TERMS AND CONDITIONS Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Entry is only open to Australian residents aged 18 years or over. Employees of The Glossary Pty Ltd (and their immediate family) are not eligible to enter this promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. Promotion commences 9am AEDST on Monday 18 March 2013 and closes 5pm AEDST on Sunday 7 April 2013 ("Promotional Period"). To enter, eligible entrants must, during the Promotional Period, visit http://www.facebook.com/theglossaryshop, follow the prompts to the competition entry page, fill in the requested details including their full name, email, answer the questions provided including describing in 25 words or less what is wrong with your current wardrobe. As a condition of submitting an entry, entrants agree that they will be signed up to the email newsletter of The Glossary Pty Ltd they nominate in their entry (if they are not already signed up). Only entries received via http://www.facebook.com/theglossaryshop will be accepted and only one (1) entry per person is permitted. Incomplete or incomprehensible entries will not be included in the judging. The Promoter reserves the right, at any time, to verify the validity of entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant that submits an entry that is not in accordance with these Terms and Conditions or tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. All entries become the property of the Promoter. As a condition of entering into this promotion, each entrant agrees to, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display the entry for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants further acknowledge and agree that elements of their entry may be displayed on the Promoter's website during the Promotional Period and for a period of up to six (6) months afterwards. Entrants agree not to assert any moral rights in relation to such use by the Promoter. Entrants warrant that they have the full authority to grant these rights. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on creative merit and originality. The judging will take place at 409/3 Gladstone Street, Newtown, NSW 2049 on Sunday 7th April 2013. The best valid entry will win an email-based styling consultation with our Style Consultant and $1,000 worth of The Glossary Pty Ltd stock selected on behalf of the winner by the Style Consultant. There will be one prize awarded in this promotion. The judges reserve the right to select additional reserve entries which they determine to be potential runner up winners, and record them in order of merit for use in case of an invalid entry or ineligible entrant. The Promoter's decision is final and no correspondence will be entered into. Winning entrants ("Winners") will be notified by email on Monday 8 April 2013 or Tuesday 9 April 2013. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. By accepting a prize, each Winner acknowledges and agrees that: they may be contacted by the Promoter via telephone and/or email during or after the promotion; Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Trade Practices Act, ASIC Act, or the Competition and Consumer Act including the guarantees under the Australian Consumer Law or similar laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant or Winner; or (f) use of, or participating in, a prize. In order to conduct this promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into The Glossary Pty Ltd database. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of the Promoter.
