TERMS AND CONDITIONS
By entering the 250,000 Fans Celebration with Royal Caribbean competition (the “Competition”), you are agreeing to the following Terms and Conditions:
GENERAL
The promoter (‘the Promoter’) of this Competition is RCL Cruises (ABN 54 150 263 086) of Level 12, 157 Walker Street, North Sydney, NSW, 2060.
Information on how to enter and prizes forms part of the Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this Competition, these Terms and Conditions will prevail.

WHO CAN ENTER?

The Competition is open to all residents of Australia who are aged 18 years or older who are available to travel between 18/01/2018 and 27/01/2018 and 22/03/2018 to 26/03/2018 if drawn as a winner, as relevant to first, second and third place prizes, except employees (and their immediate families) of the Promoter and all companies and agencies associated with this Competition ("Entrants"). Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.
Entrants into this Competition must be 18 years of age as at the date of entry in order to be eligible to enter the Competition.
The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Requiring proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot or will not provide suitable proof (as determined by the Promoter, acting reasonably), the winner will forfeit the prize in whole and no substitute will be offered.
COMPETITION PERIOD
The Competition commences on Tuesday, 13 December 2016 at 10am ADST and concludes on Saturday, 31 December 2016 at 11.59pm ADST (the “Competition Period”). Entries must be received by the Promoter prior to the Competition close date and time, in order to be valid.
The Promoter accepts no responsibility for any late, lost or misdirected entries including online messages not received by the Promoter or delays in the delivery of the message due to technical disruptions, network congestions or for any other reason. Entries via automatic computer generation and not attributable to a valid individual are invalid and will not be accepted.
HOW TO ENTER
To enter, Entrants must undertake the following steps, during a Competition Period:
go to www.royalcaribbean.com.au/celebrate250 (“Competition Website”);
register their details including (but not limited to) full name, post code, date of birth, phone number, and valid email address. The cost of accessing the promotional website will be the Entrant’s responsibility and will dependent on the Entrant’s individual Internet Service Provider;
automatically opt in to Promoter's email database;
agree to the Competition Terms and Conditions and Promoter’s Privacy Policy; and
successfully submit their fully completed Competition entry form.
All entries once made, immediately become the property of the Promoter. All opt-in entries will be entered into a database and unless the Entrant advises that their name, address and telephone number are not to be used, the Promoter may use the Entrant’s names, addresses and telephone number for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being payable to the Entrant. By opting-in, Entrants confirm that they allow their details to be used for this purpose. If Entrants no longer consent to their details being used for future marketing purposes, the Entrant should contact the Promoter on the details set out below. Any request to update, modify or delete the Entrant’s details should be directed to the Promoter by emailing customerservices.au@rcclapac.com. Entrant's personal information will also be collected in order to conduct the Competition and the Promoter may, for this purpose, disclose such personal information to third parties, including but not limited to, agents, contractors, service providers, prize suppliers and as required, to the Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will also handle personal information as set out in its Privacy Policy available at http://www.royalcaribbean.com.au/privacyPolicy.do. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. Our websites reside in the United States and your information may therefore be stored outside Australia, either where you have consented to our use of your data, or, in order to provide the products and services you have requested.
Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Terms and Conditions.
If there is a dispute as to the identity of an Entrant, the Promoter shall, in its sole discretion, determine the identity of the Entrant.
All entries shall be deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the Entrant.
The Promoter takes no responsibility should an Entrant not have internet access permitting access to and use of the Competition Website.
Any entry that is made on behalf of an Entrant by a third party will be invalid, unless the Entrant requires the assistance of a third party to enter due to a genuine disability preventing the Entrant from making the entry him or herself.
The Promoter reserves the right to disqualify any Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. This includes, but is not limited to, Entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple entries. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s decision is final and the Promoter will not enter into correspondence with any Entrant regarding the Competition or any aspect of it.
Incomplete or indecipherable entries will be deemed invalid at the sole discretion of the Promoter.
NUMBER OF ENTRIES PERMITTED
Entrants are limited to one (1) entry per person. Duplicate entries will be deemed invalid.
DRAW
There will be twenty (20) winners drawn in this promotion. All entries received will be pooled into one (1) prize draw. The order in which Entrants are drawn will deem the corresponding prize they will win, with prizes awarded in descending order of value. The draw will take place on Wednesday 4th January 2017 at 10.00am AEDST at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway Erina NSW 2250. The Promoter reserves the right at its sole discretion to draw additional reserve entries in the draw (and record them in order), in the event that an invalid entry is drawn or the Entrant drawn is ineligible.
The winners will be contacted within two (2) business days of the draw in writing. Winners will then be advised how to redeem their prize. The name and locality of the winners will be published on the Competition Website at www.royalcaribbean.com.au/celebrate250 and on the Promoter’s social media channels, and other channels deemed appropriate by the Promoter from Thursday, 5 January 2017.
This Competition is a game of chance. Skill plays no part in determining the winners.
Should an Entrant’s contact details change during the Competition Period, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
PRIZES
There are a total of twenty (20) prize packs on offer.
The first valid entry drawn from all valid entries received, will win the first place prize of an eight (8) night cruise, for two (2) people on board Ovation of the Seas, departing Sydney, NSW on Friday, 19 January 2018 to the South Pacific, valued at up to AUD$6,110 depending on the winner’s point of departure. Prize includes:
Return economy flights for two (2) people from the winner’s nearest Australian capital city to Sydney, NSW (only provided if winner resides outside of NSW. If the winner resides in NSW, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash or for any other benefit);
One night, four (4) star accommodation in Sydney, NSW on Thursday, 18 January 2018 (night prior to cruise);
Eight (8) nights accommodation on board Ovation of the Seas;
An opportunity to Meet the Captain onboard Ovation of the Seas (subject to availability at the Promoter's sole discretion);

The next two (2) valid entries drawn from all remaining valid entries will each win the second place prize of a three (3) night Sydney Sampler cruise, for two (2) people, on board Ovation of the Seas, departing Sydney, NSW on Friday, 23 March 2018, each valued at up to AUD$3,250.50 depending on the winner’s point of departure. Prize includes:
Return economy flights for two (2) people from the winner’s nearest Australian capital city to Sydney, NSW (only provided if winner resides outside of NSW). If the winner resides in NSW, then the prize does not include airfares and the airfare component of the prize is not redeemable for cash or for any other benefit),
One (1) night, four (4) star accommodation in Sydney on Thursday, 22 March 2018 (night prior to cruise);
Three (3) nights accommodation on board Ovation of the Seas; and
Two (2) Live Life Big with Royal Caribbean Summer Packs (made up of branded thongs and cap, with size and style determined by the Promoter).
The next two (2) valid entries drawn from all remaining valid entries will each win the third place prize of a GoPro Hero4 and a Live Life Big with Royal Caribbean Summer Pack (made up of branded thongs and cap, with size and style determined by the Promoter). Each third place prize is valued at $329.
The next two (2) valid entries drawn from all remaining valid entries will each win the fourth place prize of a Jamie Oliver’s cookbook ‘Super Food’, Jamie Oliver Super Food DVD, Jamie Oliver Pantry Pack including Jamie Oliver pasta sauces, relish, spices and pesto, and a Live Life Big with Royal Caribbean Summer Pack (made up of branded thongs and cap, with size and style determined by the Promoter). Each fourth place prize is valued at $175.
The next six (6) valid entries drawn from all remaining valid entries will each win the fifth place prize of an Ovation of the Seas ship model, Ovation of the Seas pen, Ovation of the Seas mug and a Live Life Big with Royal Caribbean Summer Pack (made up of branded thongs and cap, with size and style determined by the Promoter). Each fifth place prize is valued at $99.30.
The next seven (7) valid entries drawn from all remaining valid entries will each win the sixth place prize of four (4) Event Cinemas movie tickets to see DreamWorks ‘Trolls’ the movie valued at $80. Movie tickets are valid while movie is showing. Any ancillary costs associated with redeeming the movie tickets are not included. Redemption of the movie tickets are subject to any terms and conditions of the issuer including those specified on the movie tickets.
Total prize pool is valued at up to AUD$14,874 based on published prices as at November 2016. All prices stated are in Australian dollars, represent the recommended retail price (RRP), include GST and are to the best knowledge, information and belief of the Promoter correct at time of printing.
Where relevant, flights (if required) will be chosen based on the most competitive fare available for the day of travel, subject to times being suitable, and the flight carrier chosen is at discretion of the Promoter. Flights will be a return economy ticket to the winner’s closest Australian capital city of residence.
If for any reason a winner is unable for whatever reason to accept a prize as stated above, the winner will forfeit the prize and no compensation will be given in lieu.
Unless specified otherwise, winners, of a cruise prize, and their travel companions (if any) are responsible for all other expenses not expressly stated as being included in the prize, including, without limitation, transport to and from airport departure point (including but not limited to additional domestic airfares if required to their nearest state capital city), meals and beverages, any sightseeing, tours or activities, any additional travel or accommodation, tips, transfers, personal spending money, travel insurance, passports, visas, vaccinations and all other ancillary costs, as well as obtaining any of these. The prize also excludes medical expenses, items of a personal nature, any onboard costs/expenditure (including but not limited to spa, shopping, casino, shore excursions, meals at specialty dining restaurants (unless otherwise stated) and anything else purchased onboard), laundry, telephone calls, additional nights, room or flight upgrades, incidentals, energy surcharges, gratuities, service charges, in-room charges or other ancillary costs associated with redeeming the prize, other than those specified. These costs and expenses are the sole responsibility of the winner and their travel companion (if any). Any extension to the duration of the prize is at the sole expense of the winner and their travel companion (if any) and is subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the domestic airfares provided by the Promoter as part of the prize.
Where relevant, it is the winner/s and their travel companion’s (if any) personal responsibility to ensure that they have valid travel and health documentation. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the winner and their travel companion (if any). The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination.
Any cruise prize/s are valid for two (2) guests, with at least one guest 18 years of age or older. During the entire duration of a cruise prize, a nominated parent/guardian must accompany any person under 18 years of age. Any additional passengers are subject to the prevailing standard fare for the selected cruise date at the time of making the booking. The value of the cruise fare is based on the Oceanview Stateroom grade cabin and any upgrades are unavailable. The prize is not transferrable to any other ship, cruise or date than that which is specified above.
It is a condition of accepting a prize that the winner and their travel companion (if any) must comply with all the conditions of use of the prize and the prize supplier’s requirements (as applicable). Without limitation, winners and their travel companion (if any) will be subject to the booking terms and conditions as set out at www.royalcaribbean.com.au.
The cruise prizes are a single event trip for the winner and their travel companion (if any) and cannot be separated into separate trips or components. Winners and their companion (if any) must travel together. The return flights (if any) for each route must be utilised at the same time, for the same travel dates, to and from the same destination. The air tickets are available on regular scheduled services of airlines and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airline’s departure city and their flight schedule. All travel is subject to availability at all times. Winners and their travel companion (if any) are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. Travel suppliers/airlines and booking time of flights to be chosen at Promoter’s discretion. Blackout periods may apply. Frequent flyer points are not available from any airline.
It is a condition of accepting a cruise prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay. Frequent flyer points will not form part of the prize.
Where relevant, it is the responsibility of the winners and their travel companion (if any) to ensure they are checked in for their flights and arrive at the airport on the correct date and at the time specified by the relevant airline carrier. The Promoter is not responsible for any costs associated with winners and/or their travel companion (if any) missing any of their flights or cruise.
Prize values are correct as at the commencement of the Competition Period. The Promoter accepts no responsibility for change in prize values between the commencement of the Competition Period and the ultimate date on which the prize is awarded.
The prizes must be taken as offered and are subject to booking and availability. The prizes, or any unused portion of a prize, is not transferable, exchangeable and cannot be refunded for or redeemed as cash. Prizes are not valid in conjunction with any other offer.
As a condition of accepting a prize, winners and their travel companion (if any):
consent to the Promoter, its related entities any other entities determined by the Promoter in its absolute discretion, using (if any of these parties elect to use) the name, image, likeness and/or voice of each of the winner/s and/or their travel companion (if any), in any manner and in any media worldwide for an unlimited period of time without remuneration, reference or further notification to the winner/s or their travel companion (if any), for the purpose of promoting the Competition (including any outcome); and
agree to participate in and cooperate with all reasonable media or editorial requests of the Promoter, its related entities and any other entities determined by the Promoter in its absolute discretion, including but not limited to being individually or jointly interviewed, photographed and filmed, and acknowledge that the Promoter, its related entities and any other entities determined by the Promoter in its absolute discretion, may use such interviews, footage and photographs in any media worldwide for an unlimited period of time without remuneration to anyone, reference or further notification to the winner/s or their travel companion (if any). The inclusion of any such interviews, footage or photographs (including but not limited to creative control of the feature) will remain with the Promoter, its related entities and/or any other entities determined by the Promoter in its absolute discretion at all times.
In the event that a prize, or part of a prize, is unavailable (for any reason beyond the Promoter's reasonable control), the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater recommended retail value and/or specification, subject to any written directions from the various lottery departments.
It is a condition of accepting a prize that the winner and their travel companion (if any) may be required to sign a legal release (including but not limited to for use of their image) in a form determined by the Promoter in its absolute discretion.
Prizes (where relevant) must be taken on the dates specified. In the event a winner does not take a prize on or by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
Winner/s acknowledge and accept that some prizes that form part of the prize pool are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Some onboard activities attract age, weight and height restrictions that may prevent some winners from participating. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may take place.
UNCLAIMED PRIZE DRAW
If any prize remains unclaimed by Tuesday, 4 April 2017, The Promoter may conduct a further draw at the same time and place as the original prize draw as necessary on Wednesday, 5 April 2017 in order to distribute any prize/s that remain unclaimed by that date, subject however to all reference to any relevant State and Territory regulations. Winners (if any) will be notified in writing within two (2) business days of the draw and the name and locality of the winners (if any) will be published on the Competition Website www.royalcaribbean.com.au/celebrate250 from Friday, 7 April 2017. The Promoter will organise movie tickets to an alternate movie for any sixth place prizes awarded in the unclaimed prize draw.
Caution: any attempt to deliberately damage any website or the information on a website, or to otherwise undermine the legitimate operation of this competition, may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the promoter reserves the right to seek damages to the fullest extent permitted by law.
LIABILITY AND RELEASE
Except for any liability that cannot be excluded by law, the Promoter, its related entities and each of their respective officers, employees, contractors and agents, exclude all liability (including for negligence) for any personal injury and any loss or damage (including to persons or property and including consequential loss and loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any electronic or human error which may occur in the administration of the Competition; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by the winner or an Entrant; (g) entry into and/or participation in the Competition and/or (h) the prize and/or redemption of the prize. This condition does not affect, and is not intended to affect, any rights an Entrant may have as a consumer, which cannot be excluded under applicable consumer protection laws.
To the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability or merchantability of a prize.
FURTHER TERMS AND CONDITIONS
The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
If for any reason this Competition is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the reasonable control of the Promoter, the Promoter reserves the right in its sole discretion take any action that may be available, and (without limitation) to cancel, terminate, modify or suspend the competition, subject to any direction given under State or other applicable Regulation or Law.
