Win 1 of 440 Mario Pin Sets

The Super Mario Bros. 35th Anniversary – Mario Quiz Promotion ("Promotion”) is sponsored by Nintendo Australia, 804 Stud Road, Scoresby, Victoria 3179, Australia (“Sponsor”).
Instructions on how to participate form part of these Official Rules.
Eligibility: Promotion is open only to individuals who are legal residents of Australia or New Zealand. To be eligible for the Promotion, you must have legal access to:
(a) a Nintendo Account with the country/region setting of your country of residence, either Australia or New Zealand; and
(b) access to a computer, mobile device or other means with internet connectivity to complete the quiz.
Directors, officers, and employees of Sponsor and any of its respective affiliate companies, subsidiaries, agents, professional advisors, and advertising and promotional agencies, and their immediate family members and persons with whom each are domiciled are not eligible to win any prizes.
Promotion Period: 10th March 2021 from 02:00 PM to 31st March 2021 11:59 PM AEDT
How to Enter: To enter, you must:
(1) Have a Nintendo Account (if you do not have a Nintendo Account, you can register for free at https://accounts.nintendo.com);
(2) Visit http://nintendo.com.au/supermario35/quiz/;
(3) Sign into your Nintendo Account (if not already signed in); and
(4) Complete either the easy or hard version of the Mario Quiz.
Each participant logged into their Nintendo Account will receive fifty (50) My Nintendo Platinum Points as a participation reward.
Each completion of either the easy or hard quiz entitles the participant to one entry into the Promotion; multiple completions will not increase the participant’s chances of winning a prize.
Selection of Winners: At 2:00pm AEST on 15th April 2021, Sponsor will select four hundred and forty (440) potential winners at random from all eligible entries received by Sponsor. The prize draw will be held at Sponsor’s offices at 804 Stud Road, Scoresby, Victoria, Australia. The potential winners will be notified by email associated with their Nintendo Account. To claim a prize, the potential winners must follow the instructions contained in these notifications and respond within five (5) business days. If a potential prize winner does not claim the prize within such period of time, such winner’s prize may be forfeited and awarded to an alternate randomly selected winner, at Sponsor’s discretion. After verification of the entrant’s eligibility, such entrant will be awarded a prize, as set forth below.

(a) Four hundred and forty (440) winners randomly selected by Sponsor will each receive one (1) of two available Super Mario Bros. 35th Anniversary pin sets, assigned at random, valued at approximately $11.20 per set. There will be 220 of Set 1 and 220 of Set 2.

(d) Odds of winning a prize depend the number of eligible entries received. The value of the prize is subject to variation and the winners will not be entitled to compensation for reduction in prize value. All prizes must be taken as offered and are not exchangeable, transferable or redeemable for cash. No substitutions or exchanges of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize per person.
Identity of Entrant: In the event of a dispute about the identity of the entrant, Sponsor may declare an entry to have been made by the authorised Nintendo Account holder of the username submitted at time of entry. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorised account holder of the username associated with the winning entry.
Privacy: The Sponsor is collecting participants’ information for the purposes of conducting and promoting the Promotion. If you do not provide this information, the Sponsor may not be able to enter you into Promotion and/or provide you with a reward or a prize. The Sponsor may disclose this information to organisations engaged by the Sponsor to conduct the Promotion; government, law enforcement and regulatory bodies where this is necessary for the Sponsor to comply with its legal obligations; and other companies within the Nintendo Group including Nintendo Co., Ltd. in Japan, Nintendo of Europe GmbH and its branches in Italy, Germany, Austria, Switzerland and the United Kingdom; and Nintendo of America Inc. located in the United States. Winners’ names may be published. The Sponsor is bound by the provisions of the Privacy Act 1988 (Australia), the Privacy Act 2020 (New Zealand), and its own privacy policies. You can gain access to the information which the Sponsor holds about you by contacting the Privacy Officer, Nintendo Australia Pty Limited, 804 Stud Road, Scoresby, Victoria 3179, Australia.
License Grant: Sponsor and its agents may broadcast, stream, film, transmit, publicly display, record and/or take photographs during the Promotion, and may use the resulting footage, recordings or photographs for a range of purposes, including, without limitation, for marketing and promoting Sponsor and its products and services. By participating in the Promotion, you (and if participant is a Minor, the participant’s legal guardian) hereby consent to your being filmed, recorded, and photographed and having your gameplay recorded, broadcast or streamed during the Promotion, and grant Sponsor and those acting under its authority (and agrees to confirm that grant in writing) the royalty-free, perpetual, irrevocable right and license to publish, reproduce, perform, distribute, stream, adapt, edit, modify, translate, create derivative works based upon, and otherwise use and display any or all of the content and details of such participation, including, but not limited to your name, city and state/province of residence, likeness, Nintendo Account, Nintendo Network ID, Mii character, and prize information, and any of the film, photographs or recordings taken pursuant to this Section without further compensation, notice, review or approval, and without territorial, time, media or medium or other limitations, for Sponsor’s marketing and promotional purposes or any and all other purposes, except where prohibited by law.
Additional Terms and Conditions: The Promotion and these Official Rules will be governed, construed and interpreted under the laws of the State of Victoria, Australia. This Promotion is subject to all applicable federal and state laws and is void where prohibited. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect. Neither the Sponsor nor its officers, agents, employees or associated companies will be liable for any injury, loss or damage (including any indirect or consequential loss) arising from the participation of a person in the Promotion unless such liability may not be lawfully excluded in which case their liability will be limited to the maximum extent permitted by law.
If this Promotion is interfered with in any way or is not able to be conducted as anticipated due to any reason beyond the reasonable control of the Sponsor, the Sponsor reserves the right to modify, suspend, extend, terminate or cancel the Promotion to the full extent permitted by law subject to any approval or directions from a regulatory authority.
Neither the Sponsor nor its officers, agents, employees or associated companies is responsible if participation is not possible due to technical errors or other reasons outside the reasonable control of the Sponsor.
People who tamper with or abuse any aspect of the Promotion, as solely determined by Sponsor, will be disqualified, and Sponsor reserves the right to terminate such player’s eligibility to participate in this or any other promotion offered by Sponsor. Entries or gameplay generated by robotic, programmed, script, macro or other automated means or by any means which subvert the entry or game play process, as solely determined by Sponsor, will be disqualified. Released Parties are not responsible for any injury, loss or damage of any kind resulting from an entrant’s participation in this Promotion.
Any delay or failure of Sponsor to perform its obligations under these Official Rules, including, without limitation, with respect to fulfillment of the prize or any part thereof, shall be excused to the extent that such delay or failure is caused by an event or occurrence beyond Sponsor’s reasonable control, including, without limitation, acts of God, actions by governmental authorities, fires, floods, storms, earthquakes, inclement weather, pandemic, natural disasters, riots, wars, terrorism, or labour disputes.
Except where prohibited by law and subject to the applicable Nintendo privacy policy, entry into the Promotion constitutes permission to use entrant’s name, city and state/territory of residence, likeness, Nintendo Account, Nintendo Network ID, Mii character, and prize information, for any purpose without further permission or compensation, including, without limitation, for Sponsor's promotional purposes. Without limiting the foregoing, entrant understands and agrees that Sponsor may use (and may allow third parties to use) your Entry, including photos on websites, social media pages, advertisements, and other promotional materials. Entrant’s grant of the foregoing permission is perpetual and may not be revoked by entrant. As a condition of being awarded a prize, winners may be required to confirm such permission in writing and execute and deliver a written affidavit of eligibility, acceptance of these Official Rules, and winners will be required to execute and deliver a release of liability, a photo/video consent and publicity release, and other documentation. By entering, entrants certify that they have complied with these Official Rules and are eligible to win. By entering, entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects.
