2.0. Entries
2.1. To enter this promotion, you must meet the following criteria:
2.1.1. You must be over the age of 18.
2.1.2. You must be an Australian resident.
2.1.3. You must not be an ESSA employee, immediate family of an ESSA employee, or current member of ESSA.
2.2. Only one (1) entry is allowed per person.
2.3. Entries will be open from 8:00am on Monday 24th May 2020 AEST and will close at 11:59pm on Sunday 30st May
2021 AEST.
2.4. Incomplete or indecipherable entries are invalid.
2.5. Entries must be submitted in English (foreign languages will not be accepted).
2.6. By entering this competition, you agree to the terms of our Privacy Policy.
2.7. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age
and place of residence) and reserves the right, at its sole discretion, to disqualify any individual who the Promoter has
reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in
any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion.
2.8. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to
automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
2.9. Entrants are responsible for any and all expenses that they incur in entering the
competition and will not be reimbursed (regardless of whether or not they win).
3.0. Prize
3.1. The Prize for this competition is one (1) Visa Gift Card to the value of $1,000.00 AUD (one thousand Australian
dollars).
3.2. The winner must also adhere to the Terms of Use that apply to the Gift Card.
3.3. Any additional costs associated with the Prize are the sole responsibility of the Winner, not the Promoter.
3.4. This prize is not transferable or redeemable for cash.
4.0. Competition Winner
4.1. The selection of the Winner is subject to the discretion of the promoter and cannot be contested by entrants.
4.2. The Promoter’s decision is final, and no further correspondence will be entered into.
4.3. The Winner will be contacted Tuesday 1st June 2021.
4.4. The Winner will be announced via Exercise Right social channels (also on Tuesday June 1st 2021).
4.5. The Winner will have one (1) week to contact the Promoter to claim the prize.
4.6. The Winner is required to provide further personal details in order to receive the prize (including but not limited to
full postal address, phone number, DOB).
5.0. Liability
5.1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due
to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties,
unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted
by law to: (a) disqualify any entrant; or (b) subject to any written directions from a regulatory authority; or (c) modify,
suspend, terminate or cancel the promotion, as appropriate.
5.2. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the
statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied
warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“NonExcludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the promotion.
5.3. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter
(including its respective officers, employees and agents) is not responsible for and excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or
not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize
claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any
reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms
and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of/taking/redeeming a prize.
