1. General
1.1 The promoter responsible for the publication and adjudication of this Competition and the provision of the prizes is Journeywise Pty Ltd (ACN 631 846 681) of 12 Wairoa Avenue, Brighton East, Victoria 3187, trading as TheOneSpot. (the “Promoter”).
1.2 Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
1. General

1.2 Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
1.3. Entry is only open to Australian residents aged 18 years and over who reside in Australia, for the date of their winning prize. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
1.4 By entering this Competition, Entrants will be deemed to be bound by and agree to the current and applicable terms and policies imposed by the Promoters and the following Terms of the Competition stated below.
1.5 Any questions, comments or complaints regarding the Competition are to be directed to the Promoters.
1.6 Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the TheOneSpot Terms of Use, which can be viewed here.
1.7 Promotion commences on [0900] AEST 8 Feb 2021 and final entries close at [2400] AEDT on at 31 March 2021 (“Promotional Period”).

2. To Enter
2.1. Individuals can enter through:

2.2 Any data usage in accessing the entry pages through a suitable mobile phone is at the cost to the individual.
2.3 To submit an entry individuals must have an active account with TheOneSpot.
2.4 Entrants must add a minimum of three new properties to their “shortlist” in TheOneSpot during the promotional period and utilise one or more of TheOneSpot tools (calculator, checklists, notes, location search) associated with the property to “evaluate” the property.
2.5 All entries must be received by 2400 AEDT on Wednesday 31 March 2021.
2.6 No purchase is necessary to enter or win this Competition.
3. The Submission Restrictions
3.1 Individuals cannot enter multiple times with different accounts
3.2 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
4. Winner determination and announcement
4.1 The draw will take place at Journeywise Pty Ltd t/a TheOneSpot 12 Wairoa Avenue, Brighton East, Victoria 3187 on 2nd April 2021. The winner will be notified by Journeywise trading as TheOneSpot, by the contact method provided when the winner’s account was created on TheOneSpot. The Promoter’s decision is final and no correspondence will be entered into.
4.2 The promotion consists of one Prize. For the Prize, one valid entry as drawn at random from eligible entries will win the Prize.
4.3 The Prize includes:
? $1,000 Bunnings gift card
? delivery of gift card to the winner’s address in Australia
4.3.1 Total Prize pool value is $1,000 Australian dollars. The Prize is not transferable or exchangeable and cannot be taken as cash.
4.4 The winner must reply to the Promoter as instructed by 9am 6 April 2021, after receiving their winner notification with their full name, date of birth, postal address and email address in the message so that the Promoter may arrange for them to claim their prize.
4.5 After being contacted by the promoter, must confirm their acceptance of the Prize.
4.6 If for any reason the Prize winner does not confirm their acceptance of the Prize, a new winner will be redrawn at random from eligible entries and awarded to a valid entry at 9am 7 April 2021.
4.7 If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a Prize to the equal value and/or specification.
4.8 If a potential winner is disqualified for any reason, the applicable prize may be awarded to a runner-up, if any, in Promoter’s sole discretion.
4.9 The Promoter reserves the right to change the Prize mechanics of the Promotion at any time upon notification
4.10 The Promoter will provide at 48 hours notification of any changes to the operation of this Promotion as contemplated throughout these Terms and Conditions by providing a new set of Terms and Conditions for the Promotion for download within TheOneSpot website.
4.11 The Bunnings gift card is not transferable or exchangeable or redeemable for cash. It is non-refundable and cannot be altered in any way and cannot be taken in parts.
4.12 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
4.13 Any cost associated with accessing the promotional pages is the entrant’s responsibility and is dependent on the Internet service provider used.
4.14 Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the NonExcludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
4.15 Journeywise trading as TheOneSpot expressly disclaim any responsibility and entrants agree to indemnify and hold harmless the promotion entities from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this promotion (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any of the prizes awarded.
4.16 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a Prize.
4.17 The Promoter accepts no responsibility for Entries that are lost, damaged, corrupted, delayed, illegal or which are unable to be submitted due to software or hardware failure or for any other reason beyond its control including unavailability of the websites
4.18 This competition is run in line with New South Wales Trade Promotion guidelines.
4.19 The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
