2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to residents of Australia, 18 years of age or older, where the Channel Seven signal is received. 2.2 Employees and their immediate families and friends of Seven Network (Operations) Limited, Qantas Airways Limited, TripADeal Pty Ltd and their associated agencies and companies and any prize suppliers are not eligible to enter. 3. Multiple entries will not beaccepted. 3.4 The entry must be: (a) the original independent creation of the entrant; and (b) free from any claims, including but not restricted to copyright or trademark claims, by other parties. The winneragrees to grantthe Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and the winners will not be entitled to any fee for suchuse. 3.6 Any entry that contains contentthatthe Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject anentry is at the Promoter’s sole discretion and no correspondence will be entered into. 4. Page 3 of 6 4.3 Winner and their travelling companion must be eighteen (18) years or older. 4.4 The winner and their travelling companion are responsible for all other expenses including but not limited to hotel and airport transfers, meals(unless specified in prize package), incidentals, tips, telephone calls, service charges, spending money, out of pockets expenses, visas, activities, tickets or passes, room service, telephone calls, mini-bar items, laundry services, travel insurance, excess payable on insurance claims, extended travel dates, passports and visas (if applicable). Travel insurance is not included in the prize package (comprehensive travel insurance is highly recommended). 4.5 TripADeal Coupon/Voucher must be declared at time of booking. 4.6 TripADeal Coupon/Voucher can only be redeemed via phone on 1300 976 056. It can't be us ed with thi rd parties or wholesalers. 4.7 TripADeal Coupon/Voucher is not valid for use on associated travel services, concierge flight ti ckets, tra vel visas, travel insurance, vouchers, or any optional extras/supplements/surcharges associated with a current or previous travel deal. 4.8 All bookings are subject to availability and you will be bound by the TripADeal Terms a nd Conditions a nd Important Information of your travel deal. 4.9 TripADeal Coupon/Voucher must be used within the stated validity period or else it will be deemed void. 4.10 TripADeal prize is nonrefundable, non-redeemable for cash, and cannot be us ed i n c onjunction wi th a ny other coupon/offer/promotion or Gift Certificate. 4.11 Accommmodation is based on two (2) people sharing a room. 4.12 All components of the prize must be taken together to coincide with the commencement of the nomi nated prize travel date and the winner and their travelling companion must travel together and depa rt from a nd return to the same departure point. 4.13 The winner and their travelling companion must make their own way to their nearest capital city airport. The prize does not include the cost the winner and their travelling companion may incur to travel to the a i rport including any ancillary costs (eg. excess luggage fees). 4.14 Before booking and travel, the Prize Winner must ensure they check the latest Australian government tra vel requirements, which may include mandatory healthdeclarations, vaccinations, us e of fa ce ma sks, entry permits, pre-approval and quarantine (possibly at your own expense), or you could be denied entry. Australian government entry restrictions apply. All travellers are responsible for ensuring they are eligible to enter Australia prior to booking. See smartraveller.gov.au for more details. 4.15 The Promoter and Sponsors are not responsible for the cancellation, delay or rescheduling of a ny part of a travel or accommodation component of Prize and any costs incurred by Winner or any travelling companion(s) as a result (including accommodation costs) will be the responsibility of the Winner. 4.16 No compensation or alternative travel plans will be arranged should the Sponsor and/ or thei r c ompanion miss their outbound or return flights or fail to meet any check in requirements for any rea son. These c osts will be the responsibility and expense of the prize winner and companion. The Promoter and Sponsor i s not responsible for anycosts associated with flights that are cancelled or delayed for any reason, i nc luding but not limited to accommodation and transfer costs. The Promoter and Sponsoris not responsible if cancellation or delay of flights or missing flights causes theprize winner and companion to miss the ticketed elements that makes up part of this prize. 4.17 Flights are economy class and may be indirect. The airline’s Conditions of Carriage apply to a ll fl ights. The winner and their travelling companion must travel at the same time and are responsible for tra nsport from their residence to their nearest capital city airport in Australia. These conditions apply for all flights. 4.18 Airline, flight route and dates of travel are subject to the promoter’s absolute and final decision. 4.19 In the event the packageshould no longer be available, TripADealreserves the right to select a new pa ckage equal (or greater) value. 4.20 The Promoter or Sponsor accepts no responsibility for any tax implications that may arise from acceptance or redemption of the prize, or this Competition. Independent financial adviceshould be sought by the wi nners Page 4 of 6 prior to accepting the Prize. The Promoter and Sponsor accept no responsibility for a ny variati on in prize value. 4.21 The prize is not transferable and cannot be extended past the date. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the promoter then tha t element of the prize will be forfeited by the winner and cash will notbe awarded in lieu of tha t el ement of the prizeand cannot be used in conjunction with any other coupon/offer/promotion or Gi ft C ertificate. Winner must secure their prize by booking no later than 30 June 2022 and be available for travel on dates of stipulated by prize. 4.22 In participating in the prize,the winner agreesto participate and co-operate a s required in a ll edi torial activitiesrelating to the Competition, including but not limited to being interviewed and photographed. The winner grantsthe promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winnerwill not be entitled to any fee for such use. HOW TO WIN 5.1 There will be one(1) prize winner each day. Five (5) prize winners will be judged fromthe national pool of daily entrants received. Each entrant who has entered the Competition over the Competition Period and registered all detailsin accordance with clause 3 (“Qualifying Entrant”) will be entered into the Competition. 5.2 The winner will be the entry judged by a panel of representatives appointed by the Promoter to be the most creative and/or original from the national pool received.All entries will be judged atthe Sunrise offices at 52 Martin Place, Sydney NSW 2000 as stipulated in the table below. The competition is a game of skill and chance plays no part in determining the winner. If any Prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further judging, as required, at the same time and place as the original judging, three(3) months and one (1) week after the date of the original judging. The winner, if any, will be notified in writing and by phone within two (2) business days ofthe re-judging. 5.4 The judges’ decision is final and the Promoter will not enter into correspondence regarding the result. 5.5 Incomprehensible and illegible entries will be deemed invalid. 5.6 It is a condition of accepting the prize that the winner must complywith all the conditions of use of the prize and Sponsorsrequirements. 5.7 It is a condition of accepting the prize that the winner may be required to signa legal release in a form determined by the Promoter or the Sponsor, as the case may be, in their absolutediscretion. NO LIABILITY 6.1 In thecase ofthe intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, thePromoter may in its absolute discretion cancel, modify or suspend the competition. If, due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated prize, the Promoter reserves the right to award a substitute prize. 6.2 The Seven Network (Operations) Limited,Qantas Airways Limited, TripADeal Pty Ltd and their associated agencies and companies will not takeany responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail. 6.3 The Seven Network (Operations) Limited, Qantas Airways Limited, TripADeal Pty Ltd and their associated agencies and companies will not beliable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: a) during the judging; b) whilst undertaking any travel won on or connected with their entry into the competition; or c) in the participation in any prize; d) as a consequence of late, lost or misdirected mail; e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; f) in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; g) arising from or related to any problem or technical malfunction of anycomputer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion 6.4 The Promoter reserves the right to reasonably amend or vary theseterms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements. 6.5 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of theseconditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s and the Sponsor’s legal rights to recover damages or other compensation from such an offender are reserved. 6.6 Seven Network (Operations) Limited and the Sponsor assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available. 6.7 If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures orany other causes beyond the control of the Promoter or the Sponsor which corrupt or affect the administrationsecurity, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualifyany individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition. 6.8 By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses.Neither the Promoter nor the Sponsor are responsible for any Page 6 of 6 acts of god,such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling.
