CONDITIONS OF ENTRY
1. By entering this Promotion, Entrants agree to abide by these Conditions of Entry. The Promoter is Gilded Cage Pty Ltd, ABN 18 601 057 916, 497 Princes Highway Fairy Meadow NSW 2519
Australia.
2. The Promotion commences at 11.00am AEDT on 23 March 2017 and closes at 16.00pm AEDT on 4 May 2017 (Promotion Period).
3. Entry is open to any Australian resident aged 16 years or older (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
4. To enter the Promotion, Entrants must “Like” the Gilded Cage Facebook page www.facebook.com/worldgildedcage then enter via the Facebook App during the Promotion Period (Entry).
5. Entrants may only enter the Promotion once during the Promotion Period. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any
delay in, or failure of transmission, which causes an Entry not to be received within the Promotion Period.
6. No purchase is necessary to enter. Purchasing products will not help your chances of winning.
7. There is one (1) Major Prize valued at $647.45. The Major Prize includes 3 x Unleashed lipstick $84.00, 3 x Revelation eyeshadow $81.00, 3 x Charisma Lipgloss $63.00, 1 x Square Tote $299.95, 1 x Mini Travel Bag $119.50. Prizes are not exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prizes.
8. The Prize Draws will be conducted 4 May 2017 at 16:01pm AEDT at 3/145 William St, Darlinghurst NSW 2010. The Prize winner will be the first valid Entry drawn.
9. The Prize Winner will be notified by email within one (1) business days of the Prize Draw, and have their name will be published on the Gilded Cage Facebook Page (www.facebook.com/worldgildedcage), on 5 May 2016, 10:00am AEDT. Winner will be provided with details of how to claim their Prize and the date by which they must claim their Prize (Prize Claim Date). Winners may need to provide sufficient identification in order to claim their Prize.
10. If the prize is unclaimed by the Prize Claim Date (4/08/17), subject to any directions from a regulatory authority, the Promoters may conduct a further draw on 4 Aug 2017 at the same time and location as the Prize Draw, in order to distribute the unclaimed Prize (Unclaimed Prize Draw). In the case of a winner, they will be notified by email within one days of the Unclaimed Prize Draw, their have names will be published on the Gilded Cage Facebook Page (www.facebook.com/worldgildedcage), on 5 August 2017.
11. By entering this Promotion and submitting content you authorise that it is your own content and that you are permitted to distribute such content.
12. The Promoters reserves the right to disqualify entries if the entry has violated the Terms & Conditions in any way.
13. The Promoters’ decision is final and binding and no correspondence will be entered into. The Promoters reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability
(including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter´s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters;
(d) any tax liability incurred by a winner or entrant; or
(e) use of a prize.
16. If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoters or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoters reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
17. The information entrants provide will be used by the Promoters for the purpose of conducting this Promotion. The Promoters may disclose Entrants’ personal information to companies and agencies connected with this Promotion.
18. This Promotion is not sponsored, endorsed, administered by or associated with Facebook. You understand that you are providing your information to The Promoters and not to Facebook.
19. In order to conduct this Promotion, the Promoters need to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Promoters’ database. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Promoters’ Privacy Policy.
Entrants should direct any request to access, update or correct information to the Promoters. All personal details of Australian entrants will be stored at the office of the Gilded Cage Pty Ltd. Upon the entrant’s request, all information provided will be removed from our active database. 20. The collection, use and disclosure of personal information in connection with the Promotion is governed by the Australian Privacy Act 1988 (Cth). By entering the Promotion, Entrants agree and consent to the Promoters:
i. using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion;
ii. using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including email and SMS, unless an Entrant otherwise withdraws their consent to the use of their
information in this manner; and
iii. using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
