TERMS AND CONDITIONS OF ENTRY
1) Information about prizes and how to enter the Competition forms part of
these terms and conditions of entry. Participation in this Competition is
deemed acceptance of these terms and conditions of entry.
2) This Competition is being run at Chadstone Shopping Centre, 1341
Dandenong Road, Chadstone, VIC 3148 (the 'Centre') during the
Promotional Period.
3) The Competition commences at 9am AEST on Wednesday, 8 November
2017 and concludes at 6pm AEST on Sunday, 24 December 2017
(‘Promotional Period’).
4) The promoter of this Competition is Vicinity Centres PM Pty Ltd (ACN
101 504 045 / ABN 96 101 504 045) as disclosed agent for the owners of
the Centre, National Office, Level 4, Chadstone Tower One, 1341
Dandenong Road, Chadstone Victoria 3148, telephone: 03 9936 1222
('Promoter').
5) Directors, officers, management and employees (and their immediate
families) of the Promoter, any related body corporates and contractors of
the Promoter, retailers at the Centre and any other agencies or
companies associated with this Competition are ineligible to enter.
6) The Competition is open to entrants of any age.
7) The Competition is a game of chance.
8) Number of entries: entrants can enter the Competition multiple times
within the Promotional Period.
9) To enter, entrants must, during the Promotional Period:
(a) take the ‘Your Christmas Gift Guide, Tailor Made’ quiz
during the Promotional Period at www.chadstone.com.au
/your-christmas-gift-guide
(b) enter all relevant details in provided fields, including first
name, last name, email, gender & date of birth; and
(c) accept terms and conditions to competition
10) There will be five winners determined in respect of the Competition. The
winners will be selected via a draw on Wednesday, 3 January 2018 at
12pm AEST, at Chadstone Centre Management Office. The first five
valid entries randomly selected from all entries received during the
Promotional Period will win a prize. The Promoter may draw additional
reserve entries and record them in order, in case the winning
entry/entrant is deemed invalid, or the prize is unclaimed ('Reserve
Entrants').
11) There are in total five prizes available to be won. Each prize is a
$1,000.00 Chadstone Gift Card, with a total prize pool of $5,000.00.
12) Winners will be notified via email within 2 days of the draw and their
name will be published on the Chadstone website at
https://www.chadstone.com.au/your-christmas-gift-guide-winners for 28
days.
13) Winners must claim their prize by 5pm AEST, 10 January 2018. If the
prize has not been accepted or claimed by this date and time or if, after
making all reasonable attempts, the Promoter can't contact the drawn
winners (or the drawn winners do not contact the Promoter) by this date
and time, the relevant entry will be discarded and the Promoter will reaward
the prize to a Reserve Entrant and/or immediately carry out an
unclaimed prize draw at the same location as the original draw. Any new
winner will be notified via email immediately after the draw.
14) The winners can collect their prize from the Chadstone Centre
Management Office from 12pm on Friday, 5 January 2018 or such other
date as agreed with the Promoter.
15) Unless otherwise specified, prizes or any unused portion of a prize, are
not exchangeable or transferable and cannot be redeemed for cash. .
The winners must pay any costs incurred beyond the value of the gift
card and are responsible for any applicable ancillary costs that are
incurred as a result of accepting a prize.
16) The Promoter reserves the right to verify the validity of entries, prize
claims and entrants (including an entrant’s identity, age and place of
residence) and to disqualify any entrant who submits an entry or prize
claim that is not in accordance with these terms and conditions or who
tampers with the entry process. An entry that is incomplete,
indecipherable, illegible or non-compliant with these terms and
conditions is invalid and will not be accepted or considered. Entries are
deemed to be received only when received by the Promoter or
Promoter's database, as applicable. The Promoter is not liable for any
problems with communications networks. Failure by the Promoter to
enforce any of its rights at any stage does not constitute a waiver of
those rights.
17) If this Competition is interfered with in any way or is not capable of being
conducted as reasonably anticipated due to any reason beyond the
reasonable control of the Promoter, the Promoter reserves the right, in its
sole discretion, to modify, suspend, terminate or cancel the Competition
to the full extent permitted by law and subject to any approval or
directions from a regulatory authority.
18) The Promoter is not liable for entries, prize claims, prizes or
correspondence that are misplaced, misdirected, delayed, lost, stolen,
incomplete, illegible or incorrectly submitted
19) The Promoter's decision in connection with all aspects of this
Competition is final and no other correspondence will be entered into.
20) It is a condition of entry that the entrant consents to the Promoter using
the entrant’s entry details, name, likeness, image and/or voice (including
photograph, film and/or recording of the same) in any media for an
unlimited period without remuneration for the purpose of the Competition
(including any outcome), and promoting any products and services,
distributed and/or supplied by the Promoters in the Centre(s) or
otherwise.
21) By entering the Competition, an entrant releases the Promoter (including
its officers, employees and agents), its related bodies corporate, the
owners of the Centre and the agencies and companies associated with
this Competition from and against all actions, liabilities, penalties, claims
or demands the entrant may have for any loss or damage (including
indirect, special or consequential loss or loss of profits) which is or may
be suffered or sustained in connection with the Competition or any prize,
except for any liability which cannot be excluded by law or which would
cause any part of this clause to be void or unenforceable (in which case
that liability is limited to the greatest extent allowed by law).
22) The Promoter is not responsible for any tax implications arising from the
prize winnings. Entrants should seek independent financial advice. If for
GST purposes this competition results in any supply being made for nonmonetary
consideration, entrants must follow the Australian Taxation
Office’s stated view that where the parties are at arm’s length, goods and
services exchanged are of equal GST inclusive market values.
23) Nothing in these terms and conditions restricts, excludes or modifies any
consumer rights under any statute including the Competition and
Consumer Act 2010 (Cth).
Collection and use of your personal information
The information you provide will be used by the Promoter for the purpose of
conducting this promotion. The Promoter may collect your personal information
(including through its contractors or agents) or disclose your personal
information to its related companies, contractors and agents to assist in
conducting this promotion, storing data or communicating with you. The
Promoter is bound by the Privacy Principles in the Privacy Act 1988 (Cth). The
