The promoter is Fienza Pty Ltd (Australia), (ABN 76 136 411 311), 2 Bailey Ct, Brendale QLD 4500 (“Promoter”).
Entry Requirements
1. The promotion commences at 10:01am AEST on 15th March 2022 and concludes at 2:00pm AEST on 14th April 2022 (the “Promotion Period”).
2. To enter participants must, during the Promotion Period:
(i) Be an Australian resident aged eighteen (18) years or over with a valid Australian postcode.
(ii) Not be currently employed by the Promoter or be an immediate family member of an employee of the Promoter.
(“Eligible Entry”)
3. A person has unlimited entries. Incomplete, inaccurate, erroneous, or ineligible entries will be deemed invalid. The promotion is free to enter.
4. Entrants must “like” one of the competition images on Instagram, follow the Fienza account and tag a friend. Multiple entries can be made via the tagging of multiple accounts in separate comments. Additional entries are available through the Gleam.io weblink.
Prizes and Fulfilment
5. There are 5 prizes to be won in this Promotion. Each prize is one of five AU$1,500 Fienza Vouchers, with a total prize pool of AU$7,500. The vouchers are redeemable for products and services with a total recommended retail price of AU$1,500 per voucher. The voucher will be redeemed directly through The Promoter. The Promoter will provide the winner with a product catalogue to make their selection, and then organise for the winner to receive their prize. This may be through collection from a local supplier, or a delivery to the winner’s postal address.
6. Five winners will be randomly selected using an automatic online generator by Social Cut on behalf of Fienza. The winners will be chosen by 12:00pm AEST on 14 April 2022 at 34 Wyatt St, Newstead, Queensland 4006.
7. The Promoter has authorised Social Cut to draw the competition. Social Cut will choose the winners. Social Cut reserves the right to reject any entry which contains content that, in their discretion, they consider to be offensive or inappropriate. The decision to accept or reject an entry is at Social Cut’s discretion and no correspondence will be entered into.
8. The winners will be notified via an Instagram Direct Message on 14 April 2022 by @fienza.au that they have won. The Winners will have 14-days to claim the prize. The winners will be announced via Instagram Stories and via Instagram post on 14 April 2022. The Winners will be required to provide their name, telephone number, email address and postal address in order to accept and receive a prize. The method of prize distribution will be negotiated with the winner by the Promoter.
9. If a winner does not accept or claim the prize by 28 April 2022, or cannot be contacted by the end of the 14-day period or is found by the Promoter to not be eligible to win the Prize, the winner will forfeit the prize and the prize will be randomly drawn again, via a randomized lottery generator (random.org) at Social Cut Studio, 34 Wyatt St, Newstead Queensland 4006 at 10:00 AM AEST 28 April 2022, subject to any directions from a regulatory authority. The redraw winner will be published via Instagram stories on 28 April 2022. The decision of the Promoter is final. The Promoter reserves the right to request confirmation of the eligibility of the winner to enter the competition and to win the Prize.
10. The winner agrees that they may be required to participate in reasonable publicity and also agrees for their name and Instagram handle to be used to announce the winner.
General.
11. Prize and prize elements may not be separated or redeemed for cash and no alternative prize are available. The prize is non-transferable, non-refundable and is not available for resale.
12. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrant (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
13. Information collected in relation to the Promotion from Eligible Entrants is subject to the privacy policies of the Promoter, which can be found at www.fienza.com.au/privacy and will be handled in accordance with all applicable laws in Australia. The privacy policies as outlined below contain details on how Eligible Entrants can access, update and correct their personal information and the Promoter’s complaint management processes. Entry is conditional on the provision of the required personal details.

13.2. The data collected is used for marketing research and analytics of website usage. This data is processed through and by Google Analytics.
13.3. To better interact and communicate with our customers and end-users, contact information given in our design tools or contact forms may be used for direct marketing.
13.4. Information collected is retained for 24 months.
13.5. It is possible at any point of time to withdraw your consent for us to use data and contact information about and from you. This can be done by contacting our DPO or Customer Service.
14. I consent to the Promoter (from time to time) using my personal information and photographing/recording my image while I am participating in any activity or event run or organised by the Promoter which constitutes part of the Prize. I agree that any such photographs, electronic images, sound recording or video footage may be used by the Promoter in resources and reports, or promotional, advertising or marketing materials, without any further notice or payment to myself.
15. The Promoter reserves the right to cancel or amend this competition due to events or circumstances arising beyond its control, subject to any written directions from a relevant regulatory authority. The decision of the Promoter is final and binding and no correspondence will be entered into.
16. The Promoter and its members, financial institutions, associated agencies and companies and their respective directors, officers, employees and agents, shall not be liable for any loss or damage, including any personal injury suffered or sustained in connection with the Promotion or any Eligible Entrant's receipt or use of any part of the Prizes except for any loss or damage which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
17. To the extent permitted by law, the Promoter and its members, financial institutions, associated agencies and companies and their respective directors, officers, employees and agents shall not be responsible in any way whatsoever in respect of the following: (1) technical failures of any kind including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, communications, line failure or the malfunctioning failure or unavailability of any computer, server, cable, line, network, hardware, software, internet service or web site; (2) unauthorised human intervention in any part of the entry process of the Promotion, including but not limited to theft, destruction or unauthorised access to, or alteration of the Promotion; (3) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (4) any entry that is late, stolen, damaged or misdirected or otherwise not received.
18. If the Prize is unavailable for any reason, the Promoter reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Entrants understand and agree:
(a) to comply with Instagram’s terms and conditions in relation to promotions, including Instagram’s terms of use;
(b) that this promotion is in no way sponsored, endorsed or administered by, or associated with Instagram
(c) that any questions comments or complaints about this promotion must be directed to hello@socialcut.com.au and not to Instagram.
20. The Promoter reserves the right to cancel, suspend, terminate or modify the Promotion if fraud, technical failures or any other factor beyond the Promoter's reasonable control adversely affects the Promoter's ability to conduct the Promotion as contemplated in these Conditions of Entry, subject to state or territory regulation.
21. If all or any part of any term or condition contained in these Terms & Conditions shall be declared or become unenforceable, invalid or illegal for any reason, such term or provision (or part thereof) shall be deemed severed from these Conditions of Entry to the extent of the unenforceability, invalidity or illegality and the other terms and conditions hereof shall remain in full force and effect as if the offending term or provision (or part thereof) appearing had not been inserted herein, subject to state or territory regulation.
22. These Terms & Conditions shall be governed by the laws of Australia and each Eligible Entrant agrees to submit to the non-exclusive jurisdiction of the courts of Australia.
