Terms & Conditions
1. These Terms and Conditions set out the conditions of entry into the LOT-O-TRIVIA promotion (Promotion). Entry into this Promotion is deemed acceptance of these Terms and Conditions.
2. The promoter is TMS Global Services Pty Ltd ABN 22 089 771 835 ACN 089 771 835 of Level 1, 55 Flemington Road, North Melbourne, VIC 3051, telephone number (03) 9321 2800 (Promoter).
3. All references to time in these terms and conditions are a reference to Australian Eastern Standard Time (AEST).
4. The promotion commences on Monday 23 June 2014 at 11:00 AEST and finishes on Friday 25 July 2014 at 17:00 AEST (Promotion Period).
5. Entry to the promotion is free.
6. An entrant must be:
a. a resident of one of the following Australian states: New South Wales, Victoria, Tasmania, Northern Territory, Australian Capital Territory and Western Australia;
b. 18 years of age or older; and
c. an Ozlotteries.com member who holds a current registered account (Account Holder) (as defined in Section 6 of Ozlotteries.com Terms & Conditions available at http://www.ozlotteries.com/terms)
7. If you are:
(a) a resident of  Queensland or South Australia;
(b) not an Australian resident;
(c) an entrant whose Account is suspended or temporarily or permanently closed at any time during the Promotion Period for any reason including for responsible gambling reasons; or
(d) directors, managers, agents and employees of the Promoter and their immediate families,
you are not eligible to:
- enter this Promotion; or
- win any prizes resulting from this Promotion.
8. The Promotion comprises five Weekly Draws (as defined in condition #10) and a Major Prize Draw (also as defined in condition #10). Without limiting anything else in these Terms and Conditions, Account Holders are only permitted to attempt to enter each Weekly Draw once and, to enter a Weekly Draw, must submit a Qualifying Entry (as defined in condition #9) in respect of that Weekly Draw. An Account Holder is only eligible to win one prize during the Promotion Period. If an Account Holder wins a prize in a Weekly Draw, they are ineligible to enter the Major Prize Draw.
9. To participate in a Weekly Draw, and subject to these Terms and Conditions, Account Holders must, during the period that corresponds to that Weekly Draw (see condition #10):
(a) log onto Ozlotteries.com Facebook Page www.facebook.com/ozlotteries; and
(b) click through to LOT-O-TRIVIA competition tab; and
(c) respond correctly to the multiple-choice question that is related to that Weekly Draw; and
(d) enter their Ozlotteries Account email address. 
An Account Holder that completes the above process is an Entrant.
Only one entry per person will be permitted in a Weekly Draw and, in respect of each Weekly Draw, if an Account Holder attempts to answer the multiple choice question but does so incorrectly, they will not be permitted to have another attempt. An entry that contains the correct answer to the LOT-O-TRIVIA question for the relevant week is a Qualifying Entry. Incomplete, incorrect and incomprehensible entries will be deemed invalid. Any entries on behalf of the participant by a third party will be deemed invalid.
10. Each week during the Promotion Period, all Qualifying Entries received between 11.00am on Monday and 5.00pm on Friday of that week will be placed in a draw (Weekly Draw). A Weekly Draw will take place in respect of each week of the Promotion Period  and there will be 5 Weekly Draws in total.
All Qualifying Entries received during the Promotion Period (excluding any Qualifying Entry which wins a prize in a Weekly Draw) will be placed in the major draw, which will take place at 12:00 AEST on Monday 28 July 2014 (Major Prize Draw).

Major Prize Draw

11. Irrespective of anything else in these Terms and Conditions:
a. Each Qualifying Entry will be entered automatically in the Major Prize Draw except for those Qualifying Entries that have been drawn in a Weekly Draw.
b. An Account Holder is only eligible to win one prize during the Promotion Period.
12. There are 5 prizes for each Weekly Draw and each prize is $100 in cash. The total value of the prizes for each Weekly Draw is $500. There is one Major Prize which is $2,500 in cash. The total prize value for the Promotion is $5,000. Each entrant who submits a Qualifying Entrant which is drawn as part of a Draw referred to in this condition # 12 is a Prize Winner (also referred to as a Winner). This condition #12 is subject always to condition #11.
13. The Prize Winners will receive their prize amount in cash, which will be paid via electronic funds transfer (EFT) to their nominated bank account or in the form of a cheque made payable to the Prize Winner and crossed “not negotiable”.
14. All Prize Winners will continue to be bound by the Promoter’s terms and conditions.
15. Each Weekly Draw will be drawn at 9:00 AEST on the Monday following the Weekly Draw End Date in respect of that Weekly Draw. The Major Prize Draw will take place at 10:00 AEST on Monday 28 July 2014. The draws will take place at the premises of Jumbo Interactive Ltd at 601 Coronation Drive, Toowong, QLD 4066. 
16. In respect of each Weekly Draw, only five Qualifying Entries will be drawn by the Promoter and the Prize Winners will be the Entrants that submitted these Qualifying Entries. In respect of the Major Prize Draw, only one Qualifying Entry will be drawn and the Winner will be the Entrant Holder that has submitted this Qualifying Entry. This condition #16 is subject always to condition #11.
17. The Promoter's decision as to the result of each draw is final and no correspondence will be entered into.
18. The Promoter will attempt to notify the Prize Winners by email within 2 days after the relevant draw (excluding weekends and/or public holidays). The Promoter will also announce or publish the first initial, full surname, and suburb and/or state of the Prize Winners on the day of the draw on www.facebook.com/ozlotteries, the Promoter's website and other media.
19. Subject to the Promoter being able to contact the Winners via an email address or telephone number that is associated with their Account, the cash prizes will be deposited directly into each Winner’s nominated bank account by EFT or in the form of a cheque made payable to the Prize Winner and crossed “not negotiable” within 2 weeks of the applicable draw. Once the Promoter has made this payment,  the Pormoter and each of its related bodies corporate, associated agencies, and companies associated with this promotion will take no responsibility for any delay in delivery, or prizes damaged, delayed or lost in transit.
20. The right to a prize is not transferable or assignable to another person.
21. By accepting a prize, each Prize Winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed for the purpose of promoting this promotion.
22. If any Prize Winner is unable to be contacted within 3 months after the date of the draw, then that person's right to the prize is forfeited and the prize will be entered into an unclaimed prize draw. The Promoter may conduct this draw in its absolute discretion at the same location as the original draw(s) at 12:00 (AEST) on Friday 31 October 2014 in order to distribute any unclaimed prizes, but subject to any directions given by the relevant regulator.
23. The Promoter reserves the right, at any time, to verify the validity of an entry and to disqualify any Entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
24. The decision to verify, validate or disqualify an entry and/or winner is in the Promoter's absolute discretion.
25. The Promoter reserves the right to request entrants and/or winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter, acting reasonably. In the event that an entrant or winner cannot provide proof of identity to the Promoter’s reasonable satisfaction, the entrant or winner will forfeit their entry/prize in whole and no substitute will be offered.
26. The Promoter and each of its related bodies corporate, associated agencies and companies associated with this promotion will not be liable for:
(a) any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion;
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any tax liability incurred by a winner or entrant; or
(e) accepting or taking of prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
27. If the Promoter is prevented from or delayed in performing an obligation by Force Majeure, then the obligation is suspended during, but for no longer than, the period the Force Majeure continues and any further period that is reasonable in the circumstances. "Force Majeure" means an event beyond the reasonable control of the Promoter, which occurs without the fault or negligence of the Promoter.
28. Subject to obtaining the approval from the regulator (if applicable), the Promoter reserves the right to delay or modify any aspect of this promotion if for any reason it is not capable of running as planned (including without limitation, by reason of infection by computer virus, bugs, tampering, fraud, technical failures, power failures or due to any other causes unforeseen or beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion) but only to the extent necessary to overcome the issue that is affecting the running of the promotion as planned.
29. All entries become the property of the Promoter. By participating in the promotion, an entrant authorises the Promoter and each of their related bodies corporate, associated agencies and companies associated with this Promotion to access, collect and use personal information about the entrant, and disclose personal information about the entrant, to the Promoter and its associated bodies corporate, associated agencies and companies, for the purposes of:
(i) conducting the Promotion; and
(ii) providing the entrant with information about products and services of the Promoter. Such information may be provided electronically, or by contacting the entrant by telephone or other means, until such time as the entrant asks the Promoter not to provide further information; and
(iii) disclosing the initial, full name and suburb or town of a prize winner to selected media outlets as well as the Promoter’s website and Facebook page.

30. If an entrant does not provide the personal information requested, the entrant cannot participate in the Promotion and will not receive information about products and services of the Promoter. An entrant can request access to information or for their details to be updated, modified or deleted from the Promoter’s database by contacting the Promoter directly at privacy@tmsglobal.com.au.
31. Entry and continued participation in the Promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php
32. This promotion adheres to the terms and conditions set out in the Facebook promotion guidelines which can be found at: http://www.facebook.com/promotions_guidelines.php
33. By entering the Promotion, entrants acknowledge that:
a. they release both the Promoter and Facebook completely from any liability arising in connection with the Promoter.
b. the Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.
c. any information they provide to the Promoter in relation to this Promotion is being provided to the Promoter, and not to Facebook.
