‘The Other Art Fair Sydney’ Promotion
OFFICIAL RULES: NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility
Not just an Other art experience promotion (the “Promotion”) is open only to legal residents of Australia who are at least eighteen (18) years old at the time of entry. Employees of Other Art Fairs Ltd., dba The Other Art Fair (the “Sponsor”) and its parent, subsidiary, and affiliate companies, suppliers as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Subject to all applicable laws and regulations. Void where prohibited. Participation constitutes your full and unconditional agreement to these Official Rules and the Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Timing
The Promotion begins on March 7, 2018 at 12:00 a.m. Australian Eastern Standard Time (“AEST”) and ends on March 14, 2018 at 11:59 p.m. AEST (the “Promotion Period”). The Sponsor’s computer is the official time keeping device for the Promotion.
3. How to Enter
During the Promotion Period, visit http://sydney.theotherartfair.com/promotion and complete and submit the online registration form with your first and last names as well as a valid email address. Once you fill out the registration form, in its entirety, and submit, you will automatically receive one (1) entry into the Promotion.
There is a limit of one (1) entry per person/email address. Additional entries per person/email address will not be acknowledged. The use of an agency or any automated system to enter is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion.

The Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. In the event of a dispute as to any entry, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
4. Prize: One (1) grand prize will be awarded and one (1) winner will be chosen.
Description of Prize: Grand Prize (total value of $2,068)
Two (2) VIP tickets to The Other Art Fair Sydney happening March 22 including a fair bag and welcome drink ($130 value); a private tour with a Saatchi Art expert curator at The Other Art Fair Sydney; a $500 value gift certificate good towards purchase of original artwork at The Other Art Fair Sydney; a $500 value gift certificate good towards purchase of original artwork Saatchi Art; an overnight stay for two (2) at an Ovolo Hotel ($323 value); dinner for two (2) at Alibi Woolloomooloo ($200 value); two reserved tickets to a City Recital Hall Presents performance ($150 value); a $360 value gift certificate towards a National Art School Weekend Short Course; and an annual subscription to Art Edit magazine ($55 value).
There is an approximately 1 in 175,000 chance of winning the Prize. Actual odds of winning the Prize depends upon the number of eligible entries received during the Promotion Period.
No cash equivalent and all prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute a Prize for one of equal or greater value if a Prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with a Prize’s receipt and/or use.
5. Promotion Drawing
The selection of a potential winner is final and binding in all matters related to the Promotion. The Sponsor will randomly select one (1) potential prize winner from all eligible entries on or around March 12, 2018.
6. ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY THE SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE PROMOTION SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY, AND THE POTENTIAL PRIZE WINNER HAVE BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. THE SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE ENTRY AND IS VOID AND WILL NOT BE HONORED.
7. Verification of Potential Winner
Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Each potential winner will be notified by mail, email or phone. Each potential prize winner will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release (“Affidavit”) (except where prohibited), which must be received by the Sponsor within ten (10) days of the date notice or attempted notice is sent, in order to claim his/her prize (if applicable). If a potential winner of any prize cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), or the prize is returned as undeliverable, such potential winner forfeits the prize. In the event that the potential Winner is disqualified for any reason, the Sponsor will award a Prize to an alternate winner by random drawing from among all remaining eligible entries. All alternate potential winners are subject to all requirements set forth in these Official Rules.
8. Publicity
Except where prohibited, participation in the Promotion constitutes winner’s consent to the Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
9. General Conditions
The Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by the Sponsor in its sole discretion. In such event, the Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Release
THE PROMOTION IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, FACEBOOK, INSTAGRAM, TWITTER, GOOGLE, YOUTUBE, OR THEIR RESPECTIVE PARENT COMPANIES, DIVISIONS, AFFILIATES, OR SUBSIDIARIES. By participating, you agree to release and hold harmless the Sponsor, Facebook, Instagram, Twitter, Google and YouTube and each of their respective parent companies, divisions, affiliates, subsidiaries, officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from any injury, loss, or damage to person, including death, personal injury or loss or damage to property due in whole or in part, directly or indirectly to the acceptance or use/misuse of a Prize or prizes, participation in any promotion related activity, or participation in the Promotion (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, torts (including negligence), warranty, or any other theory or cause of action.
11. Limitations of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Promotion; (d) technical or human error which may occur in the administration of the Promotion or the processing of entries; (e) any damage to an entrant’s computer or telephone system that is directly or indirectly caused by accessing the Sponsor’s application, website, Facebook page, Instagram, Twitter account, or other social media accounts; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Promotion or receipt or use or misuse of any Prize or prizes. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant’s sole remedy is another entry in the Promotion, provided that if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, the Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, the Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
12. Disputes
Except where prohibited, you agree that: (a) any and all disputes, claims and causes of action arising out of or connected with the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a court located in Australia; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorneys’ fees; and (c) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of Australia, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction.
