TERMS& CONDITIONS
DEFINITIONS
1. The following definitions apply to these Terms and Conditions:
a) “Closing Date” means 11.59hrs on 31st October 2015
b) “Commencement Date” means 00.01hrs on 1st September 2015
c) “Determination Date” means 11:00hrs on 14th November
d) “Entrant” means a person who enters thePromotion.
f) “Prize” means a prize offered in the Promotion.
g) “Promoter” means Discount Drug Stores Pty Ltd ABN 54067616826, of 1/36 Sherwood Rd, Toowong, QLD 4066. 
h) “Promotion” means this competition.
i) “Promotion Period” means the period between the CommencementDate and the Closing Date.
l) “Website” means the Discount Drug Store website, www.discountdrugstores.com.au.
m) “Winner/s” means the Entrant who wins the Prize.
n) “Unclaimed Prize Determination” has the meaning set out in clause 21.
o) “Unclaimed Prize DeterminationDate” means 30th December.
2. All times and dates are times and dates in Brisbane, which is AESTtime. All times are stated using the 24-hour clock. 00:00hrs is the start of aday and 24:00hrs is the end of a day.
PARTICIPATION
3. The Promotion is conducted by the Promoter.
4. The Promotion is a game of skill, and chanceplays no part in determining the Winners.
5. Entry to the Promotion constitutes acceptanceof these Terms and Conditions. By entering the Promotion, Entrants accept andacknowledge full responsibility for their decision to participate in thePromotion and to take the Prize if they are the Winner.
6. All entry instructions and prize informationpublished by the Promoter form part of these Terms and Conditions.
7. An Entrant is eligible to win the Prize ifthey:
a) Are apermanent resident of Australia; and
b) Are over theage of 15 and, if under the age of 18, have their parent’s or guardian’spermission before entering the Promotion;
And are not:
c)  Employeesof:
1) The Promoter, Discount Drug Stores; 
2) Any of theRelevant Parties; or
3) A spouse, defacto spouse, parent, child or sibling (whether natural or by marriage oradoption) of a    person who is anemployee of any of the entities listed in paragraph (c) above.
8. Entry to the Promotion commences on theCommencement Date and closes on the Closing Date.
ENTRY
9. To enter the Promotion, an Entrant must,during the Promotion Period:
a) Purchase any Elmore Oil or Lifespace branded product atany Discount Drug Store from 1st September – 31st October2015
b) Fill out all of the required data entry fields on the websiteentry form; and
    c) Answer the following question, in 50 words or less: “If you were stuck on a deserted island andcould take just 3 things, what would they be and why?” (The “Entry Question”).
10. An Entrant’s entry must not be:
a)late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) libellous;
i) threatening;
j) pornographic;
k) harassing;
l) hateful;
m) racially or ethnically offensive;
n) capable of encouraging conduct that would be considered acriminal offence;
o) capable of violating any law; and/or
p) capable of giving rise to civilliability.
11. Entry to the Promotion is limited to 1 entry per every Lifespaceor Elmore Oil product purchased and in one transaction.
12. Entrants must ensure that their entries are received by thePromoter during the Promotion Period. All entries are deemed to be received atthe time of receipt by the Promoter, not the time of transmission by theEntrant. The Promoter takes no responsibility for late or lost entries. 
13. Should an Entrant’s contact details change at any time betweenthe date on which they enter the Promotion and the Unclaimed PrizeDetermination Date, that Entrant must notify the Promoter of their correctcontact details immediately.
14. The Promoter may decide in its sole discretion which documentsare considered suitable for establishing eligibility to enter or win. In theevent that a Winner cannot provide suitable proof of eligibility, the Winnerwill forfeit their Prize in whole and no substitute or compensation will beoffered.
15. Any entry that is made on behalf of an Entrant by a thirdparty, or otherwise by proxy, will be invalid.
16. The Promoter may, at its absolute discretion, declare any orall entries made by an Entrant to be invalid if the Entrant:
a)Fails to establish their entitlement to win the Promotion to the Promoter’ssatisfaction; or
b) Appears, to the Promoter, to have tampered with, or benefitedfrom tampering with, the entry process; or
c) Has submitted an entry that isnot in accordance with these Terms and Conditions.
WINNERS
17. There will be forty winnersdetermined from all entries received during the Promotion Period. The Winnerswill receive the prize.
18. The Winners will be determined on the Determination Date bythe Promoter at 1/36 Sherwood Rd, Toowong, QLD 4066. The Winners will be theEntrants who, in the sole opinion of the judges, have the most informative,creative and original answer.  
19. The Promoter’s decisions are final and no correspondence willbe entered into.
20. The Winners will be notified by phone and/or email within 2business days of the Determination Date.
21. All reasonable attempts willbe made to contact the Winners. Subject, where relevant, to any directionsgiven under the legislation regulating the Promotion, if a Prize is:
a)not claimed by the Winner by 11:00hrs onthe Unclaimed Prize Determination Date; or
b) forfeited for any reason, thePrize will be awarded to another Entrant in an unclaimed prize determination(the “Unclaimed Prize Determination”), which will take place at 11:00hrs on the Unclaimed Prize DeterminationDate and will be conducted by the Promoter at 1/36Sherwood Rd, Toowong, QLD , 4066. The Winner of the Unclaimed PrizeDetermination will be notified by telephone and/or email within 2 business daysof the Unclaimed Prize Determination Date.
PRIZES
22. Each prize is valued at a maximum of $499 and consists of the following:
a)     An Apple Watch base model 38mm Space GreyAluminium Case with Black Sport Band
THE TOTAL PRIZE POOL FOR THIS PROMOTION IS VALUED AT A MAXIMUM OF$19,960
23. All Prize maximum values are correct as of Monday31st August 2015 and are reflective of the recommended retail priceand are in Australian dollars. The Promoter takes no responsibility for anyvariations in the Prize values.
24. If the Prize is unavailable for any reason, the Promoter will,in its absolute discretion, substitute alternative goods or services of nolesser retail value and/or specification.  The Promoter accepts no liability orresponsibility for any loss incurred by the Winner or any other party if thePrize (or any part of the Prize) is damaged for any reason.
26. The Prize cannot be refunded or exchanged.
27. Once the Prize has left the Promoter’s/Supplier’s premises,the Promoter and the Relevant Parties will not be responsible for any delay indelivery or loss or damage to the Prize.
28. If the Determination Date or Unclaimed Prize DeterminationDate is a public holiday, the determination will be conducted on the followingbusiness day.
29. The Prize will be awarded to the persons named in the winningentry.
GENERAL
30. The Promoter reserves the right to take anyaction necessary in its sole discretion at any time, subject to any directiongiven under State permit regulations.
31. These rules are Terms and Conditions andconstitute the entire terms and conditions between the Entrant and the Promoterwith respect to the Promotion and cannot be altered, modified, or amended.
32. All entries become the property of thePromoter.
33. All entries will be given automatic access tothe Discount Drug Store loyalty program
PRIVACY
34. Your privacy is important to us. The Promoteris bound by the National Privacy Principles in the Privacy Act 1988.Entrants’ personal information will be collected by o
r on behalf of the Promoter to enable it toadminister the Promotion, publicise its Winners, and send Entrants marketinginformation where Entrants have consented. Entrants’ personal information maybe disclosed to marketing and communications agencies, Prize suppliers andPrize deliverers in order to conduct this Promotion. Personal information aboutEntrants may also be disclosed to the authorities responsible for theregulation of gaming and lotteries. Winners’ names will be published andretained as required by relevant legislation and as specified in these Termsand Conditions.
