5. Payment
5.1. Payment is required at the time of purchase and placement of your order. Payment is charged/debited at the end of the complete check-out process. You will not be charged prior to the final step, and can choose not to proceed at any time before payment is taken.

6.2. If HOKA Australia determines an order is potentially fraudulent, we will not dispatch goods until we are satisfied that cardholder identification has been achieved and our Fraud Protection Process has been completed.

7. Refunds

7.2 In the event HOKA Australia requests your bank account details to issue a refund, please ensure you provide the correct BSB and Account Number. Your refund may be delayed if the incorrect details cause the refund to bounce. We are not liable for any refunds processed into the wrong account due to incorrect information provided.

16. Viruses
16.1. HOKA Australia does not represent that any information (including any file) obtained from or through the website is free from computer viruses or other faults or defects. It is your responsibility to scan any such information for computer viruses.
16.2. HOKA Australia will not be liable to you or to any other person for any loss or damage (whether direct, indirect, consequential or economic), however caused and whether by negligence or otherwise, which may result directly or indirectly from any such information. To the extent that any liability may be imposed on HOKA Australia it shall be limited to the cost of re-supplying that information.
17. Afterpay
17.1. Afterpay does not charge a fee to consumers when purchasing and we do not charge interest. The only fees applied to consumers are late fees if your scheduled payments are unsuccessfully processed and, after being notified, you do not log in to your Afterpay account to make your payment via a different method.
17.2. If a payment has not been made by you on the Afterpay website before the scheduled payment date, we will automatically take payment from your default payment method on that date. The scheduled payment dates can be seen in the confirmation email sent to you after your order was approved, or by logging in to your Afterpay account at afterpay.
17.3. If an automatic payment fails, you have until midnight (AEDT in the summer months and AEST in the winter months) to make payment. After midnight, if that payment has not been made, you will incur a late payment fee of $10 and a further late fee of $7 if the payment is not made within 7 days (as stated in the Afterpay Terms).
17.4. We understand that there are certain extenuating circumstances which will not allow you to make payments on or before the scheduled date. If you believe you fall into this category and would like to discuss your payment schedule with us, please e-mail Afterpay here.
17.5. All new Afterpay customers are required to make their first payment at the time of purchase. You will no longer be considered a ‘new’ customer once you have fully paid off your first order AND 6 weeks have passed since you placed that order. For any order thereafter, your first payment will only be deducted 2 weeks after your purchase and your last payment deducted 8 weeks after purchase.
17.6. Afterpay is a PCI DSS Level 1 certified compliant Service Provider organisation. 17.7. HOKA accept returns of online orders, providing the refund to you back via your Afterpay account. Please note that any outstanding payment instalments due will be processed until your refund has been completed. For information on how to return your online order see our returns information page.
17.8. Afterpay does not allow for exchanges. We do however encourage you to send back your online purchase and place a new order with us.
18. Guess the Brick Competition
18.1. Promoter: The Promoter is Accent Group Limited, ABN 85 108 096 251, Tel: (03) 9427 9422 of 2/64 Balmain St, Richmond VIC 3121 (Promoter).
18.2. Eligibility: Entry is only open to Australian residents who are aged 18 years or over (Entrant). Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
18.3. Promotion Period: The Promotion commences at 12:01 am AEST on Thursday 15th July, 2022 and closes at 11:59pm AEST on Sunday 14th August, 2022 (Promotion Period).

Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt. Incomplete or indecipherable Entries will be deemed invalid. This competition is limited to one entry per person. If a person enters more than once, only their first entry will be counted in the promotion.
18.5. Judging: This Promotion is a game of skill. Judging of entries will be conducted at Accent Group Limited, 719 Elizabeth Street, Waterloo, NSW 2017 Australia on Wednesday 17th August, 2022. There will be 5 winning entries chosen for this Promotion. If there are not 5 entries that have correctly chosen the exact number of bricks contained within the HOKA Bondi 8 shoe as part of this promotion, the remaining winners will be chosen based on the closest entries to the correct number of bricks. If there are multiple people that have the same entry, winners will be chosen based on the earliest submission.
18.6. Prize: Each of the 5 winners will win the following prizes:

18.7. Prize notification: The winners will be contacted by 12:00 pm AEST on Wednesday 17th August, 2022 by email as well as the first names of the winners published on Facebook and Instagram that same day. It is the responsibility of the winners to check their email account and/or the Promoter’s Facebook Page or Instagram Page to determine if they are the winner, and to send an email containing their contact details to hayley.blease@accentgr.com.au within 7 days of the post which announces the winner. For privacy reasons, the Promoter will not contact the winner through Facebook or Instagram private messaging to notify them of their winning entry.
18.8. Unclaimed prizes: If for any reason any of the winners do not claim their prize within 7 days by Wednesday 24th August, 2022 at 12pm AEST then the prize or that part of the prize will be forfeited and will not be awarded to the winner.
18.9. Promoter's rights: The Promoter’s decisions is final, and no correspondence will be entered into, including in the event of a dispute. The Promoter reserves the right, at any time, to verify the validity of Entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. 9. Risk and Title
9.1. HOKA Australia will retain title to the products you order until you have made payment in full for those products, but all risk in the products will pass to you upon their delivery to or collection by a postal or courier service.

12. Limitation of Liability
12.1. HOKA Australia will in no way be liable for any direct, indirect, incidental, special or consequential damages, resulting from use or inability to use the website or for the cost of procurement of substitute products or resulting from any products purchased or obtained or messages received or transactions entered into through the website or resulting from unauthorized access to or alteration of your transmissions or data or of any information contained on this website, including but not limited to, damages for loss of profits, use, data or other intangible, even if HOKA Australia has been advised of the possibility of such damages.
12.2. Where any Act of Parliament implies in the Terms and Conditions any term, condition or warranty, and that Act avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of, or liability under such term, condition or warranty, such term, condition or warranty shall be deemed to be included in the Terms and Conditions, however, the liability of HOKA Australia for any breach of such term, condition or warranty shall be limited, at the option of HOKA Australia to any one or more of the following:
If the breach relates to goods:
the replacement of the goods or supply of equivalent goods;
the repair of such goods;
the payment of the cost of replacing the goods or of acquiring equivalent goods; or
the payment of the cost of having the goods repaired;
If the breach relates to services:
the supplying of the services again; or
The payment of the cost of having the services supplied again.

15.1. At times the Website may contain links to other websites, which are not operated by us (“Linked Sites”). We may also provide embedded content hosted and controlled by third party providers (“Embedded Content”). HOKA Australia has no control over Linked Sites and Embedded Content, and as such accepts no responsibility for them or any loss or damage to you that may arise from using them. Your use of Linked Sites or Embedded Content is entirely your choice and responsibility, and is subject to the T&Cs of Linked Sites and Embedded Content.
15.2. HOKA Australia does not endorse, promote or recommend any the operators, or any person, organisation or corporation, associated with Linked Sites and Embedded Content unless explicitly stated.
15.3. At times you may be able to provide, contribute, upload and publish (collectively, “Publish”) your own data, content or materials (“User Content”) to, or through, our Website and associated websites (eg. our Blog, Facebook page, etc). User Content could include text, images, information, or comments, Published via email, comment, blog, enquiry, social media platforms, third-party partnerships and plug-ins, or other means.
15.4. You own any User Content that you Publish on HOKA Australia Website (“Your Content”). Other users own any User Content they publish to HOKA Australia Website. HOKA Australia reserves the right to moderate, deny or remove any User Content, at any time, without explanation. We are not obliged to use, maintain or display your User Content.

16. Viruses
16.1. HOKA Australia does not represent that any information (including any file) obtained from or through the website is free from computer viruses or other faults or defects. It is your responsibility to scan any such information for computer viruses.
16.2. HOKA Australia will not be liable to you or to any other person for any loss or damage (whether direct, indirect, consequential or economic), however caused and whether by negligence or otherwise, which may result directly or indirectly from any such information. To the extent that any liability may be imposed on HOKA Australia it shall be limited to the cost of re-supplying that information.
17. Afterpay
17.1. Afterpay does not charge a fee to consumers when purchasing and we do not charge interest. The only fees applied to consumers are late fees if your scheduled payments are unsuccessfully processed and, after being notified, you do not log in to your Afterpay account to make your payment via a different method.
17.2. If a payment has not been made by you on the Afterpay website before the scheduled payment date, we will automatically take payment from your default payment method on that date. The scheduled payment dates can be seen in the confirmation email sent to you after your order was approved, or by logging in to your Afterpay account at afterpay.
17.3. If an automatic payment fails, you have until midnight (AEDT in the summer months and AEST in the winter months) to make payment. After midnight, if that payment has not been made, you will incur a late payment fee of $10 and a further late fee of $7 if the payment is not made within 7 days (as stated in the Afterpay Terms).
17.4. We understand that there are certain extenuating circumstances which will not allow you to make payments on or before the scheduled date. If you believe you fall into this category and would like to discuss your payment schedule with us, please e-mail Afterpay here.
17.5. All new Afterpay customers are required to make their first payment at the time of purchase. You will no longer be considered a ‘new’ customer once you have fully paid off your first order AND 6 weeks have passed since you placed that order. For any order thereafter, your first payment will only be deducted 2 weeks after your purchase and your last payment deducted 8 weeks after purchase.
17.6. Afterpay is a PCI DSS Level 1 certified compliant Service Provider organisation. PCI DSS is a comprehensive set of requirements created by the Payment Card Industry Security Standards Council to enhance cardholder data security and to ensure the safe handling and storage of sensitive customer credit card information and data. 17.7. HOKA accept returns of online orders, providing the refund to you back via your Afterpay account. Please note that any outstanding payment instalments due will be processed until your refund has been completed. For information on how to return your online order see our returns information page.
17.8. Afterpay does not allow for exchanges. We do however encourage you to send back your online purchase and place a new order with us.
18. Guess the Brick Competition
18.1. Promoter: The Promoter is Accent Group Limited, ABN 85 108 096 251, Tel: (03) 9427 9422 of 2/64 Balmain St, Richmond VIC 3121 (Promoter).
18.2. Eligibility: Entry is only open to Australian residents who are aged 18 years or over (Entrant). Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
18.3. Promotion Period: The Promotion commences at 12:01 am AEST on Thursday 15th July, 2022 and closes at 11:59pm AEST on Sunday 14th August, 2022 (Promotion Period).
18.4. How to enter: To enter, Entrants must, during the Promotion Period:

Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt. Incomplete or indecipherable Entries will be deemed invalid. This competition is limited to one entry per person. If a person enters more than once, only their first entry will be counted in the promotion.
18.5. Judging: This Promotion is a game of skill. Judging of entries will be conducted at Accent Group Limited, 719 Elizabeth Street, Waterloo, NSW 2017 Australia on Wednesday 17th August, 2022. There will be 5 winning entries chosen for this Promotion. If there are not 5 entries that have correctly chosen the exact number of bricks contained within the HOKA Bondi 8 shoe as part of this promotion, the remaining winners will be chosen based on the closest entries to the correct number of bricks. If there are multiple people that have the same entry, winners will be chosen based on the earliest submission.
18.6. Prize: Each of the 5 winners will win the following prizes:

- 1x HOKA Performance Tee (RRP $89.99)
- 1x HOKA Hat (RRP $39.99)
- 1x LEGO set (RRP $39.00)
18.7. Prize notification: The winners will be contacted by 12:00 pm AEST on Wednesday 17th August, 2022 by email as well as the first names of the winners published on Facebook and Instagram that same day. It is the responsibility of the winners to check their email account and/or the Promoter’s Facebook Page or Instagram Page to determine if they are the winner, and to send an email containing their contact details to hayley.blease@accentgr.com.au within 7 days of the post which announces the winner. For privacy reasons, the Promoter will not contact the winner through Facebook or Instagram private messaging to notify them of their winning entry.
18.8. Unclaimed prizes: If for any reason any of the winners do not claim their prize within 7 days by Wednesday 24th August, 2022 at 12pm AEST then the prize or that part of the prize will be forfeited and will not be awarded to the winner.
18.9. Promoter's rights: The Promoter’s decisions is final, and no correspondence will be entered into, including in the event of a dispute. The Promoter reserves the right, at any time, to verify the validity of Entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
18.9.1. Use of, and rights in, Entries –: Entrants consent to the Promoter using their first name in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or LEGO. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook, Instagram or LEGO. Entrants release Facebook, Instagram and LEGO from liability for any loss or damage which they suffer or sustain as a result of participating in the promotion.
18.9.2. Privacy: The Promoter collects personal information (PI) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. 12. The Promoter will also use and handle PI as set out in its Privacy Policy, available at https://www.hoka.com/en/au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. 14. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy).
18.9.3. Prize delivery, acceptance, substitution or exchange: Winners should allow 28 days for the prize delivery. Prizes will be sent by the most suitable method of delivery for the prize (for example mail). The Promoter will notify the winner how they will receive their prize. 16. The Prizes (including any unused portion of a Prize) cannot be transferred, exchanged, replaced or redeemed for cash. The Prizes must be taken as offered and cannot be varied by a winner. The Promoter retains the right to substitute the Prize (or a part of the Prize) with a prize or prizes of equal or greater value (including where a Prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
