Sharp Shot Australia Terms and Conditions Sharp Shot Australia Competition (“Promotion”) is sponsored by Western Digital Technologies, Inc. or its affiliates (“Sponsor”) and G Squared Digital Marketing Pty Ltd is the Promotion Administrator. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook Inc. Participation in the Promotion constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements as stated in these Official Rules. Eligibility: The promotion is open to legal residents of Australia who are over 18 years of age. Employees of Sponsor and their respective affiliates, subsidiaries, agents, advertising and promotional agencies, retailers and distributors, as well as the immediate family (spouse, parents, siblings and children and their respective spouses, regardless of where they reside) and household members of any such employees, whether or not related, are not eligible to enter or win. Timing: The promotion begins on 7th of September 2017 at 9:00AM AEST and ends on 7th October 2017 at 12:00am AEST (The “Promotion Period”). An Entry must be received by the Sponsor before the end of the Promotion Period or it will not be accepted. Sponsors computer will be the official time-keeping device for this promotion. 1. Entry Requirements: All entries submitted during the promotion (“Entry”) must satisfy the following: 1.1: To enter, eligible persons must: 1.1.1: visit www.sharpshotaustralia.com ("Promo Page"); 1.1.2: follow the instructions for the Promotion (as indicated on the Promo Page) to submit a photo ("Entry Photo") and an entry form (which may include submission of your name, email address, comment, photo, and/or hashtag) (together, "Entry"). 1.2: Your Entry must be original and created by you. 1.3: You must have a high res copy of your Entry (300dpi at 1m x 1m print) 2. Entry Conditions: 2.1: By submitting an Entry, each entrant represents and warrants that their Entry: 2.1.1 does not refer to or contain any brand names other than those of the Sponsor and is not confusingly similar to any third-party product names, brand names or trademarks; 2.1.2: does not contain material that violates or infringes any third party’s rights, including but not limited to privacy, publicity, or intellectual property rights, or that constitutes copyright infringement; 2.1.3: does not contain material that promotes bigotry, racism, hatred, or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; 2.1.4: does not contain material that is inappropriate, obscene, indecent, tortuous, offensive, violent, hateful, or defamatory, or that disparages Sponsor or contains any other content otherwise prohibited by or contrary to the laws of the state in which the Entry is created; and 2.1.5 does not feature any individual other than yourself who has not consented to being photographed or otherwise included in the Entry. 2.2: Any Entry that is determined by Sponsor in its sole discretion at any time during the Promotion to violate the Entry Requirements or these Official Rules, or to otherwise be unsuitable, offensive or in poor taste, may be rejected and disqualified. Winner Selection: The most creative and compelling Entry Photo as determined by the Western Digital Judges will win the Grand Prize. Two runners up will win the Runner Up Prize. 47 finalists will win a Finalist Prize. Sponsor's sole obligation to any verified winner of this promotion is to furnish the winner with a prize described below. There will be a total of one (1) Grand Prize Winner, two (2) Runners Up and (47) Finalists. The Grand Prize Winner as well as each Runner Up and Finalist will also have their Entry Photo exhibited at an exclusive event in Sydney in November 2017 (the "Exhibition"). Grand Prize: The Grand Prize Winner (1) will become a Western Digital brand ambassador, subject to the final execution of a written agreement between Sponsor and the Grand Prize Winner. This means they will have their images shared by Western Digital on their social accounts worldwide as well as contribute to special collaborations. Prize Restrictions 3.1: Prizes, or any portions of Prizes, are not transferable, exchangeable or redeemable for cash. No part of the Prizes can be resold (at a premium or otherwise), advertised or offered for resale on the internet or any other medium. Stated Prize values are the recommended retail value (including GST) in Australian dollars, are provided by the supplier and are correct at the time of printing. 3.2: If any Prize, or component thereof, becomes unavailable for reasons beyond the Sponsor’s control, the Sponsor may substitute a Prize, or component of a Prize, of equal or greater RRP value, subject to any written directions from a relevant regulatory authority. Winners will not be entitled to any additional compensation in the event that the Prize (or component thereof) has been substituted at equal or greater RRP value. 3.5: Nothing in these Official Rules limits, excludes or modifies the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth), or any other implied warranties under any legislation in Australia. Except for any liability that cannot be excluded by law, the Sponsor (including its officers, employees and agents) excludes all liability (including for negligence), for any personal injury or any loss or damage (whether direct, indirect, special or consequential) arising in any way out of the Promotion, including but not limited to where such injury, loss or damage arises out of: (a) any technical difficulties or equipment malfunction (whether or not under the Sponsor’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Sponsor; (d) any variation in Prize value to that stated in these Official Rules; (e) any tax liability incurred by an entrant or a winner; (f) participation in the Promotion or any component of a Prize by an entrant or a winner; (g) the conduct, act or omission of any service provider or prize supplier associated with the Promotion; (h) cancellation or postponement of any portion of the Prize for any reason beyond the reasonable control of the Sponsor. 3.6: Each winner must accept prize as described in these Official Rules. If the prize winner is not willing or able to accept prize as described, the Sponsor may, in its discretion, disqualify that winner and award the prize to an alternate winner in accordance with the disqualification provisions below. Prize Delivery: prizes will be mailed or shipped to the winners in accordance with the information supplied to the sponsor by the winners. Allow up to 4 weeks after winner notification for all prizes to be received. 4. Winner notification, verification and disqualification 4.1: Winners will be notified on 8thth October 2017 by 4:00PM AEST via an email nominated by the entrant at the time of submission. The Grand Prize Winner will be acknowledged on Facebook to the SanDisk and WD social audience on 15th October 2017. Winners must respond to Sponsor by email within 7 days to claim the prize. Grand Prize Winner will be identified by first and last name in the winner announcement post on Facebook. 4.2: The Sponsor reserves the right to request verification of age, identity, residential address and any other information from any entrant or winner relevant to entry into or participation in the Promotion. Verification is at the discretion of the Sponsor, whose decision is final. The Sponsor reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the Promotion. Entry forms are void if stolen, forged, mutilated or tampered with in any way. 4.3: Disqualification: In the event that (a) any attempted notification or prize delivery to a potential winner is returned as undeliverable, (b) any prize is unclaimed within the required time period, or (c) any potential winner (i) does not reply to the initial notification within the time required, (ii) fails to satisfy any eligibility or verification requirement herein, (iii) declines to accept the prize or to accept the prize as described herein, (iv) or is otherwise determined to be ineligible or not in compliance with these Official Rules for any other reason, Sponsor in its discretion may disqualify that individual and award the prize to an alternate winner as determined by the Western Digital judges. An alternate winner is subject to all eligibility requirements and restrictions of these Official Rules. 5. General Conditions: 5.1: To the extent permitted by law, the Sponsor accepts no responsibility for: 5.1.1: any late, lost or misdirected entries or other communications; or 5.1.2: any Internet traffic congestion or problems with, or technical malfunction of, any hardware or software, including but not limited to any damage to the hardware or software of any entrant or other persons related to participation in the Promotion. The decision of the Sponsor is final and binding; no correspondence will be entered into. 5.2: Sponsor reserves the right to cancel, terminate or suspend this Promotion or any part of this Promotion should any non-authorized intervention or other cause beyond Sponsor’s control corrupts or impairs the security, administration, fairness or operation of this Promotion as determined by Sponsor in its sole discretion. 5.3: Sponsor reserves the right to correct typographical or clerical errors in any Promotion related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available or claimed, Sponsor reserves the right to award only the stated number of prizes. 5.4: Sponsor reserves the right to prohibit you and any other entrant from participating in the Promotion if, at its sole discretion, Sponsor finds such entrant to be tampering with the entry process or the operation of the Promotion, of if the entrant has repeatedly shown a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner Sponsor determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or Sponsor; or (c) in any other disruptive manner. Any person attempting to defraud or tamper with this Promotion in any way will be ineligible for prizes and may be prosecuted to the full extent of the law. Any failure by Sponsor to enforce any of these Official Rules shall not constitute a waiver of these Official Rules. Publicity: Entries remain the property of the Sponsor. Except where prohibited by law, a winner's acceptance of a prize constitutes permission for Sponsor and its designees to use that winner's name, photograph, likeness, statements, biographical information, voice, address (city and state), Entry and details of winning for advertising, promotion and other purposes, worldwide and in all forms of media, in perpetuity, in any manner, together with other materials, without further compensation or notification to, or permission from, the winner, for the purpose of promoting the Promotion (including any outcome) and/or promoting the Photo Book. Copyright and Moral Rights: By submitting an Entry, you grant to the Sponsor an irrevocable, perpetual, royalty-free, worldwide licence, which can be assigned and sublicensed, to use, reproduce, communicate, publish, distribute, display and create derivative works from your Entry Photo, without any payment, compensation or further notification to or permission from you, for the purposes of: • conducting this Promotion; and • including your Entry Photo in the Photo Book and in the Exhibition. For the avoidance of doubt, you also consent to the Sponsor, and anyone acting on behalf of the Sponsor, doing any act in accordance with the licence aforementioned that would otherwise constitute an infringement of any moral or intellectual property rights that you or any other relevant party may have in your Entry Photo. Governing Law: This Promotion is governed by New South Wales law. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrant and Sponsor in connection with this Promotion shall be governed by and construed in accordance with the laws of New South Wales, without giving effect to any choice of law or conflict of law rules (whether of New South Wales or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New South Wales. Disputes: The Sponsor and any consumer who participates in the Promotion submit to the non-exclusive jurisdiction of the courts of New South Wales in respect of all matters arising out of or relating to these Official Rules, and the performance or subject matter of the Promotion. Severability: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision.
