Unclaimed Prize Determination: 10:00 hours AEST on Friday 2 November 2012 at the offices of the Promoter. The unclaimed prize winner (s) will be notified by telephone and in writing via email within 2 days of the Unclaimed Prize Determination.
Prize: 4 x winners will each win a $1,000 hotels.com voucher, valued at a maximum of $1,000 each. Total Prize Value: $4,000.00
Prize Conditions Prize Terms and Conditions a) This discount code (or "Coupon") may be used to book a prepaid 'Price Match Guarantee' hotel on the Hotels.com Australia website. For full hotel exclusion list, please click here (http://www.hotels.com/deals/apac_hotels_exclusion-au/).
b) The Coupon entitles you to $1,000 off your total reservation cost (exclusive of any taxes, fees or GST) and is deducted after any other discounts have been applied.
c) Valid for hotel bookings between 00:01am AEST on 01/10/2012 and 11:59pm AEDT on 31/03/2013 for stay dates between 01/10/2012 and 31/03/2013.
d) Only one Coupon per booking may be used. Usual booking terms and conditions apply and all bookings are subject to availability.
e) Coupons may be transferred, but are not valid if sold.
f) All taxes, fees, charges, and surcharges are applicable to reservations made using Coupons. These charges must be paid at the time of the reservation and are the responsibility of the customer.
g) Coupons have no cash or refund value except when redeemed in accordance with all terms and conditions of this offer. Coupons cannot be returned for cash or its equivalent. Coupons cannot be applied to the cost of prepaid reservations or other miscellaneous charges.
h) Single-use Coupons will be deemed fully used once a qualifying reservation has been made and will not be returned or replaced and there will be no refund if a Coupon is redeemed in part. Multiple-use Coupons will be deemed fully used in accordance with the restrictions set out in the individual Coupon terms and conditions.
i) If the travel stay dates are changed after the use of a Coupon, then that Coupon will not apply to the changed travel schedule.
j) Hotel bookings made using a Coupon are not eligible for Welcome Rewards credits.
k) Coupons may not be used for any previously purchased reservation.
l) Hotels.com reserves the right to vary these conditions of use or to withdraw Coupons at any time. In relation to the accommodation component of the Prize:
m) the Winner may be required to provide a valid credit card imprint or cash deposit at check-in for the purpose of covering incidental or other charges at the hotel; and
n) unless expressly stated otherwise in the description of the Prize in these Terms and Conditions, the Prize does not include the cost of telephone calls, internet access, breakfast, in-room dining, in-room movies, mini bar, gratuities or any other costs or expenses incurred by the Winner, his/her travel companion and/or any of their guests at the hotel.
WINNERS The Winners will be notified in accordance with the Notification. Each Winner must claim the Prize within the Claim Period. The Promoter will not be responsible for any delay, loss or damage to the Prize once it has left the Promoter's or supplier's premises. If the Winner is under 18 years of age, the Prize will be awarded to the parent or legal guardian of the Winner. If a Winner is unable to comply with these Terms and Conditions and/or does not claim the Prize within the Claim Period, the Promoter reserves the right to award the Prize to the Entrant with the next best Entry, as determined by the judges at the Unclaimed Prize Determination.
PRIZE The prize consists of the 4 Prizes, valued at the Total Prize Value. The Winner's use of the Prize is subject to:
(a) the Prize Conditions; and
(b) additional terms and conditions imposed by the supplier(s) of the Prize (if any), with which the Winner must comply.
The Prize is not transferable and not redeemable for cash or other goods or services. The Prize must be taken as a whole and as stated in these Terms and Conditions. No alternative will be provided and no compensation will be payable if the Winner is unable to use the Prize as such. The value of the Prizes are the recommended retail price as provided by the supplier (inclusive of GST) and is correct as at the start of the Competition. If the Prize becomes unavailable for any reason, the Promoter, in its sole discretion, reserves the right to substitute the Prize with a prize of equal or greater value and/or specification.
YOUR INFORMATION If an Entrant's contact details changes between the date of entry and the Unclaimed Prize Determination, the Entrant must notify the Promoter of his/her updated contact details.The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants' personal information will be collected by or on behalf of the Promoter to enable it to conduct the Competition, publicise the name of the Winners and where Entrants have consented to the receipt of such information, send Entrants marketing, advertising and promotional material.
Entrants' personal information may be disclosed to third parties who assist the Promoter in conducting this Competition, including regulatory authorities, entities which supply and deliver the Prizes to the Winners, and marketing and communications agencies. The Winners' names will be published and retained as required by relevant legislation and as specified in these Terms and Conditions. Each Winner consents to the Promoter's use of the Winner's name, likeness, image, picture, voice, statements, testimonials or quotations for promotional, marketing and publicity purposes in any media worldwide, without any fee being paid to the Winner.
RISK AND LIABILITY The Winner participates in this Competition, and uses the Prize, at his or her own risk.The Promoter, its related bodies corporate and the suppliers, agencies and other companies involved in this Competition assume no responsibility for any error, omission, interruption, defect, delay in operation or transmission, or loss or damage to data.If this Competition is not capable of running as planned for any reason (including as a result of technical failures, fraud or causes beyond the Promoter's control), the Promoter may, in its sole discretion, cancel, suspend or change the Competition and re-commence it on similar terms, subject to any directions by regulatory authorities. To the fullest extent permitted by law, the Promoter, its related bodies corporate and their respective officers, directors, employees and agents exclude liability for all loss (including loss of data, unauthorised access to data and consequential loss), damage, expenses, death or personal injury suffered or incurred arising out of, or in connection with, this Competition (including in relation to the Winner's participation in this Competition and use of the Prize).
These Terms and Conditions are governed by the laws of the State of New South Wales.
