WHO CAN ENTER?
To be eligible to enter you must: • reside in Australia and who holds Australian citizenship or holds an Australian permanent residency visa; • Employees of Bosch Australia, their immediate families and any agencies associated with this competition are ineligible to enter and described in further detail below; and • Be over 18 years of age. HOW TO ENTER • The competition period commences at 11:59pm AEST on 10 December 2021 and ends at 11:59pm AEST on 20 December 2021 (“Competition Period”). • To enter the competition, you must submit an online entry by providing your full name, mobile number, email address, postcode, state, and accept these Terms and Conditions where required on the competition landing page at www.supercars.com/favouritechampion during the Competition Period. • The competition will be advertised on the Bosch Australia website, Bosch Australia Facebook page, Bosch Australia Instagram, Supercars Australia website, and will include a link or instructions to the competition landing page. • No late entries will be accepted. • A limit of one entry to the competition per person applies. SELECTION OF WINNERS • Three (3) winners will be chosen by random draw which will take place from: 10am AEST on 21 December 2021 • at Greenroom Digital, 343 Ferrars Street, South Melbourne, Victoria, Australia 3205. • The winners will be notified by email and/or telephone on the day of the draw. • The results of the draw will be final, and binding and no correspondence will be entered into in relation to the results of the draw. This is a game of chance. • The winners will be published on the website UNCLAIMED PRIZE DRAW • If one or more of the winners do not comply with the Terms and Conditions, cannot be contacted or does not respond within 1 week of being notified by Greenroom Digital that they have won the competition, one or more of the winners are not readily identified and reasonable efforts have been made by Greenroom Digital to identify those winners were unsuccessful, they will automatically forfeit their prize and Greenroom Digital reserves the right to select another winner or winners through a second chance draw. • As the prize is for an event, if necessary, an unclaimed prize draw will be held on 21 March 2021 at the same time and place as the first draw. The first valid entry or entries drawn will win any unclaimed prizes. The unclaimed prize draw winner or winners will be notified by email and/or telephone on the day of the draw. • The results of any unclaimed prize draw will be final, and binding and no correspondence will be entered into in relation to the results of the draw. • The winner will be published on the website PROMOTION AND MARKETING • Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Bosch Australia (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. • By entering the competition, the winners agree to participate in such promotional activity and material as Bosch Australia may require without remuneration. • The winners also consent to the use and publication of their name and any other details provided by the winners in any marketing material without any further reference or payment to the winners. • Except or any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Bosch Australia (including their respective officers, employees and agents) are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: a. any technical difficulties or equipment malfunction (whether or not under Bosch Australia’s control); b. any theft, unauthorised access or third-party interference; c. any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Bosch Australia) due to any reason beyond the reasonable control of Bosch Australia; d. any variation in prize value to that stated in these Terms and Conditions; e. any tax liability incurred by a winner or entrant; or f. taking of the prize/attendance at the prize event. Bosch Australia collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to the Supercars (https://www.supercars.com/privacy-policy/) and other third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. Bosch Australia will also use, and handle PI as set out in its Privacy Policy available at https://www.bosch.com.au/privacy-policy/ In addition to any use that may be outlined in the privacy policies identified above, Bosch Australia and the Supercars may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The privacy policies also contain information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of Bosch Australia and the Supercars. Bosch Australia and the Supercars may disclose Australian entrant's PI to any entity outside of Australia in accordance with their respective privacy policy. PRIZE • Three (3) x Bosch 18V Brushless Impact Wrench Kits packs valued at $929 each) • No part of a prize is exchangeable or redeemable for cash or any other prize. • If the prizes are not available for any reason, Bosch Australia reserves the right to substitute the prize with another item of equal or greater value if the winners agree in writing and subject to any written directions from any applicable regulatory authority. If the winners do not agree despite reasonable attempts by Bosch Australia to reach an agreement and the prize is not available due to circumstances beyond Bosch Australia control, Bosch Australia may substitute the prize with another item or items determined by Bosch Australia to be of equal or higher value. • The corporate ticket element of the prize is subject to the event venue and ticket terms and conditions, including any applicable age restriction. Bosch Australia and event organisers hereby expressly reserve the right to eject the winner (and/or their companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize. STANDARD TERMS • Please read these competition terms and conditions carefully. If you enter the competition, we will assume that you have read these terms and conditions and that you agree to them. • Bosch Australia reserves the right to amend the competition and its terms and conditions at any time and for any reason, subject to regulatory approval (if required) and will notify entrants of any such amendments as soon as reasonably practicable on the competition landing page at Bosch Australia. It is the entrant's responsibility to regularly check the competition landing page for any amendments. Any amendments will be applied and interpreted at the sole discretion of Bosch Australia. • If the competition is not capable of running as planned to include by reason of technical failure, fraud or any cause beyond Bosch Australia ‘control, Bosch Australia may cancel or suspend the competition or invalidate any affected entries, to the extent permitted by law. • Bosch Australia does not accept responsibility for any entries that are delayed or which are not received for any reason during the competition period. • To the extent permitted by law, Bosch Australia shall not be liable for any loss, damage or injury suffered in connection with the conduct of the competition or the redemption or use of the prize (including but not limited to direct loss) including: o technical or telecommunications problems (such as security breaches, technical website malfunctions or glitches); or o acts or omissions (including negligent acts of omissions) of Bosch Australia’s servants or agents involved in the conduct of this competition who are acting outside their authority as agent of Bosch Australia. • Bosch Australia and entrants acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with Facebook or Instagram. • Bosch Australia is not liable for any tax implications arising from prize winnings, including fringe benefits tax. Independent financial advice should be sought. • The laws of Victoria apply to this competition. Entrants submit to the exclusive jurisdiction of the courts of Melbourne, Victoria.
