Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry
Entry is only open to Australian residents aged 18 years or over.
Employees (and their immediate families) of the Promoter, Participating Stores (as defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotional Period: The Promotion opens on 15/04/2020 and closes at 11:59pm AEST on 14/05/2020 ("Promotional Period").
How to Enter
To enter, individuals must complete the following steps during the Promotional Period:
(a) purchase any Sunbites or Grainwaves product from any participating Woolworths Supermarket or Woolworths Metro in Australia (including online at www.woolworths.com.au) (each a "Participating Store") during the Promotional Period ("Qualifying Purchase"). For the removal of doubt, Caltex/Woolworths fuel outlets are excluded for the purposes of this promotion. After completing a Qualifying Purchase, individuals will be provided with a purchase receipt. In the event a purchase receipt is not automatically provided to them it is the individual’s responsibility to request one;
(b) visit www.sunbites.com.au/sodastream ("Website"); and
(c) follow the prompts on the Website to the promotion entry page, input the requested details (including their full name, address, phone number and email address), upload a copy of the purchase receipt for the Qualifying Purchase and submit the fully completed entry form.
Multiple entries are permitted, subject to the following:
(a) a maximum of two (2) entries per person per day is permitted;
(b) only one (1) entry permitted per Qualifying Purchase (regardless of the number of Sunbites or Grainwaves products purchased in excess of one (1) in that transaction); and
(c) each entry must be submitted separately and in accordance with entry requirements.
Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Participating Store of purchase and that the purchase was made during the Promotional Period but prior to entry.
Prize Draws and Claims
Daily Draws: There will be one (1) draw conducted for the entries received each day of the Promotional Period, for a total of thirty (30) draws ("Daily Draws"). Entries into each Daily Draw will open at 12:00am and close at 11.59pm each day based on NSW local time. Each Daily Draw will take place at Tactics Marketing, Unit 6, 106 Old Pittwater Road, Pittwater NSW 2100 at 11:00am AEST on the first business day after entries close for that Daily Draw, with the first Daily Draw taking place on 16/04/2020 and the last Daily Draw taking place on 15/05/2020. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in NSW - draws for days falling on a weekend or public holiday will be conducted on the next business day. Non-winning entries in each Daily Draw will NOT be entered into any subsequent Daily Draw(s).
The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
Winners will be notified in writing within two (2) business days of the draw and their names will be published on the Website from 22/05/2020.
Prize Claim Deadline: Winners must claim their prize by 12:00pm (noon) AEST on 16/08/2020 by replying to the winner notification email with their full name, date of birth, Australian mailing address and contact number.
Prizes
Daily Prize: The first valid entry drawn in each Daily Draw will win the following prize valued at $230.95:
1 x SodaStream Spirit Sparkling Water Maker valued at $109;
1 x SodaStream Twin Pack of FUSE 1 Litre Carbonating Bottles valued at $21.95; and
1 x Sunbites hamper valued at $100 (which includes 10 x Rice & Chickpea chips (100g), 10 x Snack Crackers (110g), and 10 x Grainwaves (170g) – exact products/flavours awarded to be determined by the Promoter in its absolute discretion).
Total prize pool value is $6,928.50.
Prize Delivery: The Prize will be delivered by post to the winner’s Australian mailing address (provided to the Promoter in accordance with the Prize Claim requirements above). The Prize will be delivered within twenty-eight (28) days of being claimed. Winners will be notified of any delay in Prize delivery.
Unclaimed Prize Draw: A draw for any unclaimed prizes may take place on 17/08/2020 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published on the Website from 24/08/2020.
General
The Promoter’s decision is final and no correspondence will be entered into.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees").
The prize is subject to the terms and conditions of SodaStream Australia Pty Limited (ABN 81 104 202 093) ("Third Party Prize Supplier").The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this Promotion, the conduct of any Third Party Prize Supplier or accepting or using any Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law) including the Non-Excludable Guarantees.
The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
The information entrants provide will be used by the Promoter for the purpose of conducting this promotion. Entry is conditional on providing the requested details. By entering this promotion, entrants consent to the storage of their personal information on the databases of the Promoter and its related bodies corporate and the Promoter and its related bodies corporate may use this information for future promotional and marketing purposes regarding their products and services including (where the entrant has opted in) contacting entrants via electronic messaging. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants.
