TERMS AND CONDITIONS
PARTICIPATION
Information on how to enter the "Angostura® Bitters Gift Card Promotion" (Promotion) and the prizes form part of these Terms and Conditions. By participating in the Promotion, Entrants (as defined below) agree to be bound by these Terms and Conditions.
The Promotion is conducted by Proximo Australia Pty Ltd (ABN 64 125 895 561), of Unit 1, 11 Packard Avenue, Castle Hill NSW 2154 (Promoter).
Entry is only open to Australian residents aged 18 years or over (Entrants). Employees (and their immediate families) of the Promoter, any of its related corporations, participating venues or any of their agencies associated with this Promotion are ineligible to enter.
The Promotion commences on 12.01am AEDST from 01/11/2018 and closes at 11.59pm AEDST on 28/02/2019 (Promotion Period). All times used throughout these Terms and Conditions will be based on AEDST.
ENTRY TO THE PROMOTION
To enter the Promotion, Entrants must, during the Promotion Period under take the following steps:
purchase either an Angostura® Lemon, Lime & Bitters, an Angostura® Soda, Lime & Bitters or an Angostura® Ginger, Lime & Bitters from a participating venue;
take a photograph of your purchased drink;
visit www.winwithangostura.com.au (Website); and
follow the prompts and provide all requested information, including uploading a copy of the photograph of the drink.
An Entrant may only submit one entry per day as part of the Promotion. Limit of one entry per qualifying purchase. Each entry must be submitted separately and in accordance with entry requirements.
For the avoidance of doubt, we will not accept entries which are incomplete, illegible, indecipherable or which are generated by computers or other automated means.
The Promoter must receive all entries during the Promotion Period. Entries received before the start of the Promotion Period or after the close of the Promotion Period will not count towards the Promotion and will be regarded as invalid. Records of the Promoter are final and conclusive as to time of receipt.
Entrants can only enter in their own name. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, place of employment, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
The total prize pool is $18,000.
DRAW AND PRIZES
There will be one prize draw for each day of the Promotion Period. Entries received between 12.01am AEDST and 11.59pm AEDST on each day of the Promotion Period will go into the draw for that day, which will take place (in weekly periods) on the Thursday following each week of the Promotion Period, starting 08/11/2018 and ending on 07/03/2019, except where it falls on a public holiday, in which case it will take place on the next day which is not a public holiday. For clarity the draw for each week's entries, will take place on the following Thursday, unless otherwise set out herein. Each draw will take place at 9 Middlemiss St, Lavender Bay, NSW 2060 at 12pm AEDST. The winners will be notified by email within 2 NSW business days of the draw. Winners will also be published on the Website on 14/3/2019.
The winner in each daily draw will win a Westfield Gift Card valued at $150. The Promoter accepts no responsibility for expired, lost, stolen or Gift Cards that have been tampered with in any way. The redemption of the Gift Cards is subject to their normal redemption process and terms and conditions. Some retailers may choose not to accept Westfield Gift Cards. Westfield Gift Card terms and conditions apply. The Westfield Gift Cards are issued by Westfield Gift Cards Pty Ltd (ACN 113 171 663).
If for any reason a winner does not take the prize (or an element of a prize) at a time determined by the Promoter, then the prize (or an element of the prize) will be forfeited and will not be redeemable for cash.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
If a prize (or an element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with another prize of equal value and/or specification, subject to any written directions from a lottery authority.
If a prize remains unclaimed then the prize will take place at the same time and place as the original draws on 10/06/2019, subject to any directions from a lottery authority. Winners, if any, will be notified by email within in 2 NSW business days of the draw and published on the Website on 17/06/2019.
GENERAL
All of the Promoter's decisions are final and no correspondence will be entered into.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention, fraud, war, terrorism, state of emergency or natural disaster), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b), subject to any directions from a lottery authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Any cost associated with entering the Promotion is the Entrant's responsibility.
The Promoter assumes no responsibility for: (a) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant; (b) any theft, destruction or unauthorised access to, or alteration of such communications; (c) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; or (d) any incorrect or incomplete information which may be communicated in the course of administering this Promotion (whether as a result of one of the foregoing causes or otherwise).
CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
Any documentation associated with a prize, are void if lost, stolen, forged, mutilated or tampered with in any way.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its related corporations or their relevant officers, employees and agents) exclude all liability (including negligence), for any personal injury, loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion or the prize.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its related corporations or their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of:
any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
any theft, unauthorised access or third-party interference;
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any variation in prize value to that stated in these Terms and Conditions;
any tax liability incurred by a winner or Entrant; or
taking/use of a prize.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on entrants providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its Privacy Policy, which can be viewed at https://proximospirits.com/privacy. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose Entrant's personal information to any entity outside of Australia without the Entrant's permission.
