1. BINDING AGREEMENT. BY ENTERING INTO THE PANDORA STYLE EDIT COMPETITION (“Competition”) OUTLINED BELOW, YOU ARE ENTERING INTO AN ELECTRONIC CONTRACT WITH SPONSOR TO BE BOUND BY THESE OFFICIAL RULES GOVERNING THE COMPETITION. THEREFORE, PLEASE READ THESE OFFICIAL RULES CAREFULLY BEFORE PROCEEDING. Sponsor encourages you to print and keep a copy of these Official Rules for your records.
2. SPONSOR. The Competition is made available to you by Pandora A/S ("Sponsor") located at Level 5, 12 Narrabang Way, Belrose NSW Australia
3. DURATION. The Competition begins on March 12th at 12.00 am AEST, and ends on May 28th at 11.59 pm AEST. (“Term”).
4. ELIGIBILITY. The Competition is open only to persons who have a minimum age of 18 years as of the date of entry, and who are legal citizens or permanent residents of Australia or New Zealand. The Competition is subject to all applicable laws and regulations and is void where prohibited or restricted by law. Employees of Sponsor or any of its affiliates, distributors or dealers, its agencies, or members of their immediate families, or persons living in same household, are not eligible to enter or win. Sponsor reserves the right to verify the eligibility of winners.
5. ENTRY. Entries must be submitted online via www.pandora.net/styleedit during the Term. To enter, participants must visit the Campaign Page during the Term and sign up to become a PANDORA Club member. Existing PANDORA Club members can enter by signing in to the PANDORA Club via the competition entry page during the Term. No entries may be submitted on behalf of another person. The use of automatic or robotic entry devices is prohibited. Entries will not be returned or acknowledged. Sponsor reserves the right to verify the authenticity and accuracy of all information provided through the Competition Page.
6. ELECTRONIC COMMUNICATIONS. By submitting your Competition entry via the Competition Page, you agree to do business with Sponsor electronically. By agreeing to do business electronically, you (i) consent to your personal data being stored on Sponsor’s servers, (ii) consent, subject to Sponsor’s Privacy Policy and Rule 11 below, to the electronic communication and delivery via e-mail and post of all documents related to the Competition, (iii) agree that your act of submitting your Competition entry is a binding form of your electronic signature, which you agree binds you to these Official Rules. This consent is effective unless and until you withdraw it. You may withdraw your consent to electronic communication and delivery of documents or update your contact information at any time by contacting Sponsor at au-digitalmarketing@pandora.net We will send you a confirmation notice once we have processed your change request.
7. WINNER SELECTION. Although this sweepstakes is referred to as a “Competition” throughout these Rules, the Competition is in fact a game of chance and NOT of skill. There will be 3 winners at the conclusion of the competition. You will get an entry for participating. The winner selection will occur at 11am on Friday 29th May at PANDORA Australia, Level 5, 12 Narrabang Rd, Belrose, NSW, 2085. The winner will receive an email using the contact information provided by the participant at the time of entry. Winners will be published on pandora.net/styleedit from 2nd June 2015. The winner will have to respond to an e-mail from the Sponsor, in order for the Sponsor to receive all the right details, including the winner’s choice of one of two prize packs as well as ring and bracelet sizes. Failure to respond to prize notification by a potential winner within three (3) months of Sponsor notifying the potential winners by e-mail will result in forfeiture of the applicable prize. Any prize awarded may be forfeited if a prize winner fails to comply with these Official Rules. In the event of prize forfeiture by a prize winner, Sponsor will select an alternative prize winner. . A redraw for any unclaimed/forfeited prizes will take place on 31st August 2015 at PANDORA Australia, 13 Narrabang Rd, Belrose, NSW, 2085. A PRIZE WINNER IS ONLY ENTITLED TO RECEIVE THE PRIZE ONCE HE OR SHE HAS SATISFIED ALL REQUIREMENTS IN THESE OFFICIAL RULES. Your odds of winning depend on the number of entrants in the Competition.
8. PRIZES. There will be three prizes awarded. The three winners will be able to choose one prize pack from a choice of two prize packs. Prize Pack One includes: 1 x Alluring brilliant ring (valued at AU$79), 1 x Pair of Petite Heart Gold Earrings (Valued at AU$169), 1 x New Beginning Necklace (Valued at AU$169), 1 x Primrose Openwork Charm (Valued at AU$30) and 1 x Silver Moments Bangle (Valued at AU$69). Prize Pack Two includes: 1 x Pair of Petite Butterfly gold earrings (Valued at AU$169), 1 x White Primrose Ring (Valued at AU$65), 1 x Dazzling Daisies Meadow Charm (Valued at AU$69), 1 x White Primrose Meadow Charm (Valued at AU$69), 1 x Double metallic silver leather bracelet (Valued at AU$75) and 1 x Sparkling Butterfly ring (Valued at AU$69). The total value of each prize pack is AU$516. The total prize pool value is AU$1,548. The prizes will be dispatched to each winner within thirty (30) days of each winner responding to the prize notification. Prizes are non-transferable, may not be substituted by the prize winner, and are not redeemable for cash and no cash alternative is offered. Sponsor will not replace any lost or stolen prizes or components of a prize(s). All taxes, fees, duties, surcharges, if any, associated with the redemption of the prize are the responsibility of the prize winner. Sponsor reserves the right to substitute a prize of equal or greater value for any reason.
9. INTELLECTUAL PROPERTY RIGHTS. By submitting his or her entry a participant irrevocably assigns to Sponsor any and all intellectual property rights, including but not limited to any copyright, in any entry submitted by the participant for Sponsor to hold in its own right. Sponsor may use or not use, for any purpose, on any media, in whole or in part, in its original or amended form any entry submitted by the participant. Entrant further agrees that if Sponsor elects to use entrant’s Entry, entrant will execute any documents requested by Sponsor regarding the assignment. By submitting his or her entry a participant also waives his or her moral rights in the entry including the right to be credited as the author and the right to object to derogatory treatment of the work. This waiver is only effective in jurisdictions where it is possible to waive such rights.
10. DISCLAIMERS. Sponsor assumes no responsibility and is not liable for entries that are late, delayed, misdirected, illegible, or incomplete, and Sponsor assumes no responsibility and is not liable for system errors and failures, mechanical equipment malfunctions, viruses, hacker attacks,
faulty transmissions, or other telecommunications malfunctions. Proof of transmissions does not constitute proof of entry. By entering the Competition, each participant agrees to be bound by these Official Rules and the decisions of Sponsor.
11. PRIVACY. Sponsor respects your privacy. Personal data of participants is gathered and processed in accordance with the applicable data protection laws, and subject to Pandora’s Privacy Policy, which may be reviewed by visiting www.pandora.net/en-au/pandora- company/terms/privacypolicyaustralia for Australian residents or http://www.pandora.net/en- nz/pandora-company/terms/privacypolicyaustralia for New Zealand. By submitting your entry into the Competition, you are registering to receive electronic communications via Communications via email from Sponsor relating to the Competition as well as campaign and promotion.. This information will be used by Sponsor for a full calendar year after the competition, in this case in all of 2015 .
12. RIGHT TO CANCEL OR TERMINATE. If, for any reason, the Competition is not capable of running as planned, including because of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, corruption, hacker attacks, faulty transmissions, force majeure, or any other cause beyond the control of Sponsor which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Competition. And, in such an instance, Sponsor may, in its sole discretion, decide to award the prizes by random drawing of all eligible entries if it is able to do so fairly. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
13. PERMISSION TO USE NAME/LIKENESS. Any prize winner, by submitting an entry, grants the right and permission to have his or her name, picture and likeness used by Sponsor only for campaign and promotion. Sponsor reserves the right but may choose not to do so.
14. RELEASE OF LIABILITY. Each participant, by entering the Competition, and the winners, by accepting any prize, release Sponsor and Sponsor's affiliates, distributors and dealers, and their agencies, directors, officers, agents and employees from any and all liability, claims or actions of any kind whatsoever for any damage, loss or injury (excluding death or personal injury caused by negligence), any claims based on publicity rights, defamation, invasion of privacy, or merchandise delivery, resulting from or arising out of participation in the Competition, or from the acceptance, use, misuse, possession, loss or misdirection of the prizes. The above parties are not responsible if any prize cannot be awarded due to cancellations, delays, or interruptions due to acts of God, acts of war, natural disasters, weather or terrorism. By entering this Competition, entrant agrees that THE ABOVE PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES TO PERSONS OR PROPERTY (EXCLUDING DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE) ARISING OUT OF ACCESS TO AND USE OF ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR THE DOWNLOADING FROM AND/OR PRINTING MATERIALS DOWNLOADED FROM SUCH SITE.
15. CONDUCT. By participating, you agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification or ineligibility to receive a prize. You further agree to comply with and be bound by decisions of Sponsor, which shall be final in all respects. Sponsor reserves the right at its sole reasonable discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the operation of the Competition and/or the Competition Page; (b) violating these Official Rules; (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
16. DISCLAIMER. THE PRIZES WILL BE AWARDED AS IS AND TO THE FULLEST EXTENT PERMISSIBLE UNDER LAW THE SPONSOR DISCLAIMS ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE PRIZES. However, nothing in these Rules shall affect your statutory rights including in relation to any PANDORA product received as a prize.
17. GOVERNING LAW AND VENUE. The Competition is governed by the laws of NSW. Subject to your legal rights as a consumer by entering the Competition participants consent to the jurisdiction and venue of the local court in NSW for the resolution of any disputes. The competition is authorised to run in Australia under permit numbers: NSW Permit No. LTPS/15/01146 and ACT TP 15/04779
