absolute discretion to require any entrant to provide proof of residency at the Household address along with proof of age shown on their entry before awarding a prize.
The Promoter reserves the right to verify the validity of entries at any time during or after the promotional period, and reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions.
To the extent permitted by law, the Promoter is not responsible or liable for: (a.) inaccurate / incorrect transcription of entry information; (b.) purported entries that are not received for any reason, including because they were incorrectly uploaded or misdirected, or that are received, but are late, illegible, incomplete, or sent other than as directed in the entry instructions; (c.) unauthorised human intervention in any part of the competition; (d.) electronic or human error which may occur in the administration of the competition; (e.) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or (f.) any technical difficulties or equipment malfunction (whether or not under either Promoter’s control); (g.) any theft, unauthorised access or third party interference.
Promoter’s decision is final and no correspondence will be entered into
7. WINNER NOTIFICATION, PUBLICATION AND REDRAW
The winner will be notified by phone and email within 48 hours after the draw. The winner’s name and postcode will appear at www.wrangler.com.au by September 20th 2017. Despite the Promoter’s best efforts to contact the prize winner or deliver a prize, if a prize remains unclaimed by September 20th 2017 then, subject to any written directions given by a relevant lotteries or gaming authority the Promoter may conduct an unclaimed prize draw at the same time and place as the original prize draw on that date to distribute the unclaimed prize. The first valid entry drawn will win the unclaimed prize. The winner of the unclaimed prize draw will be notified by phone and email within 48 hours after the draw. The winner’s name and postcode will appear at www.wrangler.com.au by 30th September 2017.
8. PRIZE
There are two Wrangler X Yours and Owls X Universal Store Festival Prize Packs for the two winners and one person of their choice that are 18+ and meet the specifications in Condition 1.1. The value of each prize is $1681.20 AUD with a total value of $3362.40 AUD.
There are two prize packs to give away which each include:
a) Two Yours and Owls Festival VIP weekender passes for 30th September & 1st October 2017 at Stuart Park, Wollongong, NSW. Known as ‘Weekend Passes’, these tickets are valued at $291.10 each*, total value $582.20. These tickets include; access to the VIP area with a perfect view of the main stage. The VIP area has extra toilets, special bar and access to phone chargers.
b) Wrangler product to the value of $500 RRP. Product is subject to availability, selections and shipping address to be advised by winner.
c) One night’s accommodation at Novotel Wollongong Northbeach valued at $299.00
d) One $300 Flight Centre Voucher to spend on flights to help get you to the festival in Wollongong, NSW (only included in prize if winner is based outside of New South Wales). Winner must pay for any costs over $300, anything less is non-refundable. Further details at flightcentre.com.au
The prize is not transferable, exchangeable or redeemable for cash.
Spending money and travel to and from the winner’s closest capital city airport, all transport, travel insurance and other ancillary costs are not included in the prize and are the responsibility of the winner and their guests. It is the responsibility of the winner and their guests to make their own arrangements to get to the festival location within the required dates. Changes to travel dates after booking confirmation are at the winner’s expense. The promoter takes no responsibility for missed connections, flights, lost baggage, person or property mishaps. The promoter recommends that the winner and guests take out travel insurance while on this trip.
All elements of the prize are subject to availability, including flights. Wrangler Australia reserves the right to select and change partners or other elements of the prize.
It is a condition of accepting the prize that all components of the prize be taken during the trip (and are otherwise forfeited) and that all persons taking the trip sign a waiver of liability and an indemnity in the form determined by the Promoter in its absolute discretion. The Promoter accepts no responsibility for variations in holiday prize value.
If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant regulatory authority), to cancel, terminate, modify or suspend the Promotion, no refunds will be issued.
The winner and their nominated companion must abide by all Yours and Owls Festival 2017 ticket and event terms and conditions. In the event of a breach of these terms and conditions, the promoter will be permitted to withdraw the winner from this competition and deem the winner ineligible for the prize package.
9. PRIVACY AND COPYRIGHT
By entering the competition, the prize winner agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.
By entering the promotion, and forming a database the entrant consents to receive emails regarding the promotion from the Promoter as well as Universal Store’s other emails which inform the entrant of the Promoter’s and Universal Store’s other promotions, products, and events. Participants will have the option to unsubscribe to communications by Wrangler Australia and Universal Store should they choose at any point.
The Promoter and Universal Store is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter and Universal Store are entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
10. DISCLAIMER AND INDEMNITY
To the extent permitted at law, the Company and its related entities, officers, employees, contractors and agents disclaim any liability of any kind (including in contract, tort and breach of statutory duty) for loss, personal injury, death, property damage or otherwise that you may suffer yourself or cause to other persons or property as a result of any activities related to the prize that you undertake or commence, whether inspired by the Promoter or its related entities, officers, employees, contractors and agents, or otherwise.
The prize winner and his/her guests acknowledge their personal responsibility and knowingly and willingly assume the risks of associated with any activities related to the prize. The Promoter does not condone or encourage in any way the consumption of alcohol or use of illicit narcotics.
The prize winner and his/her guests agree to indemnify, defend and hold harmless the Promoter and its related entities and officers for any and all claims, demands, suits, loss, damage, injury, and liability, including costs, expenses, and reasonable solicitors fees arising from, or in any way connected with, the prize.
Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value. Each entry becomes the property of the Promoter.
