Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms andConditions.
The promoter is Alphapharm Pty Ltd t/as Mylan Australia (ABN 93 002 359 739) of Level 1, 30 The Bond, 30-34 Hickson Road, Millers Point NSW 2000. Telephone: 02 9298 3999 (“Promoter”).
Entry is only open to Australian residents aged 18 years or over.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex- spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step- parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step- brother, step-sister or first cousin.
Promotion commences at 12.00am AEDT on 15/10/2017 and ends at 11:59pm AEDT on 16/12/2017 (“Promotional Period”).
To enter this promotion, entrants must, during the Promotional Period:
visit www.quitpromo.com.au/;
follow the prompts to the promotion entry page;
correctly complete all requested details in the online entry form (including full name, age, email address, postcode, ticket preference (Hoyts Cinemas or Village Cinemas), and information regarding smoking habits);
agree to these Terms and Conditions of entry and the Promoter’s Privacy Policy by selecting the “I agree to the Terms and Conditions and Privacy Policy” check box; and
click “Submit” to submit the fully completed entry form and enter the promotion.
Each entrant may submit a maximum of one (1) entry per week during the Promotional Period. Each week during the Promotional Period commences on a Sunday and ends on a Saturday, from 15/10/2017 onwards.
The Promoter reserves the right, at any time, to verify the validity of entries and information provided by entrants (including an entrant’s name, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper conduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter and its associated agencies or companies accept no responsibility for any late, lost, altered, damaged, or misdirected entries. Incomplete, indecipherable entries will be deemed invalid. Entries must be received by the Promoter during the Promotional Period. An entry will be deemed to be received by the Promoter at the time of receipt of the entry into the Promoter’s database.
Each entrant acknowledges that participation in this promotion is not linked, implicitly or explicitly, to an agreement to use the Promoter’s products, or is in any way connected to prior purchases of the Promoter’s products.
Any cost associated with accessing www.quitxpromo.com.au is the entrant’s responsibility and is dependent on the Internet service provider used.
Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will be deemed invalid.
There will be one (1) draw conducted for the entries received each week during the Promotional Period (i.e. Sunday to Saturday), with a total of nine (9) draws conducted during the Promotional Period (each a “Draw”).
Entries into each Draw will open at 12.00am AEDT and close at 11.59pm AEDT on the dates set out in the table below:

Each Draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway at 12.00pm AEDT on the dates specified in clause 14 above.
The Promoter may draw additional reserve entries and record them in case an invalid entry or an ineligible entry is drawn.
Entries in each Draw will not be entered into any subsequent Draw(s).
The first five hundred (500) valid entries drawn electronically at random in each Draw will each win one (1) restricted adult movie ticket, redeemable for a single session at either a Hoyts Cinema or a Village Cinema (as selected by the relevant entrant at the time of entry), valued at $22.00 (“Prize”).
Winners will be notified in writing by email within two (2) business days of the relevant Draw and each winner’s name will be published online at www.quitxpromo.com.au on the relevant date set out in clause 14 above.
Prizes will be emailed to winners at the time of notification in accordance with clause 19.
The total Prize pool value is up to a maximum of $99,000.00.
The value of each Prize is accurate at the date of publication of these Terms and Conditions. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.
The Prizes (including any unused portion of a Prize) cannot be exchanged, transferred, or redeemed for cash.
If a Prize is unavailable, the Promoter, at its sole discretion, reserves the right to substitute that Prize with a prize of equal or greater value, subject to approval of the gaming authorities in each State and Territory where relevant.
Subject to clause 24, if for any reason a winner does not take a Prize by 5.00pm AEDT on 18/03/2018, then the Prize will be forfeited.
A draw for any unclaimed Prizes may be conducted on 19/03/2018 at the same time and place as the original Draws, subject to any directions from gaming authorities in each State and Territory where relevant. The winners of any unclaimed Prize draw will be notified in writing within two (2) business days of the draw and the name of each winner of an unclaimed Prize will be published online at www.quitxpromo.com.au by 21/03/2018.
Any decision made by the Promoter in connection with this promotion is final, and no correspondence will be entered into, including in the event of a dispute.
Any ancillary costs associated with redeeming the Prize are not included. Redemption of the Prize is subject to any terms and conditions of the relevant issuer. Hoyts Cinema movie tickets cannot be redeemed on public holidays or on Saturdays after 2pm. Village Cinema tickets cannot be redeemed on Saturdays after 5pm.
As a condition of entering this promotion, each entrant licences and grants the Promoter, its affiliates, and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish, and display all or any part of their entry for any purpose, including (but not limited to) future promotional, marketing, or publicity purposes, in any media, without compensation, restriction on use, attribution, or liability.
Each entrant consents to the Promoter using their name, likeness, image and/or voice in the event they are drawn as a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law), in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with participating in this promotion is the sole responsibility of the Entrant.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non- Excludable Guarantees”).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking or use of a Prize.
The Promoter collects personal information in order to conduct the promotion in accordance with these Terms and Conditions. Entry is conditional on providing this personal information to the Promoter. The Promoter will handle the personal information it collects about entrants in accordance with its privacy policy available on at www.mylan.com.au/en-au/privacy-policy or by calling 1800 314 527 (toll free). The Promoter may use and disclose an entrant’s personal information for the purposes stated in these Terms and Conditions, or as otherwise described in the Promoter’s privacy policy or permitted, required or authorised by law. The Promoter may use an entrant’s personal information and disclose it to the Promoter’s affiliates, agents, contractors, or other third party service providers described in its privacy policy for direct marketing purposes. Some of these entities may be located overseas.
The Promoter’s privacy policy explains how to opt out of direct marketing at any time, how to request access to and correction of personal information, how to make a privacy complaint and how the Promoter deals with such complaints and the countries to which the Promoter may disclose personal information.
An entrant’s personal information may be disclosed to recipients in countries that are not subject to the same or at least equivalent privacy protections which apply to the handling of the entrant’s personal information in Australia under the Privacy Act 1988 (Cth). Each entrant agrees and consents to such overseas disclosures on the express understanding that the Promoter may not take steps to ensure the overseas recipient handles the entrant’s personal information in accordance with the Privacy Act 1988 (Cth).
The Prize suppliers (Village Roadshow Ltd and The HOYTS Corporation Pty Ltd), and their related entities, are not in any way associated with, or affiliated with, this promotion. Any queries regarding this promotion should be directed to the Promoter.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
