TERMS AND CONDITIONS
1) Information and instructions on how to enter the Audi Australia Facebook Competition (the “Promotion”) and information on prizes form part of these Terms and Conditions. By entering the Promotion, entrants accept these Terms and Conditions.
Promotor
2) The Promoter is Audi Australia Pty Ltd (ABN 86 077 092 776) of Level 7, 895 South Dowling Street, Zetland NSW 2017. Telephone: (02) 9695 6200.
Eligible Entrants
3) Entry is only open to residents of Australia and owners of an Audi vehicle who are over the age of 18 years (“Eligible Entrant”). Employees and directors of the Promotor and their immediate families, the Promoter’s related bodies corporate (as that expression is defined in the Corporations Act 2001 (Cth)), its agencies and retailers associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4) Any person who is discovered to have used or attempted to use any more than one name in order to enter the Promotion, except in the case of a legal change of name, is ineligible to enter this Promotion.
Promotion Period
5) The promotion commences on 5 November, 2018 at 11:00 (AEST) and closes on 5 December 2018 at 23:59 (AEST) (“Promotion Period”).
6) This Promotion is a game of skill. Chance plays no part in determining the Prize Winner (as defined in clause 13). Each valid entry will be individually judged (by representatives of the Promoter) based on the originality and creativity of the photo provided in the entry (“Judging Criteria”). The judges’ decision is final and no correspondence will be entered into.
Entry Method
7) To enter the Promotion, an Eligible Entrant must, during the Promotional Period post an original photo showing their most creative picture of their Audi and their pet, on Audi Australia’s Facebook Page https://www.facebook.com/AudiAustralia (“the Facebook Page”) on the promotional post relating to this Promotion. Entrants must act in accordance with Facebook’s requirements and the Facebook Statement of Rights and Responsibilities at all times, which can be viewed at www.facebook.com/terms.php.
8) Entries that, in the Promotor’s opinion, contain offensive, defamatory or otherwise objectionable or inappropriate material or that infringe any third party rights (including intellectual property rights) will be invalid and therefore ineligible to enter the Promotion or win a Prize (as defined in clause 13). Any dispute relating to whether entries have been received or not, will be determined by the Promoter, whose decision is final. The Promoter accepts no responsibility for late, lost or misdirected entries.
9) Once an entry is submitted, the entry may not be withdrawn, altered or deleted (except as and where required by the Promoter).
10) An Eligible Entrant must create their own entry and may only enter once during the Promotion Period.
Use of Entries
11) By entering this Promotion, an Eligible Entrant consents to their name, image, content of their entry and any other information submitted to the Promoter being published in any form of media by the Promoter.
12) Use or any publication of entries during or after the Promotion Period (in any form of media) does not mean that an entrant has been selected as a winner in the Promotion, and that entrant may not be awarded a Prize.
Determination of Prize Winner
13) Chance plays no part in determining the winner of this Promotion. All valid entries received will be judged no later than on 7 December 2018 finishing at 17:00 (AEST). Entries will be judged by a judging panel consisting of representatives of the Promotor (“Judging Panel”). The Prize (as defined in clause 14) will be awarded to the Eligible Entrant whose entry, in the opinion of the Judging Panel, best meets the Judging Criteria, as determined by the members of the Judging Panel in their absolute and sole discretion (“Prize Winner”).
14) The Prize Winner will receive a $1,000 voucher to be used towards Audi Genuine Accessories and / or Audi Service (as set out on https://forms.myaudi.com.au/locate-a-dealer) (“Prize”).
15) Dollar values are quoted in Australia dollars. The Prize is not redeemable for cash and is personal to the winner. It cannot be transferred, exchanged or otherwise be dealt with. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher. In the event for any reason a Prize Winner does not take an element of the Prize at the time stipulated by the Promoter or in the terms and conditions relating to the voucher, then that element of the Prize will be forfeited by the Prize Winner and cash will not be supplied in lieu of that element of the Prize.
16) The total prize pool value is up to $1,000 (incl GST).
17) The Prize Winner will be notified via email on 7 December 2018 and published on the Audi Australia Facebook page.
Proof of identity
18) The Promoter reserves the right to request the Prize Winner to provide proof of identity, proof of residency at the nominated prize delivery address, and proof of entry validity in order to claim any prize. Proof of identification, residency and entry validity considered suitable for verification is at the discretion of the Promoter. In the event that a Prize Winner cannot provide suitable proof, the Prize Winner will forfeit the Prize in whole and no substitute will be offered.
19) The Promoter’s decision is final and no correspondence will be entered into. If a Prize, or element of a Prize, is unavailable for any reason, the Promoter reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority.
20) If a winning entry is deemed not to comply with these Terms and Conditions or any Prize remains unclaimed by 14 December 2018 at 17:00, the next best winner will be determined by the Judging Panel based on the Judging Criteria for the unclaimed or available Prize.
Limitation of Liability
21) Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot be excluded, including the Non-Excludable Guarantees, the Promotor The Promotor (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion or accepting or using any Prize.
22) The Promoter has no control over communications networks or services, the internet or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
Publicity
23) By accepting the Prize, the Prize Winner agree to participate in and co-operate with, if required by the Promoter, all reasonable media editorial requests relating to the Promotion, including but not limited to, being interviewed and photographed and/or filmed.
Tax implications
24) The Promoter accepts no responsibility for any tax implications that may arise from winning of the Prize. Independent financial advice should be sought.
Submission of Content or Material
25) Entries that are found to have been derived from third party work will be considered invalid and, if awarded a Prize, that Prize must be returned to the Promoter. Without limiting the generality of other conditions, the Promoter reserves the right to take legal action against anyone found to have breached this condition. If the Promoter becomes aware after an entrant has won a Prize that the entrant has not complied with these Terms and Conditions, that entrant will have no entitlement to the Prize, even if the Promoter has announced them as a winner. That entrant will be required to return, refund or otherwise make restitution of the Prize. The Promoter’s legal rights to recover damages and other compensation are reserved.
26) Each entrant warrants and agrees that:
a. the entrant has created the entry himself/ herself;
b. the entrant is entitled to reproduce and exploit all of the underlying works in the entry;
c. the entrant will not submit material in their entry that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless the entrant is the owner of such rights;
d. the entry has not been previously published in any other medium or forum worldwide;
e. the entrant will not submit material that is unlawful, obscene, defamatory, derogatory, threatening, pornographic, sexually inappropriate, violent, abusive, harassing, hateful, racially, religiously or ethnically offensive, or encourages, evidences or indicates conduct that would be considered a criminal offence, gives rise to civil liability, or violates any law;
f. the entry will not cause injury or harm to any person or entity; and
g. the entrant has not granted rights to their entry to any other person which is inconsistent with the rights granted to the Promoter.
Intellectual Property Rights
27) Each entrant consents to the Promoter (and each of its assignees and licensees) doing or omitting to do anything which may infringe any and all moral rights of the entrant including to edit, alter and reproduce the entry, and that such consents have been obtained to the full extent permitted under the Copyright Act 1968(Cth).
28) An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promotor. Each entrant acknowledges and agrees that if his/her entry wins, the Promoter (any each of its assignees and licensees) have the right, in their absolute discretion, to edit, amend, copy, use, publish, broadcast and communicate to the public, the entry in any media including the internet, without any further consultation, reference, payment or any other compensation to the entrant.
Cancellation and disqualification
29) If the Promotion is not capable of being conducted due to circumstances beyond the Promoter’s control the Promoter reserves the right to amend, suspend or cancel the Promotion subject to approval from any relevant authority.
30) The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Facebook
31) The entrant acknowledges that the Promotion is in no way sponsored, endorsed, administered by or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the Promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
32) By accepting these Terms and Conditions each entrant releases Facebook from any possible claim or liability.
Use of personal information
33) The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, employees and service providers assisting with this promotion. The Promoter will keep an entrant’s personal information for only as long as is necessary to carry out the purpose(s) described above (unless we are required or permitted by law to hold the information for a longer period). The Promoter may, if the entrant has opted in, and, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant in accordance with the Promoter’s privacy policy located at http://www.audi.com.au/au/brand/en/tools/navigation/meta/privacy.html. Entrants should direct any request to access, update, and correct information or opt out to the Promoter.
