Eligibility
Entry is open to Australian residents who are 18 years or older and are not employees of, or children of employees of, the Promoter (including its related bodies corporate) or a company associated with the Promotion (Eligible Entrants).

Entry is open to Australian residents who are 18 years or older and are not employees of, or children of employees of, the Promoter (including its related bodies corporate) or a company associated with the Promotion (Eligible Entrants).
Eligible Entrants are limited to one entry per person as verified by a valid email address.
Entries open at 12.00 pm on 14 June 2020 and close at 12.00 am on 12 July 2020 Australian Central Standard Time (Entry Period).
An entry will only be eligible for the Promotion where it complies with these terms and conditions in every respect (Eligible Entry). For the avoidance of doubt, an entry received after the Entry Period or an incomplete entry received during the Entry Period will be accepted but would not be considered as an Eligible Entry for the purposes of being eligible to win the prize.
No responsibility is taken by the Promoter for late, lost, incomplete, illegible or misdirected entries.
Method
To enter, Eligible Entrants must within the Entry Period:
submit all fields in Promotion entry via the form at https://brillianttravels.com.au/brilliant-holiday-escape-competition/ and
complete an entry form with a valid email address.
All entrants (whether or not they are an Eligible Entrant) consent to their email address being added to the Promoter’s email database in accordance with the Promoter’s privacy policy.
Draw
Four (4) winners will be drawn at random by the Promoter and all Prize draws will be conducted at 3.00 pm ACST on 20 July 2020 at the Promoter’s head office at Level 3, 26 Flinders Street, Adelaide, South Australia 5000.
Prizes will be drawn and awarded to Eligible Entrants in accordance with clause 4.2.
The winners will be notified of their win by email, post or telephone on or before Friday 24 July 2020 using the contact details submitted with their entry.
Prizes
The total number of Prizes is 4 with a total prize pool value of $11,862 (including GST).
The Prizes are as described below will be drawn in the following order:
Prize 1: Fraser Island – SeaLink Fraser Island passenger ferry fare for 4 adults plus one 4WD vehicle (return), plus 4 nights in a Lagoon View Wallum room, valid for 12 months from date of issue at Kingfisher Bay Resort. Valued at $2,252.
Prize 2: Kangaroo Island. SeaLink Kangaroo Island Passenger ferry fare for 4 adults plus one vehicle (return), plus 2 prizes x 4 nights in a Studio Superior Apartment including breakfast, valid from 03 September 2020 through to 30 August 2021 at Mercure Kangaroo Island. Valued at $2,824.
Prize 3: Magnetic Island – SeaLink Magnetic Island Passenger ferry fare for 4 adults (return) plus 2 prizes x 4 nights in a Deluxe Studio Waterview room, valid for 12 months from date of issue at Peppers Magnetic Island. Valued at $2,736.
Prize 4: Murray River – 3 Night Murray River Discovery Cruise for 2 people plus 2 x 1 nights in Deluxe Room, including breakfast for 2 each day, valid for 12 months from date of issue at the Pullman Adelaide. Valued at $4,050.
The Promoter reserves the right to substitute a Prize with a comparable prize of similar value if necessary. A Prize is not transferable by the Prize winner and is not redeemable for cash or otherwise substitutable.
The Promoter makes no warranty or representation in connection with any of the Prizes as to the value, quality, suitability for any purpose, dimensions or other property or attribute of the Prize.
Prize Winner Announcement, Prize Collection and Unclaimed Prizes
The Prize winners will be notified of their win by email or telephone on or before Friday 24 July 2020 using the contact details submitted with their entry.
The names of all Prize winners will be published in The Australian newspaper on 25 July 2020.
The Promoter may also publish the Prize winners’ details in any SeaLink Travel Group newsletter, on any SeaLink Travel Group website, by email or other social media (including Facebook).
Each Prize will be awarded or delivered to the respective Prize winner, or made available for collection by that winner, in the manner notified to the winner by the Promoter.
In the event that the Promoter can’t contact a winning Entrant within 90 days of determining that winner, the following will apply:
Winners of Unclaimed Prizes will be notified via email no later than 24 July 2020.
A random unclaimed prize draw for any unclaimed prizes will occur on 29 October 2020 at the Promoter’s head office as set out above and the winner/s will be notified by telephone, email or in writing.
Personal Information and Communications
The personal information of an Entrant will be handled in accordance with the Promoter’s Privacy policy located at www.sealinktravelgroup.com.au/privacy-policy/.
Entrants agree to receive separate and direct marketing communications in the future from the Promoter and its related bodies corporate to the Entrant’s email address. All such communications will contain an opt-out option.
Termination of an Entrant’s Participation
The Promoter may terminate the participation of an Entrant in the Promotion, refuse to award a Prize to an Entrant or recover a Prize awarded to an Entrant without notice for any reason including, without limitation, if that Entrant:
submits an entry otherwise than in accordance with these terms and conditions or tampers with the process for making an entry;
commits any breach of these terms and conditions;
abuses any privilege afforded to the Entrant under the Promotion;
supplies any misleading information or makes any misrepresentations to the Promoter or its agents in connection with the Promotion;
is otherwise dishonest or fraudulent in its dealings in connection with the Promotion;
behaves in a manner which diminishes the name or reputation of the Promoter, is unlawful or otherwise inappropriate.
An Entrant may terminate their participation in a Promotion at any time by emailing notice to the Promoter at: marketing@brillianttravels.com.au.
The Promoter will not be liable for any loss or other consequence arising out of termination of an Entrant's participation in a Promotion whatsoever.
Suspension and termination of Promotion
The Promoter may suspend or terminate a Promotion at any time at its discretion without prior notice.
The Promoter will not be liable for any loss or other consequence arising out of suspension or termination of a Promotion whatsoever.
In the event of war, terrorism, state of emergency, disaster or pandemic, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a Prize, subject to any written directions from a relevant regulatory authority.
The Promoter’s Website
While the Promoter takes all reasonable care in the construction, operation and content of the Promoter’s website, it makes no guarantee or warranty that:
the use of the Promoter’s website will be uninterrupted or virus and error free;
any information contained on the Promoter’s website is complete, accurate or up to date.
Entrants must take their own precautions to ensure that the process which they employ for accessing the Promoter’s website in making an entry in a Promotion does not expose them to the risk of viruses, malicious computer code or other forms of interference which may damage their computer system. The Promoter is not responsible for any interference or damage to computer systems which may arise in connection with accessing the Promoter’s website or any other website linked to the Promoter’s website.
Access to the Promoter’s website may be terminated at any time without notice.
Disclaimer
The Promoter makes no express or implied warranty or representation in connection with any Promotion other than those set out in these terms and conditions.
Tax Liability
Any tax, liability or duty arising from a Prize received by an Entrant is the responsibility of the Entrant.
Limitation on Liability
To the fullest extent permitted by law:
any liability that the Promoter may have to an Entrant whether for negligence, breach of contract or otherwise in respect of a Promotion is, to the fullest extent permitted by law, limited to conducting the Promotion and awarding the Prize in accordance with these terms and conditions; and
the Promoter will have no liability whatsoever for any loss of profits or any other incidental, consequential or indirect loss or other consequence in connection with the Promotion.
No waiver
No granting of time indulgence or failure to enforce a provision of these terms and conditions shall constitute a waiver by the Promoter of the same.
Release and indemnity
Each Entrant releases and indemnifies the Promoter from and against any liability arising from:
any breach of these terms and conditions by the Entrant;
any use or misuse of a Prize by the Entrant;
any other conduct by the Entrant which entitles the Promoter to terminate the participation in the Promotion of the Entrant.
Severability
If any part or all of any provision of these terms and conditions becomes or is found to illegal or unenforceable that provision may be severed from these terms and conditions and the remaining provisions of these terms and conditions shall continue in force.
Governing Law
These terms and conditions will be construed according to and governed by the law of South Australia, Australia. The parties submit to the exclusive jurisdiction of the courts in and of South Australia in relation to any dispute arising under these terms and conditions.
Terms and Conditions subject to Change
The Promoter reserves the right to vary these terms and conditions at any time and without notice. Please check these terms and conditions at regular intervals for any changes.
