Shiseido Noise Cancel Game Competition 2014 (“Competition”).
TERMS AND CONDITIONS
1. This Competition is being organised and managed by Shiseido Australia Pty Ltd ABN 46 001 787 695 of 6-10 Walker St, Rhodes, NSW, 2138, Australia (“Promoter”).
2. Participation in the Competition constitutes the entrant’s acceptance of these conditions. Entries must comply with these terms and conditions to be valid.
3. Entry is open to all Australian residents aged 18 years or over. Employees of the Promoter and their immediate family members are ineligible to enter.
HOW TO ENTER
4. The Competition commences on 24 March 2014 at 9am Australian Eastern Standard Time (AEST) and entries close on 23 June 2014 at 11.59pm (AEST) (“Competition Period”).
5. To enter into the Competition, entrants (“you”) must, during the Competition Period:
(a) log onto your Facebook account, and then visit the Shiseido Australia Facebook page;
(b) click on the Noise Cancel Game page and enter;
(c) play the Noise Cancel Game, and reach a level of 11 or above for an entry into the competition.
6. Winners will be chosen randomly by the Promoter. You can enter as many times as you like, provided you reach level 11 or above each time.
PRIZES
7. The competition consists of 2 parts, which is:
(a) (a) a major prize will be drawn monthly on 28th April 2014, 26th May, and 26th June for which there will be one (1) winner each month;
(b) a minor prize will be drawn monthly on 28th April 2014, 26th May, and 26th June for which there will be ten (10) winners each month.
8. All winners are drawn at the Promoter’s office, Shiseido Australia Pty Ltd, 6-10 Walker Street, Rhodes, NSW 2038 at 11am (AEST) on 28th April, 26th May, and 26th June 2014 for each competition period. The winners will be announced on the Shiseido Facebook page at 4pm on 28th April, 26th May, and 26th June 2014 for each competition period.
9. For the major prize, each winner will receive a Shiseido Makeup pack consisting of Sheer Eye Zone Corrector, Face Enhancing Trio, and Lacquer Gloss. Each major prize pack is valued at $138. For the minor prize, each winner will receive a Shiseido Makeup pack consisting of Sheer Eye Zone Corrector, and Lacquer Gloss. Each minor prize pack is valued at $80. The total prize pool is valued at $2,814.
10. The prizes do not cover any additional expenses incurred by the Promoter. The prizes will be sent out to the winners within 14 days of the relevant draw.
MISCELLANEOUS CONDITIONS
11. Entering the Competition is free. No purchase of products or services is necessary.
12. The names of the winners will be posted on the Shiseido Australia Facebook page. Winners will also be notified by email. Should your details change during the Competition Period, it is your responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
13. The decision of the Promoter is final and no correspondence will be entered into with the Promoter.
14. The Promoter:
(a) reserves the right to cancel or amend the competition, the prizes, or these rules at any time without prior notice, subject to approval from the relevant state authorities;
(b) reserves the right to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process;
(c) will not be liable for any losses incurred as a result of any cancellation or changes to the competition.
15. Subject, where relevant, to any directions given under the legislation regulating the competition, if the prize is: (i) not claimed by the winning entrant by 29th September 2014 or (ii) forfeited for any reason, the prize will be deemed unclaimed. The Promoter may conduct a further draw on 3rd October 2014 (or such earlier date approved by the relevant regulatory authorities) at 12.00pm (AEST) at the Promoter’s Head Office as is necessary for an unclaimed prize. The winning entrant of any unclaimed prize will be notified by phone and email within 2 business days after the date of the unclaimed prize draw, and a public advertisement will be placed on 7th October 2014 on the Promoters Facebook page announcing the unclaimed prize winner’s name and suburb (or town).
16. To the extent permitted by law, the Promoter makes no warranties or representations about the fitness for purpose or suitability of any prize and is not responsible for the quality or fitness for any purpose of any prize, or the failure of any prize to be of merchantable quality. If liability under terms of legislation cannot be excluded, the liability of the Promoter is limited to re-supplying the relevant goods or services or paying the cost of replacing them.
17. The Promoter is not responsible for e-mail, internet, computer hardware and software, phone and/or any other technical errors, malfunctions, and delays that may prevent you from entering the Competition, or that interfere with your compliance with the rules of this Competition. You are solely responsible for submitting a valid entry.
18. You agree that the Promoter is not liable for losses or injuries of any kind resulting from acceptance of prize(s), participation in the Competition, any delay or inability to submit an entry or any act or omission by you or any third parties.
19. You acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.
20. You agree to indemnify and release and keep indemnified and released the Promoter and Facebook against any loss or damage suffered or any claim incurred by the Promoter or Facebook arising out of inaccuracies or illegal content contained in your entry submitted or an act or omission by you or a breach of these terms by you.
21. To the extent permitted by law, the Promoter is not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death that is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or your accepting or using any prize.
22. If, due to any reason whatsoever, the Promoter becomes aware after a winner of a prize is announced that the winner has not complied with these terms, that winner will have no entitlement to the prize, even if the Promoter has announced them as a winner and that entrant will be required, at the direction of the Promoter, to return, refund or otherwise make restitution of the prize.
23. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought by you. Where the operation of this competition results for GST purposes, in supplies being made for non-monetary consideration, Entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. All taxes and any other costs related to this prize not specifically stated within these terms are the sole responsibility of the winner.
24. The information that you provide will be used by the Promoter for the purpose of conducting this Competition. By entering this Competition, you consent to the storage of their personal information on the databases of the Promoter and you agree that the Promoter may use this information for future promotional and marketing purposes regarding their products and services including contacting you via electronic messaging. You agree that Promoter may disclose your personal information to its contractors and agents to assist in conducting this competition or communicating with you. The Promoter and its partners are bound by Privacy laws.
25. The Promoter is not liable for any delay or failure in performing its obligations under these terms caused by unforeseeable circumstances beyond its reasonable control.
26. These terms are to be construed in accordance with the laws from time to time in the States and Territories of Australia issuing competition permits for this competition. The parties submit to the non exclusive jurisdiction in New South Wales or other state or territory as applicable.
