By Entering the Competition, You (“Entrant” or “You”) (Or Your Parent Or Legal Guardian If You Are Under The Age of Majority) Must Agree to These Official Rules, Which Create a Contract So Read Them Carefully Before Entering.
Information on how to enter, the prizes and rules for redeeming the prizes form part of the terms and conditions of entry for the Competition. Participation in the Competition is deemed to be acceptance of “Official Rules” (“Official Rules”) and any other notices referenced herein.
In these Official Rules, the term “you” refers to any person who enters, or who wishes to enter, the Competition.
The Promoter of this Competition is Expedia Australia Pty Limited of Suite 1, Level 2, 77 King Street, Sydney, ABN 12 101 694 946 (“Expedia”) and Expedia, Inc., 333 108th Avenue NE, Bellevue, Washington 98004 USA is the sponsor of this Competition. The permit numbers for this promotion are NSW permit no. LTPS/15/06183?issued on 10/08/2015, ACT permit no. TP 15/06897 issued on 12/08/2015.
1. Eligibility: The Lastminute.com.au “Happy 15th Birthday“ Competition is open only to legal residents of Australia who are at least eighteen (18) years old at the time of entry and have a Facebook, Instagram or Twitter account and who otherwise meet the requirements set out in these Official Rules. Employees of the Promoter or Sponsor, their subsidiaries, affiliates, prize suppliers and advertising/promotion agencies as well as their respective immediate family members (spouse, parents, siblings and children and each of their respective spouses, regardless of where they reside) and household members (whether or not related) of those employees are not eligible to enter.
2. Competition Period: The Competition Period begins at 10:00 AM Australian Eastern Standard Time (“AEST”) on Monday, 17th August 2015 and ends at 10:00 AM AEST on Friday 21st August 2015. Entries submitted before or after the Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Competition.
3. How to Enter: This Competition is a game of chance. To enter the Competition, you must, at any time during the Competition Period, visit any of the following Lastminute.com.au social media accounts: www.facebook.com/lastminute.com.au, https://twitter.com/lastminute_au or www.instagram.com/lastminutecomau/ and follow the applicable instructions set out below:
i. Facebook: Submit an entry by posting a comment on the specified competition post by including the phrase: Pick me, I RSVP! #livelastminute.
ii. Twitter: Submit an entry by replying to one of our competition tweets with the following phrase: @lastminute_au Pick me, I RSVP! #livelastminute.
iii. Instagram: Repost or regram the competition image, and caption the image with the #livelastminute hashtag and @lastminutecomau.
4. Winner Selection: All valid entries will be exported into an excel spreadsheet and go into a random electronic draw, which will take place on Friday, 21st August 2015 at 12pm AEST at 7 Baroona Rd, Milton, QLD, 4064. The first valid entry drawn will win the following Prize:
One (1) x AU$1,000 Lastminute.com.au branded Visa Card (Prize). To use your Visa card: visit http://www.giftcardplanet.com.au/ and activate the card (within two (2) months of the date of receiving the Prize) by entering the sixteen (16) digit card number and following the prompts. Once activated, the card can be used at any VISA terminal by swiping, selecting credit and then signing or entering the four (4) digit PIN on the back of the card. Terms and conditions can be found at: http://www.giftcardplanet.com.au/visa-terms.If the Prize is redeemed on lastminute.com.au, the Visa Card cannot be used on a booking transaction that is valued at more than the AU$1,000 Prize amount. Sponsor cannot guarantee that any particular product will be available at the time the winner would like to use their Prize. The price and availability of all products listed on the lastminute.com.au site is subject to change. The value of the Prize must cover any lastminute.com.au or lastminute.co.nz booking fees.
The Promoter will notify the potential winner within two (2) business days of the prize draw, by commenting through the Lastminute social media channel the winner used to submit their winning entry. The Promoter will attempt to tag the winner’s account name and request the potential winner to email social@lastminute.com.au with their contact details in order to receive their Prize.
The potential winner is responsible for paying all applicable federal, provincial, state, local, income and withholding taxes, if any. In the event that any tax withholding is required by law for the prize, potential winner authorises Sponsor to make the corresponding deduction. Any prize details not specified above will be determined by Sponsor, in its sole discretion. Potential winner may not transfer, assign or substitute the prize, or redeem prize for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value. Prize is awarded "as is" without any warranty or guarantee, either express or implied by Sponsor.
The prize will be provided by the Promoter. Specific Prize details are at the discretion of the Promoter.
The maximum total value of the prize pool is AU$1,000.
5. Entry Requirements: Entrants may submit a maximum of one (1) entry per social media profile for each social media channel. Any entries in excess of the stated limitation will be automatically disqualified and the Sponsor may, in its absolute discretion, disqualify such entrant’s participation in the Competition. Entries submitted by any other method other than those listed above in Section 3 will be automatically deemed invalid and will not be entered into the Competition. Entries generated by script, macro or other automated means or practices, and entries by any means which subvert the entry process are void. Any entries that: (i) violate any third party rights, including, but not limited to, copyrights or trademark rights; or (ii) contain content that is obscene, indecent, or otherwise inappropriate, as determined by Sponsor, in its sole discretion, will not be entered into the Competition.
6. Sponsor’s Rights to Submissions: By entering, you grant Promoter, Sponsor, and their agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) license and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your entry and all elements of such entry, including, without limitation, responses to the questions, as-is or as-edited (with or without using your name) in any media throughout the world, in perpetuity, for any purpose, without limitation, and without additional notification, review, compensation, or approval from you or any other party.
7. Potential Winner Requirements: The potential winner may be required to submit to the Promoter and Sponsor their first name, last name, email address and proof of ownership of winning social media account in order to redeem the Competition prize.
8. Redraws: In the event the prize winner fails to claim his or her prize by 12 pm AEST, 23rd November, 2015, the prize winner will be deemed to have forfeited the prize and will not be entitled to any supplementary prize or benefit. If the prize is forfeited, the Promoter will conduct a redraw in respect of all other entrants at 12:01 pm AEST, 23th November, 2015 at the same location and method as the original draw as outlined in Section 4. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation. The Promoter will notify the potential winner within two (2) business days of the prize draw, by commenting through the Lastminute.com.au social media channel the winner has submitted their entry. The Promoter will attempt to tag the winner’s account name and request the potential winner to email social@lastminute.com.au with their contact details in order to receive their Prize.
9. General Conditions: In the event that the operation, security, proper play or administration of the Competition is impaired in any way, the Promoter may, in its sole discretion, (a) suspend the Competition to address the impairment and then resume the Competition; or (b) terminate the Competition and award the prize according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Promoter reserves the right, in its sole discretion, to disqualify and seek any and all remedies available from any individual who tampers with the operation of the Competition, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to the Promoter by mail or via the internet shall not be deemed proof of receipt of that communication by the Promoter. The Competition is subject to federal, state, and local laws and regulations, and is void where prohibited. Each entrant acknowledges that the promotion is in no way sponsored, endorsed or administered by or associated with Facebook, Twitter or Instagram and that Facebook, Twitter and Instagram has no responsibilities in relation to the promotion. Participants acknowledge that any information provided by them in connection with the promotion is provided to the Promoter and not to Facebook. Any questions or comments about the promotion should be directed to the Promoter and not to Facebook, Twitter or Instagram. The Promoter expressly reserves the right to change or alter these Terms and Conditions at any time subject to the approval of all relevant lottery departments if required.

By entering this Competition or providing personally identifiable information you consent to the collection, processing, maintenance and transfer of such information in and to the United States and other applicable territories outside of the country where the data was collected from you. The data protection and other privacy laws of the United States and such other countries may not be as comprehensive as those in your country. The Released Parties (as defined below) will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with Sponsor’s Privacy Policy and these Official Rules in respect of such transfer, but will not otherwise take steps to ensure compliance with applicable laws in your country of residence. By participating in the Competition, participants expressly agree to such transfer. In the event of an inconsistency between these Official Rules and the Sponsor’s Privacy Policy, these Official Rules shall prevail.
11. Licence By entering this Competition you grant Promoter, and its agents, licensees, and assigns and irrevocable, perpetual (non-exclusive) license and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit and otherwise use your entry and all elements of such entry, including, without limitation, responses to the questions, as-is or as-edited (with or without using your name) in any media throughout the world, in perpetuity, for any purpose, without limitation, and without additional notification, review, compensation, or approval from you or any other party.
12. Release and Limitations of Liability: By entering, you agree to release and hold harmless the Promoter and the Sponsor, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any prize, including, but not limited to: (a) unauthorised human intervention in the Competition; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) any errors on the Competition site that may impact may entry; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Competition; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
13. Disputes: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New South Wales, Australia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Promoter or the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of New South Wales, Australia, without giving effect to any choice of law or conflict of law rules (whether of NSW or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New South Wales, Australia.

15. Results: The winner will be announced within 2 business days of the prize draw on the following lastminute.com.au subdomain: http://www.lastminute.com.au/p/competition-winners.htmland displayed for a period of three months. In the event there is a redraw, the redrawn winner will also be announced within 2 business days of the prize draw on the above lastminute.com.au subdomain and displayed for a period of three months.
