TERMS AND CONDITIONS
1. This competition (“Competition”) is conducted by Coca-Cola South Pacific Pty Ltd, ABN 50 003 029 794, of Level 9, 40 Mount St, North Sydney, NSW 2060 (“Promoter”). Phone number 1800 283 391.
2. Entry into the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
TERMS AND CONDITIONS
1. This competition (“Competition”) is conducted by Coca-Cola South Pacific Pty Ltd, ABN 50 003 029 794, of Level 9, 40 Mount St, North Sydney, NSW 2060 (“Promoter”). Phone number 1800 283 391.
2. Entry into the Competition constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
3. Only open to “Eligible Entrants”. An Eligible Entrant is an individual who is an Australian resident as at the time of entry, excluding any: (i) employee of the Promoter or any of its related corporations or any of their agencies associated with the Competition; (ii) employee of Coca‑Cola Amatil (Aust) Pty Ltd, ABN 68 076 594 119 (iii) spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iv) person who the Promoter has previously notified is not permitted to enter the Promoter’s competitions. Eligible Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this Competition.
4. Competition opens at 00:01 hrs on 04/04/2016 and closes at 24:00 hrs on 15/05/2016 ("Promotional Period"). All times and dates are times and dates in Sydney which will be Australian Eastern Standard Time (“AEST”). All times are stated using the 24 hour clock. 00:01 hrs is the start of a day and 24:00 hrs is the end of the day.
5. “Promotional Product” means any of the following Coke Trade Mark product including Coca-Cola, Coca-Cola Life, Coca-Cola Zero, diet Coca-Cola, Fanta, Sprite, PUMP, Powerade, Powerade Zero, Barista Bros, Fountain Cups and DP Beverages Limited Trade Mark product Fuze Tea
6. “Participating Retailer” means any retailer that stocks Participating Products.
7. To be eligible to enter the Eligible Entrant must purchase any Promotional Product from a Participating Retailer nationally during the Promotional Period.
8. To enter, Eligible Entrants must enter online by undertaking the following steps during the Promotional Period:
• visit www.coca-cola.com.au (“Competition Website”),
• follow the prompts to the Competition entry page, input the requested details including the last four (4) digits of their purchase receipt and the last four (4) digits from the barcode of their Promotional Product;
• answer the question “There have been so many amazing moments from the Olympics over the years. Please tell us which of these moments was the best for you and why you think it deserves to be at the top of the list?” in 50 words or less;
• submit the fully completed entry form.
9. Any cost associated with accessing the Competition Website is the Eligible Entrant's responsibility and is dependent on the internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and may render all entries submitted by that Eligible Entrant invalid.
10. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
11. Incomplete or indecipherable entries will be deemed invalid.
12. Multiple entries permitted, subject to these conditions, including the following: (a) only one (1) entry permitted per Promotional Product purchased; (b) each entry must be submitted separately and in accordance with entry requirements and these Terms and Conditions; (c) unrecognised barcodes and/or receipt numbers will be deemed invalid; and (d) a limit of one (1) entry per Eligible Entrant per day is permitted. The Promoter reserves the right, in its absolute discretion, to block any Eligible Entrant from entering the Competition who attempts to enter invalid barcodes and/or receipt numbers through the Competition Website at any stage.
13. Entrants must retain their Promotional Product label(s) (including the barcode) as well as a photocopy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize.
14. The Promotional Period will be divided into forty two (42) daily entry periods (each a “Daily Round”). Entries into each Daily Round open and close each day based on Sydney local time. The judging for each Daily Round will take place from 11:00 at Handling Matters, Unit 1/3 Green Street Brookvale NSW 2100 on the first NSW business day after entries close for that Daily Round, with the first judging date commencing at 11:00 on 05/04/2016 and last judging commencing at 11:00 on 16/05/2016. The judges may select additional reserve entries, in each Daily Round, which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant. Non-winning entries in each Daily Round will NOT be entered into any subsequent Daily Round(s). This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the genuinity of how amazing the Olympic moment is; the type of moment that captures the spirit of the Olympics (that does not have to be directly linked to winning a gold medal); the originality and uniqueness in description of why it’s an amazing moment; the consumer justification as to why that particular moment should be top of the list; the level of creativity the consumer has displayed; and literary merit.
15. The best valid entry, as determined by the judges, in each Daily Round, will be deemed a finalist (“Finalist”). Each Finalist will be awarded a $1,000 Visa Pre-Paid gift card (“Gift Card”). All taxes (excluding GST) which may be payable as a consequence of receiving a Gift Card are the sole responsibility of the winner. Any ancillary costs associated with redeeming the Gift Card are not included and are at the sole expense of the winner. Any unused balance of the Gift Card will not be awarded as cash. Redemption of a Gift Card is subject to any terms and conditions of the issuer outlined in clause 16 including those specified on the Gift Card.
16. It is a condition of accepting a Gift Card that the winner must comply with all the conditions of use of the Gift Card and the Gift Card supplier Edge Loyalty Systems Pty Ltd ABN 96 138 299 288 (the "Gift Card Supplier”) requirements:
a. Gift Cards may be used for goods or services at any retailers in Australia with Visa facilities who accept the Gift Card, when the Gift Card has enough unused value to make the purchase.
b. All Gift Cards must be activated by the data stipulated on the card. Funds must be redeemed within 12 months of activation. Gift Cards will be loaded 24-36 hours after activation and cannot be redeemed for cash, reloaded, returned for a refund, have their balances consolidated to a new card, or be replaced after expiry and are not legal tender, account cards, credit or debit cards or securities.
c. The Gift Card Supplier is not liable for the availability, quality or fitness for purpose of any goods or services purchased with the Gift Card. Any dispute about goods or services purchased with the Gift Card must be resolved with the supplier of those goods or services. Except for rights, which cannot be excluded, any conditions or warranties implied or imposed by legislation or otherwise are excluded from these conditions of use. To the extent permitted by the law, the Gift Card Supplier’s liability is limited to replacing faulty Gift Cards. The Gift Card Supplier may cancel any Gift Card, for any reason at any time without notice. If so we may either provide a refund or a replacement Gift Card of equivalent value unless we reasonably suspect fraud in relation to a Gift Card. The Gift Card remains the Gift Card Supplier’s property.
d. Should the Gift Card be lost or stolen, or you suspect an unauthorised transaction, please contact the Gift Card Supplier by telephone on 1300 079 267, or online at www.giftcardplanet.com.au.
17. At the end of the Promotional Period, the Promoter will re-judge each of the Finalist entries for the purposes of determining the winner’s of the major prizes. The best three (3) valid entries, as determined by the judges from all Finalist entries, will each be deemed a major prize winner (“Major Prize Winner”). Each Major Prize Winner will win the major prize of a trip for two (2) people to the 2016 Olympic Games in Rio De Janeiro valued at up to AU$25,000 each depending on point of departure (“Major Prize”). Each Major Prize includes:
• Two (2) x return economy airfares from winner's nearest Australian capital city to Rio De Janeiro departing on the 07/08/2016 and returning on the 14/08/2016;
• Seven (7) nights twin share minimum 4 star accommodation. Hotel to be chosen in the Promotor’s sole discretion;
• Tickets for two (2) people to an Olympic event on each day from 09/08/2016 to 11/08/2016 (inclusive). The Olympic events will be determined by the Promoter in its absolute discretion; and
• Motor coach transfers to and from each Olympic event included.
18. Taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken to coincide with the 2016 Rio Olympics event with flights departing on 07/08/2016 and is subject to booking and flight availability.
19. If a Major Prize Winner is under the age of 18 years, the Major Prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf. During the entire duration of the Major Prize, a nominated parent/guardian must accompany any other person under 18 years of age. Each Major Prize Winner (and his/her companion) are responsible for any further costs associated with redeeming the Major Prize which are not otherwise specified in these Conditions, including but not limited to, additional transfers including to and from the departure point, spending money, additional food and beverage expenses other than those outlined, additional entertainment and/or miscellaneous expenses. A credit card imprint or cash deposit may be required from a Major Prize Winner (or his/her co mpanion) at the time of check-in to the accommodation, for all incidental charges. Once accommodation vouchers are issued they are non-changeable. Accommodation is non-transferable and cannot be exchanged for other destinations or cash. Selection of airline, departure and arrival destination, flight times and accommodation venue is at the Promoter’s discretion. The Major Prize must be taken between 07/08//2016 and 14/08/2016 to coincide with the Rio Summer 2016 Olympic Games and is subject to booking and flight availability, otherwise the Major Prize will be forfeited. The Major Prize winner and their guest must travel together. The Major Prize Winner must finalise their prize booking within twenty (20) days of the relevant judging date. The Major Prize Winner is responsible for providing all documents and information requested by the Promoter to complete the booking (including documents and information in respect of their guest). Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the Major Prize Winner. Each Major Prize Winner (and his/her companion) will not accrue any frequent flyer points from taking the Major Prize. Transfers will be organised at the Promoter’s discretion. All components of the Major Prize must be taken together and cannot be seperated. The relevant Major Prize Winner and his/her companion must depart and return from the same point of departure. Travel Insurance is not included. The Promoter recommends that the travel insurance be taken out, and accepts no responsibility for any person failing to do so. All additional costs incurred whereby a Major Prize Winner (or his/her companion) wishes to make variations to the travel are the Major Prize Winner’s responsibility and must be booked separately by the Major Prize Winner. All travel variations are subject to approval by the Promoter. Travel variations include, but are not limited to extension of travel duration, and additional travellers.
20. The Major Prize Winner (and his/her companion) are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Itinerary to be determined by the Promoter in its absolute discretion. Prize is subject to the standard terms and conditions of individual prize and service providers.
21. The 2016 Rio Olympic ticket prizes awarded as part of a Major Prize are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any Major Prize Winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
General
22. If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
23. All prizes (including Gift Cards and Major Prizes) are subject to the terms and conditions of the relevant suppliers. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner or their guests as a result of the conduct of any third party suppliers, or otherwise as a result of the winner or their guests accepting and/or using a prize or Gift Card, except for any loss, damage or injury which is due to the negligence or willful misconduct of the Promoter or which cannot be excluded by law.
24. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
25. If a winner of a prize is subsequently found not to be an Eligible Entrant, or their entry is deemed invalid under these Conditions, the prize will be forfeited.
26. The Promoter’s decision is final and no correspondence will be entered into.
27. Total prize pool value is up to AUD$119,000.
28. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. No responsibility will be accepted by the Promoter for late, lost or misdirected prize claims.
29. Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a prize winner (including photograph, film and/or recording of the same) in any media (including social media) for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
30. If required by the Promoter, winners agree to participate in any promotional activities associated with a prize such as public appearances, photo opportunities or media interviews as might be required by the Promoter.
31. It is a condition of accepting a prize that the winner (and their companion where relevant) must comply with all the conditions of use of the relevant prize and the relevant prize supplier’s requirements.
32. As a condition of accepting a prize, the winner (and his/her companion where relevant) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner or winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
33. If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition.
34. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (vi) any variation in prize value to that stated in these conditions; (vii) any tax liability incurred by a winner or Eligible Entrant; or (viii) use of a prize. Individuals should obtain independent tax and financial advice.
35. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITIN OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
36. If any prize or any element of a prize becomes unavailable, is abandoned, called off, varied or postponed for reasons beyond the Promoter's control, the Promoter may substitute a prize or that element of a prize of equal value at the Promoter’s sole discretion.
37. To the full extent permitted by law, the Promoter, its related companies (including but not limited to Coca-Cola Amatil (Aust) Pty Ltd ABN 68 076 594 119), agencies and prize suppliers and all those entities' personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or a prize, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia.
38. Eligible Entrants' personal information will be collected by or on behalf of the Promoter to enable it to administer the Competition and publicise its winner(s). The personal information of each winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers. Persons may contact the Promoter at privacyofficerau@coca-cola.com to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Eligible Entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win a prize. The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at www.coca-cola.com.au/privacy-policy. The Privacy Policy also contains information about how Eligible Entrants may opt out, access, update or correct their personal information, how Eligible Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Entrants’ personal information collected will be shared with overseas third parties who provide services to the Promoter in order to conduct the promotion. These overseas locations are noted in the Promoter’s Privacy Policy. By registering for the promotion, Eligible Entrants consent for this to occur. Do not register for the promotion if you do not consent for your personal information to be shared with overseas recipients.
