Promotion Period Entry into the Promotion commences at: 4:30pm AEDT Monday 13 February 2023 Entry into the Promotion closes at: 1:00pm AEDT Friday 17 February 2023 5. Eligible States and Territories NSW VIC QLD SA WA 6. Age Restriction Entrants and any companions (if applicable) must be: 18 years of age or over. 7. Maximum Number of Entries Entrants may submit as many entries as they wish however each entry must be submitted via a separate entry and must independently comply with these Competition Terms of Entry. For the avoidance of doubt, unless otherwise expressly stated, entrants may only win one (1) Prize each in the Promotion. 8. Entry Method Entrants may enter the Promotion in either or both of the following ways: Website Entry During the Promotion Period entrants must complete the online entry form and register their details in the manner required on the Website and answer in 25 words or less the question: “Tell us why do you need to win invites to see Budjerah Live In Nova’s Red Room In Sydney?”. AND/OR Nova App Entry During the Promotion Period entrants must download the Nova Player App, register their details, complete the entry form for the Promotion under the ‘win’ tab in the manner required and answer in 25 words or less the question: “Tell us why do you need to win invites to see Budjerah Live In Nova’s Red Room In Sydney?”. All valid entries received during the Promotion Period will be individually judged by representatives of the Promoter based on the Judging Criteria. During the Promotion Period, the Promoter will: Appear On Air At various times during the Promotion Period the Promoter will: (a) select up to ten (10) entrants judged to have submitted the ‘best’ online entries based on the Judging Criteria (as determined by the Promoter in its sole and absolute discretion) from all valid online entries, submitted up until that stage during the Promotion Period (each a Selected Entrant); (b) contact up to ten (10) Selected Entrants (as determined by the Promoter in its absolute and sole discretion) by telephone and place them on the standby list; (c) contact the Selected Entrant who submitted the ‘best’ online entry (based on the Judging Criteria in the Promoter’s sole and absolute discretion) from the standby list for that day on their Personal Contact Number and invite them to appear on air either live or in a pre-recorded segment (if applicable); (d) if the Selected Entrant successfully answers their Personal Contact Number within five (5) rings or by the time it goes to voicemail (the earlier of) and successfully appears on air (if applicable) for the purpose of the Promotion (as determined by the Promoter in its sole and absolute discretion), they will be deemed a winner and will be awarded a Prize (in the absolute and sole discretion of the Promoter); (e) if the Selected Entrant does not successfully answer their phone in accordance with clause (d) above or if their phone is turned off, engaged, the phone line drops out, or they are inaudible or they are unreachable for any reason, the Promoter may (in its sole and absolute discretion) contact the Selected Entrant with the next 'best' online entry (based on the Judging Criteria in the Promoter’s sole and absolute discretion) from the standby list for that day on their Personal Contact Number in the same manner as outlined above. This process may be repeated until a Selected Entrant successfully answers their phone in accordance with clause (d) above and is deemed the Prize winner and awarded the Prize (as determined by the Promoter in its sole and absolute discretion). The Promoter will select up to five (5) Selected Entrants in total (throughout the Promotion Period) judged to have submitted the ‘best’ online entries based on the Judging Criteria (as determined by the Promoter in its sole and absolute discretion) and award each of those Selected Entrants a Prize. For the avoidance of doubt the Selected Entrants may be invited to appear in a pre-recorded segment for the purpose of deeming the Selected Entrant a Winner and/or awarding them a Prize (as determined by the Promoter in its sole and absolute discretion). 9. Entry Restrictions Travel from WA/VIC/SA/QLD to/from NSW (If Applicable) If a Prize winner is ordinarily resident in WA/VIC/SA/QLD and state travel and border restrictions prevent them from travelling to/from NSW on the dates required in order to attend the Event, the Prize winner will still be awarded the flights and accommodation component of the Prize in the form of a travel voucher to redeem at a later date. Unfortunately state travel and border restrictions are out of the Promoter’s control, and no tickets to an alternative Red Room event will be provided. COVID Vaccination All Prize winners and companions attending the Event may need to show proof of up to date COVID vaccination status as per government guidance as to what constitutes ‘up to date’ for vaccination status at the time of the Event, by showing representatives of the Promoter their COVID Passport/vaccination certificate. Prize winners may not be allowed into the Event if they do not have government issued proof that they are fully vaccinated against COVID. Personal Contact Number Each entrant must nominate a personal contact number, either a personal mobile number or home phone number (and not a business number), to be eligible for a Prize (Personal Contact Number) and each entrant grants the Promoter the right to call that entrant on their Personal Contact Number live on-air. Entrants in the Promotion must be able to receive a phone call from a representative of the Promoter (on their Personal Contact Number) between the following timeframe (or such other time specified by the Promoter) and in accordance with the requirements outlined in the Entry Method: 4:30pm AEDT Monday 13 February 2023 and 6:00pm AEDT Friday 17 February 2023 If the entrant does not answer their phone by the time that phone goes to a message bank, the entrant consents to the Promoter broadcasting that entrant's voicemail message including their full name and/or business name live on-air. Each entrant warrants that it has obtained all consents from third parties to broadcast live on-air any information or names (including business names) in the entrant’s voicemail message. Each entrant warrants that they have received all consents from third parties that may ordinarily answer their Personal Contact Number in the entrant's absence to be broadcast live on-air if that third party answers the relevant phone live on-air. If a third party answers an entrant's Personal Contact Number, that entrant will not be eligible for a Prize as determined by the Promoter in its absolute and sole discretion. If for any reason an entrant is unable to be contacted, or is otherwise unable to, or declines to, appear on-air, or their phone line drops out or is inaudible, the Promoter (in its sole and absolute discretion) may replace that entrant by contacting/selecting another entrant and inviting them to appear on-air or participate in an on-air game or challenge (where applicable). The Promoter will repeat this process until an entrant is able to be contacted and confirms their eligibility and ability to appear on-air or participate in the relevant on-air game or challenge (where applicable). For the avoidance of doubt, if an entrant is spoken to by a representative of the Promoter, it does not mean they have been selected as an entrant or a winner (where applicable) and they may not be invited to appear on-air or participate in the relevant on-air game or challenge or be awarded a Prize (where applicable). 10. Judging All valid entries will be individually judged by representatives of the Promoter (Judges) (in the Promoter’s sole and absolute discretion) by 2pm AEDT Friday 17 February 2023 at the Promoter’s premises. All valid entries will be judged based on the Judging Criteria. 11. Judging Criteria All valid entries will be judged (by representatives of the Promoter) on originality, creativity and suitability or as otherwise specified by the Promoter (in the Promoter’s sole and absolute discretion). Where entrants are required to participate in a challenge or on-air game (if applicable), the Promoter may specify the relevant judging criteria prior to or at the time of the challenge or on-air game. 12. Prize There are up to five (5) Prizes to be won, each comprising of; • Two (2) invitations for one (1) winner and one (1) companion to attend Budjerah Live In Nova’s Red Room in Sydney, NSW on Monday 27 February 2023 at a time and location to be disclosed by the Promoter at the time of winning (Event); and, • One (1) night minimum three (3) star accommodation in a hotel in Sydney, NSW to be determined and specified by the Promoter, twin share, to be shared by the winner and their companion. Each Prize is valued at up to AUD $400 each (incl GST). Domestic Travel Prize If the Prize winner’s residential state is VIC, SA, QLD or WA, the winner will be awarded a Domestic Travel Prize, providing their state’s border restrictions permit travel into NSW as required to attend the Event, from their state of residence, which will comprise of the following: • Two (2) adult economy return airfares from the winner’s nearest capital city in the state that they ordinarily reside to Sydney, NSW (inclusive of airfare related taxes and charges). Domestic Travel Prize is valued at up to AUD $500 (incl GST). For the avoidance of doubt, the time, date and location of the Event is at the sole and absolute discretion of the Promoter and will be revealed to entrants at the time of winning. It is the Prize winner's responsibility to organise transport to/from the airport departure/return point. For the avoidance of doubt if a Prize winner is from WA/VIC/SA/QLD and state travel and border restrictions prevent them from travelling to/from NSW on the dates required in order to attend the Event, the Prize winner will still be awarded the flights and accommodation component of the Prize in the form of a travel voucher to redeem at a later date. Unfortunately, state travel and border restrictions are out of the Promoter’s control, and no tickets to an alternative Nova’s Red Room event will be provided. 13. Prize Restrictions It is the Prize winner and Prize winner companions’ responsibility to organise transport to and from the venue to attend the Event, there is no transfer component included as part of the Prize. 14. Total Prize Value Up to $4,500 (incl GST). 15. Notification of Winners Winners will be notified by one or more of the following by 6:00pm AEDT Friday 17 February 2023 ? mail ? email ? telephone ? in person ? on air at the time of winning ? Website(s) ? social media 16. Prize Claim Date Prizes must be claimed by 5:00pm local time Wednesday 22 February 2023 17. Prize Delivery Prize winners who receive the flight component of the Prize will receive a travel pack containing all etickets, itineraries, hotel information and travel information for the Prize. All travel dates, flights and accommodation are at the absolute and sole discretion of the Promoter. Prize winners will receive accommodation details via email. The winners’ names will be on a guest list at the Event. 18. Additional Conditions For the avoidance of doubt, entrants and their companion are restricted from winning the Prize under multiple Budjerah Live In Nova’s Red Room promotions, conducted by the Promoter. In the event the Event is cancelled, no alternative prize will be provided for the invite component of the Prize. The winner is responsible for checking state and federal government, health authority and travel advice to stay up-to-date with the latest travel requirements and restrictions relevant for travel to/from and between the relevant travel destination. The Promoter is not responsible for any such restrictions which may affect the winner’s (or any companion’s) ability to redeem and use the Prize (including but not limited to any travel restrictions in place in the winner’s (or any companion’s) ordinary state of residence around the time of the Event). The Promoter is not responsible for any cancellations in connection with government mandated lockdowns, quarantine or isolation restrictions, costs associated with quarantine or isolation as a result of redeeming the Prize, or as a result of the incapacity of the winner to travel for any other reason. The Promoter is not responsible for any cancellation, changes, delay or rescheduling of events, travel, activities and flights and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the winner and its companions. In the event that one or more event or activity is no longer available, the remainder of the prize shall constitute the complete and total Prize.
