Terms and Conditions
By entering the screenPLAY Digital Giveaway #3 08/09/17 competition (“the Competition”), the entrant agrees to the following terms and conditions:
STANDARD TERMS
Information on how to enter forms part of the terms of entry.

WHO CAN ENTER?

Subject to clause 2.2, entry is open to all residents in Australia where the Channel Seven signal is received.
Employees and their immediate families of Seven Network (Operations) Limited, St George Bank and Nintendo and their associated agencies and companies are not eligible to enter.
HOW TO ENTER
The Competition commences on 08/09/17 from 1530 AEST and concludes at 1600 AEST on 04/10/17 (“the Competition Period”).
Entrants must create an entry which is their best interpretation of what it means to “switch something up” then post the entry on Twitter or Instagram using the hashtag #screenPLAYswitch.
Entries must be received within the Competition Period.
Entrants (including winners) in the Competition may enter as many times as they like but each entry, including any written comments, must be unique and:
(a) the original independent creation of the entrant; and
(b) free from any claims, including copyright or trademark claims, by other parties.
You MUST have the permission of any individual depicted (and be their parent/guardian in the case of any child).
Entry details remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use, distribute, broadcast and sub-licence their entries and written comments in all media and platforms worldwide and acknowledge that they will not be entitled to any fee for such use.
Entrants consent to their name, social media handles, and Facebook, Twitter and/ or Instagram profile photograph(s) being shared and distributed throughout the world in all media and all platforms, and acknowledge that they will not be entitled to any fee for such use.
Entrants warrants they are the owner of the copyright in their Facebook, Twitter and/ or Instagram profile photograph(s), or they have obtained full prior consent from any person who has any rights in the Facebook Profile photograph, and the Content does not infringe the rights of any third party.
PRIZES
There will be three (3) prize winners who will each receive the prize package detailed in clause 4.2.

Total maximum value for prize package(s) is AUD$1407.00 (inclusive of GST). Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
In the event that the Winner can not attend the event at the prescribed time and date, the prize is forfeited.
In the event that an element of a product prize outlined above is, for any reason not available, an equal or better prize will be substituted in its place. The winner will have no claim to the element of the prize that is no longer available.
Any cost associated with accessing the promotional websites is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Unless expressly stated in these terms and conditions all other expenses become the responsibility of the major prize winner and (where applicable) their companion, including but not limited to all travel, accommodation, meals, spending money, incidentals, telephone calls and all other ancillary costs.
In accepting the prize the winners agree to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media and online platforms worldwide and the winners will not be entitled to any fee for such use.
The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
It is a condition of accepting the prize that the winner’s must comply with all the conditions of use of the prize and Sponsor’s requirements.
Prizes cannot be redeemed for cash and are not transferable or exchangeable.
Prize winners must have an Australian address to which prizes may be sent.
Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.

Subject to state permit authority restrictions, the Promoter may amend these terms and conditions in its absolute discretion.
WARRANTIES
Entrants agree that they are fully responsible for any materials they submit via the Competition including but not limited to comments, videos and photographs (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. Entrants warrant and agree that:
i. they will not submit any Content that is unlawful or fraudulent, or in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
ii. their Content shall not contain viruses or cause injury or harm to any person or entity;
iii. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
iv. they are the parent or legal guardian of any child and/or children appearing in any Content and give consent to the use of the Content for the purposes described in these terms and conditions;
v. they are the owner of copyright in the Content, or they have obtained full prior consent from any person who has jointly created or has any rights in the Content, and the Content does not infringe the rights of any third party;
vi. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
vii. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
Entrants acknowledge that the public will have the capacity to comment on the Content, and will not hold the Promoter or Sponsor liable for the publication of any comments, whether derogatory, offensive, racist, defamatory or otherwise, posted in relation to the Content.
HOW TO WIN
There will be three prize winners. All entries will be judged by a panel of judges appointed by the Promoter in its absolute discretion at the offices of Seven Network (Operations) Ltd, 8 Central Avenue, Eveleigh NSW 2015. The first winner will be judged and chosen at 1700 AEST on 20/09/17. The second winner will be judged and chosen at 1700 AEST on 27/9/17. The third winner will be judged and chosen at 1700 AEST on 04/10/17. The entrant(s) whose entry is deemed to be the funniest and most creative entry out of all entries received will be deemed the winner. The Competition is a game of skill and chance plays no part in determining the winner. Any entry received at any time during the Competition Period, prior to any of the three prize draws, is eligible to win in any draw.
The first winner will be announced in the episode on 21/9/17. The second winner will be announced in the episode on 28/9/17. The third winner will be announced in the episode on 05/10/17.
The prize winner(s) will be notified by either a phone call, an email, or social media correspondence from the Promoter within two weeks of the judging.
Entrants in the Competition may enter as many times as they like.
The judges’ decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result. The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional judging will be conducted.
It is a condition of accepting the prize that the major prize winner(s) (and their companions) agrees to comply with all the conditions of use of the prize and prize supplier’s requirements.
It is a condition of accepting the prize that the major prize winner (and their companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
NO LIABILITY
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions.
Seven Network (Operations) Ltd, and its associated agencies and companies will take no responsibility for defective prizes or prizes damaged or lost in transit, or late, lost or misdirected mail.
Seven Network (Operations) Ltd, and its associated agencies and companies will not be liable for any claims, misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:a) during entry into the competitionb) during the judging;
c) whilst undertaking any travel won on or connected with their entry into the Competition; or
d) in accepting of or participating in the prize;
e) as a consequence of late, lost or misdirected mail;
f) due to the broadcast or publication of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
g) in relation to failure of an entry to be received by the Promoter on account of technical problems, website or phone anomalies, or traffic congestion; or
h) to entrant or any other person’s computer software, computer equipment or internet connection resulting from or related to participation in this Promotion;
i) any variation in Prize value to that stated in these Terms and Conditions that is not due to an intentional error by Seven and/or its agencies and affiliates;
j) any technical difficulties, technical error or equipment malfunction (whether or not under the Promoter’s control);
k) any error, omission, interruption, deletion, delay, defect, theft, unauthorised access or third party interference; or
l) due to any change in these terms and conditions or any change in Seven’s programming, scheduling or production of broadcast material
The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements.
If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.

By providing your personal information below, you agree to the terms of the Privacy Policy. Without limiting the foregoing, Seven may disclose the entrant’s personal information to its related entities, business partners and external service providers for research and profiling purposes as well as other purposes reasonably related to the entrant’s relationship with Seven. In addition, by entering this competition, you consent to Seven using your personal information for the purpose of Seven and its related entities sending you information regarding programs, products and services available through them and/ or through their business partners, and to Seven from time to time sharing your personal information with carefully selected business partners for the purpose of them sending you such information directly.
