Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
Entry is open to residents of Australia who are 18 years and over. Employees and their immediate families of the Promoter, its agencies and third parties associated with this competition are ineligible to enter.
The competition commences at 09.00 AM AEDT on 24/01/2022 and closes at 09.00 AM AEDT on 07/02/2022. Entries received after 09.00 AM AEDT on 07/02/2022 will not be accepted.
To enter:
a. visit www.amazon.com.au/spaceupgrades, and access the online entry form for this promotion, then complete all sections of the online entry form (including your full name, address, email address, date of birth and mobile number (i.e. the entrant’s details)) and submit the form during the Promotional Period;
and
b. answer the following question in 25 words or less: “Tell Alisa and Lysandra in 25 words or less how you would like to upgrade your living space and why?” No personally identifiable information, such as name and email address of the entrant should be provided with the entry.
Limit applies of one (1) entry per person.
This competition is a game of skill. Chance plays no part in determining the winner. All entries will be judged individually on their merits based on the below criteria.
a. Relevance of reasons why the entrant deserves a space upgrade; and
b. Innovation and creativity.
The best one (1) entry, as determined by the judges, will receive the prize, which will be delivered to the winner by Amazon Australia, the details of which will be obtained after the winning entry has been selected.
Judging will take place at 11.00 AM AEDT on 07/02/2022 at 121 Harrington Street, The Rocks, Sydney. Entries will be judged by one or more judges appointed by the Promoter.
Prize consists of products from amazon.com.au for the winner’s work-from-home setup, gaming setup and entertainment setup at the winner’s residential address in Australia. The total prize will be valued up to the maximum of $25,000 AUD. Products will be determined by Amazon Australia in its sole discretion. All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner.
Prize will be delivered to the winner within three (3) months of the winner being notified subject to any delays (including as a result of delivery or processing delays and/or any restrictions as a result of the COVID-19 pandemic). Winners will be notified of any delay.
It is a condition of accepting the prize that the winner agrees to participate in filming of promotional materials which will be shared via Amazon Australia channels, including but not limited to social media and PR. Relevant consents and releases will need to be obtained from the winner as part of accepting the prize.
The winner will be notified by email on or by 07/02/2022. Winner must accept the prize by email no later than 06.00 PM AEDT on 11/02/2022 in order to be entitled to the prize. Delivery details, consents and/or releases from the winner must be obtained as part of accepting the prize.
If any prize remains unclaimed in accordance with clause 12 or is otherwise forfeited despite the Promoter making all reasonable efforts to notify the winner, the Promoter may deem any winner as ineligible to receive the prize. In that event, the Promoter will reconvene the judges on 14/02/2022 at the same time and place as the first judging in order to distribute any unclaimed prizes. The next most creative and applicable entry, as determined in the discretion of the judges, will be deemed the replacement winner.
Any replacement winner will be notified by email on or by 14/02/2022. Replacement winner must accept the prize by email no later than 06.00 PM AEDT on 18/02/2022 in order to accept the prize.
Prizes are not transferable and are not redeemable for cash. The judges’ decision is final and binding – no correspondence will be entered into.
Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth).
Subject to clause 14, and to the extent permitted by law, the Promoter assumes no responsibility for:
a. any loss, damage or injury suffered by any winner as a result of the winner accepting and/or using a prize, except for any loss, damage or injury which is due to the negligence, fraud or wilful misconduct of the Promoter; or
b. any failure to receive an entry or for inaccurate information or for any loss, damage or injury in connection with the conduct of the promotion arising out of:
i. technical or telecommunications problems, including security breaches, technical website malfunctions or glitches; or
ii. acts or omissions (including negligent acts of omissions) of the Promoter's, employees, servants or agents involved in the conduct of this promotion.
In the event of such problems or conduct, the Promoter may (subject to relevant state and territory lottery regulations and where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion.
The Promoter reserves the right to request verification of age, identity, residential address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or is otherwise involved in any conduct that involves manipulating, interfering or tampering with this promotion or otherwise preventing the conduct of the promotion as intended by the Promoter. In the event of such problems or conduct, then the Promoter may modify, cancel, terminate or suspend the promotion.
The winner and any other person(s) sharing the prize with the winner may be required to sign an agreement to release the Promoter from, and indemnify the Promoter against, any loss, damage or injury arising from the use or participation in the prize, except to the extent any loss, damage or injury is due to the negligence or wilful misconduct of the Promoter.
Entries will be deemed accepted at the time of transmission if all mandatory fields are completed. Any dispute relating to whether entries have been received or not will be determined by the Promoter, whose decision is final. Any entry that contains content that the Promoter, in its sole discretion, considers to be incomplete, inaccurate, underage, erroneous, ineligible, offensive, misleading, inappropriate or incomprehensible will be deemed invalid, as well as any entry that the Promoter, in its sole discretion, considers to infringe any intellectual property rights or other rights of any person, corporation or entity.
Entrants consent to the Promoter publishing their name and/or associated entry on the Promoter's website and associated social media pages including Facebook, Instagram, Twitter and About Amazon blog.
Entrants consent to the Promoter using their name, image, entry and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
Any personal property rights in entries are owned by the Promoter. Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including but not limited to agents, contractors, service providers and, as required, to Australian regulatory authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.
