COMPETITION TERMS AND CONDITIONS – ‘Shop and Win’
1 INTRODUCTION
(a) The following terms and conditions (“Terms”) apply to Floreat Forum Shopping Centre’s ‘Shop
and Win’ (“Competition”). Entrants warrant that by submitting an entry into this Competition, they have
read, understand and agree to be bound by these Terms.
These Terms may be collected at the Floreat Forum Centre Management Office, corner of Howtree Pl
and The Boulevard, Floreat.
(b) These Terms may be varied from time to time by the Promoter.
2 PROMOTER
The prom
5 METHOD OF ENTRY
(a) To enter the competition, the following steps must be followed:
(i) To enter the competition, entrants must provide their name, email address, proof of purchase
and select the specialty store they made a purchase at via a form on the Centre website competition
page (www.floreatforum.com.au/shop-and-win), during the competition dates.
(ii) A purchase of $50 or more is required to be made from Floreat Forum retail stores/restaurants
during the competition dates to receive a unique competition code card and enter the competition.
Entrants can only upload one unique proof of purchase per entry.
(iii) Final entries for the draw must be submitted by midnight on Sunday 4 March 2018.
(iiii) A specialty store is defined as an independent retailer and excludes Woolworths and Coles.
6 DRAW
(a) An entrant will be deemed a prize winner of the Competition if they are the first valid eligible
entry to be drawn by the Promoter, with a valid receipt.
(b) There will be one (1) winner selected. The competition ends midnight Sunday 4 March 2018
and draw will be done on Wednesday 7th March 2018. The winner will be the first (1) person selected at
random for the draw. The draw will take place at 3pm on Wednesday 7th March 2018 by a Centre
Management Representative.
(c) The Promoter’s decision on the prize winner is final and no correspondence will be entered
into.
7 PRIZE
(a)The main prize is a $1000 shopping voucher for The Floreat Forum. The total prize pool is valued at
$1000.
(b) There are daily prizes drawn Monday to Friday. These prizes will be awarded at random and will be
either a $25 Boulevard Hotel voucher, a $50 Floreat Forum voucher or a $20 Coffee Club voucher.
8 PRIZE CONDITIONS
(a) Prizes are not transferable and may not be redeemed for cash from the Promoter.
(b) The Promoter does not warrant the merchantability, suitability and/or fitness for purpose of any
goods or services awarded as a prize.
(c) No other costs are included in the prize. All expenses (including but not limited to the costs of
transport to and from a prize venue and meals), other than those specifically referred to above, will be at
each winner’s and (if applicable) their accompanying guest’s cost.
(d) Obtaining time off work and/or study or related activities to participate in the Competition and/or
a prize is at the sole cost of the entrant. No compensation will be provided for any costs incurred.
(e) A maximum of one (1) prize per household / family is permitted.
9 NOTIFICATION
All prize winner(s) will be notified of winning via phone call and/or email. The winner may be requested
to provide contact details.
10 PRIZE COLLECTION
(a) All prize winners must collect their prize from the Centre Management office at the Centre. The
Promoter reserves the right to request winners to provide proof of identity, residency and/or entry validity
in order to claim a prize. Proof of identity, residency and/or entry validity considered suitable for
verification is at the Promoter’s discretion. If a winner cannot provide suitable proof, the winner will
forfeit the prize in whole and no substitute will be offered.
(b) All prize winners must sign these Terms in a form prescribed by the Promoter in order to
receive their prize.
(c) Entrants proposing to redeem prizes which involve travel, stunts or challenges may at the
absolute discretion of the Promoter first be required to:
(i) submit to a medical examination by a medical practitioner approved by the Promoter and obtain
relevant medical clearance to participate in the Competition and/or redeem the prize; and/or
(ii) execute a deed of release and indemnity in a form prescribed by the Promoter in order to
participate in the Competition and/or redeem the prize.
11 PRIZE AVAILABILITY
(a) The Promoter is not responsible or liable if for any reason beyond their reasonable control any
element of any prize is not provided. The Promoter may at its discretion and subject to State regulations,
substitute a different prize of equivalent value in place of any prize offered by the Promoter in the
Competition.
(b) The Promoter is not responsible for any changes in times or dates, or cancellations or
rescheduling of events that may prevent the prize winner from redeeming a prize or any part of it.
12 TAXES
Any tax payable as a result of a prize being awarded or received will be the sole responsibility of the
prize winner. Prize winners should seek independent financial advice prior to accepting a prize if this is a
concern.
13 UNCLAIMED PRIZES
Subject to State Regulations, prizes unclaimed after a period of 3 months will be forfeited.
14 PUBLICITY MATERIALS
(a) The Promoter has the right to publicise the names and photos, of any entrants for any
promotion or matter incidental to the Competition.
(b) Entrants consent to their entry into the Competition being read out.
(c) Entrants may be required by the Promoter to participate in photo, recording, video and/or film
session(s) (“publicity materials”). The Promoter has the right to use the publicity materials in any
medium (including, without limitation, the internet) and in any reasonable manner it sees fit, unless that
person advises the Promoter at the time of entering the Competition that he/she wishes to retain his/her
anonymity.
(d) The publicity materials may be provided to the prize provider for the purposes of promotional
display.
(e) No compensation will be provided for the use of entries and publicity material by the Promoter.
(f) Personal information supplied by entrants when entering this Competition will otherwise be
used by the Promoter in accordance with its Privacy Policy.
15 COPYRIGHT
By entering the Competition, all entrants:
(a) assign to the Promoter all rights including present and future copyright in their entry and
publicity materials in all media (including, without limitation, the internet) whether in existence now or
created in the future;
(b) agree not to assert any moral rights in respect of their entry and publicity materials (wherever
and whenever such rights are recognised) against the Promoter, its assigns, licensees and successors
in title; and
(c) undertake to the Promoter that their entry is not in breach of any third party intellectual property
rights.
16 RELEASE AND INDEMNITY
To the extent permitted by law, all entrants release from, and indemnify the Promoter against all liability,
cost, loss or expense arising out of acceptance of any prize(s) or participation in the Competition
including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property,
whether direct or consequential, foreseeable, or due to some negligent act or omission or otherwise.
17 TAMPERING AND OTHER MATTERS
(a) If for any reason this Competition is not capable of running as planned as a result of any
(including but not limited to) technical failures, unauthorised intervention, computer virus, mobile phone
failure, tampering, fraud or any other cause beyond the control of the Promoter which corrupts or affects
the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter
reserves the right, subject to State regulations and at its discretion, to disqualify any person who
(whether directly or indirectly) causes the same and/or to cancel, terminate, modify or suspend the
Competition.
(b) The Promoter accepts no responsibility for any late, lost or misdirected entries including but not
limited to electronic messages not received by the Promoter due to technical disruptions, network
congestion or any other reason.
(c) The use of any automated entry software or any other mechanical or electronic means that
permits any person to enter the Competition repeatedly is prohibited.
18 EXCLUSION OF PARTICIPANTS
The Promoter may at its sole discretion exclude any person from participating in the Competition or
redeeming a prize for any reason, including but not limited to, that person’s medical condition or history,
the preservation of the safety of the Promoter’s staff members or any other person or because the
Promoter deems that the behavior of a person may bring the Promoter’s brand into disrepute.
19 MINORS
(a) If the prize winner is under the age of 18 years, these Terms must be signed by the prize
winner’s parent or legal guardian before the prize is awarded and the prize may at the absolute
discretion of the Promoter be awarded to the prize winner’s parent or legal guardian.
(b) If the winner of a holiday prize is under the age of 18 years, that winner must nominate a parent
or legal guardian as their accompanying traveller for the trip.
20 TERMINATION OF COMPETITION
The Promoter may, subject to State Regulations, terminate this Competition at any time at its absolute
discretion without liability to any entrant or any other person. The Promoter will not award a prize if the
Competition is terminated.
21 DECISIONS FINAL
All decisions and actions of the Promoter relating to the Competition and/or redemption of the prizes are
exercised in its absolute discretion and are final. No discussions or correspondence with entrants or any
other person will be entered into.
22 FAILURE TO ENFORCE TERMS
A failure by the Promoter to enforce any one of these Terms in any instance will not give rise to any
claim or right of action by any other person or entrant. The Promoter will not enter into correspondence
in relation to such matters.
23 PERSONAL INFORMATION AND PRIVACY
(a) The personal information supplied by entrants when entering this Promotion may be used for the
purpose of sending information on any of the Promoter’s products or services. From time to time this
information may be used by the Promoter. The use and disclosure of this information is subject to the
restrictions imposed on the Promoter by the Privacy Act 1988. Subject to the provisions of the Privacy
Act 1988, entrants may have access to any personal information held by the Promoter by contacting
[reception@floreatforum.com.au]. An access fee may be charged to cover any costs of providing the
information to the entrant. A copy of the Promoter’s privacy statement can be found at our website

(b) The Entrant acknowledges that any personal information provided by the Entrant is not sensitive
information.
(c) By entering the Promotion, each Entrant gives its consent to the Promoter, for an indefinite
period, unless otherwise advised, to use his or her personal information for promotional, marketing,
publicity, research and profiling purposes, including sending electronic messages or telephoning the
Entrant.
(d) If the Entrant does not want the Promoter to use or disclose the Entrant’s personal information in
accordance with clause 23 (a), the Entrant may opt out by emailing reception@floreatforum.com.au.
(e) The Entrant acknowledges that if it fails to opt out in accordance with clause 23 (d), the Promoter
may use and disclose the Entrant’s personal information in accordance with clause 23 (a).
(f) If the Entrant wishes to access, update or correct the Entrant’s personal information, the Entrant
may do so by providing the Promoter with written notice.
