Terms and Conditions
1. The promoter is Cover-More Insurance Services Pty Ltd ABN 95 003 114 145 (“Promoter”). Contact number is 1300 772 183.
2. You (“Participant”) must be an Australian resident, 18 years of age or older to be eligible for the Competition.
3. The following person(s) are ineligible to enter the Competition:
3.1 employees of:
3.1.1 the Promoter; and
3.1.2 the Promoter’s related bodies corporate (as that expression is defined in the Corporations Act 2001 (Cth), and associated agencies, companies, and contractors; and
3.2 Members of the immediate families of the employees where “immediate family” means any of a spouse or domestic partner, ex- spouse or ex-domestic partner, de-facto spouse or ex-de-facto spouse, child, or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.
4. The Competition commences on 7 December 2021 12:01am AEST and closes 7 January 2022 11:59am AEST (“Competition Period”). The Promoter may extend the Completion Period at its sole discretion by written notice on the competition pages (competitionsandgiveaways.com.au/freely-10k-competition) and also via update of the Promoters’ Facebook and Instagram pages.
5. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged, based upon individual creative merit. All entries must be an independent creation by the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions.
6. There are four prizes, a person may only win one prize with each prize being a Flight Centre Travel voucher valued at $2,500. The Prize is not redeemable for cash. The Prize is personal to the winner. It cannot be transferred, exchanged, or otherwise dealt with. The Promoter assumes no responsibility for lost, misplaced, destroyed or stolen Prizes once they are claimed. The prize will be sent to each winner in the form of two vouchers each to the value of $1250.00 and can be sent via email or as a physical card. In the event that a physical card is selected by the winner, the winner indemnifies the Promoter against any claims and acknowledges that the Promoter accepts no responsibility in the event that the card is lost as a result of delays or misadventure in the delivery of the voucher to the Winner’s chosen address for delivery. Each declared winner will also receive complimentary travel insurance through Freely for themselves and up to three (3) additional travelling companions for a maximum cover period of up to 30 continuous calendar days. To qualify for the complimentary travel insurance the declared winners need to be a minimum age of 18 years and a maximum age of 60 years, be an AU resident or hold a Permanent Visa with Medicare. Further, each travelling companion needs to be aged 99 years and under, be an AU resident or hold a Permanent Visa with Medicare”
7. To enter, the Participant must: (a) “Tell us where your next holiday destination is, why & when”; (b) like the Promoter’s Facebook page, (c) follow the Promoter’s Instagram page and (d) confirm their Instagram username on the competition entry pages; competitionsandgiveaways.com.au/freely-10k-competition
8. For the Participant to be eligible to compete in the competition, the Participant must enter the competition:
a. within the Competition Period:
b. in the strict manner specified on the entry form for the Competition;
c. by the method specified on the entry form for the Competition; and
d. only once during the Competition Period.
9. The entries will be judged by the Promoter. The four entries that best answer “Tell us where your next holiday destination is, why & when”, as judged in the absolute discretion of The Promoter to be the best worded, most creative, most compelling or most unique response.
10. Winners will be notified by the Promoter on 10 January 2022 via Email, Instagram and Facebook (direct message and via page notification on The Promoter’s social media pages, notably @freelytravelapp).
11. The Promoter reserves the right to disqualify any entrant submitting an entry which, in the opinion of the promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language
12. The Promoter’s decision is final and no further correspondence will be entered into.
13. By entering the Competition, the Participant is deemed to have accepted these terms and conditions.
14. The Promoter reserves the right to request winners to provide proof of age and identity and eligibility to participate in the Competition. In the event that a winner cannot provide suitable proof of identity, the winner will forfeit the Prize in whole and no substitute will be offered.
15. Nothing in these terms and conditions is intended to exclude, restrict or modify rights which the Participant may have under any law (including the Australian Consumer Law) which may not be excluded, restricted or modified by agreement (‘Your Consumer Rights’). Subject to Your Consumer Rights, The Promoter is not liable for any loss or damage however caused (including by negligence), suffered, or incurred in connection with the Competition or any Prize. Any condition or warranty which would be implied by law into these terms and conditions is excluded.
16. As a condition of accepting a Prize, the winner may be required to sign legal documentation as and, in the form, required by The Promoter including but not limited to a further agreement to exclude liability of The Promoter for certain loss, damage or injury arising from the use or participation in a Prize to the extent the Prize is or includes a recreational service or activity.
17. The Participant agrees that the Promoter may create content using images of the winner(s) for sharing purposes on our social media pages and/or website and for general advertising purposes. The Participant acknowledges that all entries become and remain the property of the Promoter and agencies associated with this promotion. The promoter may use the entrant's names and/or their submission for any commercial purpose, including future promotional marketing and publicity purposes.
18. By entering the Competition all entrants consent to the use by the Promoter of their username/email for publicity and commercial purposes in connection with the Competition and/or the Promoter’s products and services, in any media and for an infinite period, without further compensation. This includes but is not limited to use on Facebook, Twitter, Instagram, YouTube, Email and social media channels, and the Promoter’s news page and website.
19. The Promoter may conduct such further judging of entries if, despite using all reasonable efforts, the original winner cannot be contacted within 10 days of the competition concluding.
20. The Promoter may cancel the competition and not award the Prize(s) where circumstances beyond the Promoter’s reasonable control prevent the Promoter from providing the Prize(s). Should The Promoter cancel the Competition, The Promoter will:
e. advertise that the Competition has been cancelled by placing a notice on the Competition’s website; competitionsandgiveaways.com.au/freely-10k-competition
f. promptly destroy all entries received; and
g. not use the personal information that any Participant has provided on the entry form.
21. All Prizes are accepted entirely at the risk of the winner, and the Promoter excludes all warranties in connection with any Prize to the extent permitted by law. The Promoter reserves the right to substitute any Prize with a prize of equal or greater value (including where the Prize is unavailable) for whatever reason, subject to approval of the gaming authorities in each State and Territory where required. The Prize and/or any element of the Prize must be taken as stated and cannot be varied by the winner. No compensation will be payable if the winner is unable to use their Prize and/or any element of the Prize as stated.
22. The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury, loss or damage suffered or sustained (even caused by negligence) in connection with accepting or using a Prize or participating in this Promotion, except for any liability which cannot be excluded by law. The Promoter is not responsible for defective Prizes, lost or stolen Prizes or misuse of any Prize. All entrants release from, and indemnify the Promoter against, all liability, cost, loss or expense arising out of acceptance of any Prize(s) or participation in this Promotion including (but not limited to) personal injury and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.
23. The Competition is in no way sponsored, endorsed, administered by or associated with Facebook. The Participant irrevocably releases Facebook from any liability arising out of or in connection with this Competition.
