WHO MAY ENTER
The only persons who may enter into the competition and be awarded prizes are those people specified in Condition 1.1 and who are not (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition; or (ii) members of the immediate family of such employees and contractors, including any spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee or /contractor. Persons must reside within Australia.
HOW TO ENTER
To enter the promotion, entrant needs to enter the required details into the registration form for an account with Kate Spade New York Australia, then accept the terms and conditions of entry and submit entry into the draw. By entering the competition, entrants consent to receive marketing communications from Kate Spade New York Australia. Entrants are able to sign-up online, or in-store.
Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction.
LIMITATIONS ON ENTRY
One entry allowed per person (identified by email). Multiple entries per household are allowed. Persons wishing to enter must comply with condition 1.1.
DURATION
The competition commences at the time specified in Condition 1.2 on the date specified in Condition 1.3. Entries must be received by the time specified in Condition 1.4 on the date specified in Condition 1.5.
SELECTION OF WINNER
There will be one (1) winner drawn for the $2,000 wardrobe from the total entrant database at the time specified in condition 1.6 on the date specified in condition 1.7, and will be conducted at the location specified in condition 1.8. The first valid entry as per condition 1.1 drawn will win the prize. The ‘SPOT THE SPADE’ campaign is a game of chance. The Promoter reserves the right to verify the validity of entries at any time during or after the promotional period, and reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. To the extent permitted by law, the Promoter is not responsible or liable for: (a.) inaccurate / incorrect transcription of entry information; (b.) purported entries that are not received for any reason, including because they were incorrectly uploaded or misdirected, or that are received, but are late, illegible, incomplete, or sent other than as directed in the entry instructions; (c.) unauthorised human intervention in any part of the competition; (d.) electronic or human error which may occur in the administration of the competition; (e.) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or (f.) any technical difficulties or equipment malfunction (whether or not under either Promoter’s control); (g.) any theft, unauthorised access or third party interference. Promoter’s decision is final and no correspondence will be entered into.
WINNER NOTIFICATION, PUBLICATION AND REDRAW
All entrants will be notified of their instant prize via email with one (1) hour of entry. Each prize offered must be redeemed within the given time frame.
The winner of the major prize, a $2,000 Kate Spade wardrobe, will be notified via email within 48 hours after the draw. The winner will be contacted via the email address which was entered into the competition. Despite the Promoter’s best efforts to contact the prize winner or deliver a prize, if a prize remains unclaimed by 7th March then, subject to any written directions given by a relevant lotteries or gaming authority the Promoter may conduct an unclaimed prize draw at the same time and place as the original prize draw on that date to distribute the unclaimed prize. The first valid entry drawn will win the unclaimed prize. The winner of the unclaimed prize draw will be notified by email 48 hours after the draw. PRIZE
The campaign consists of three (3) instant prizes of varying value, allocated at random, with all entrants receiving one (1) of the below:
1. 15% off* full priced styles only, to be redeemed online at katespade.com.au. Cannot be used in conjunction with any other offer or voucher code. Expires 31/03/2022.
2. Gift to be redeemed in-store at Kate Spade*. Must be redeemed before 27/02/2022. One gift per customer.
3. Kate Spade handbag valued at $500* to be redeemed in-store. Must be redeemed before 27/02/2022. One bag per customer.
All entrants will be entered in the draw to win a Kate Spade wardrobe valued at $2,000, to be redeemed in-store or online.
The prize is not transferable, exchangeable or redeemable for cash. All elements of the prize are subject to availability.
After the Promoter has sent the prize, the Promoter is not responsible for prizes that have been lost, stolen, forged, damaged or tampered with in any way. The Promoter will not be liable for any damage to or delay in transit of prizes.
PRIVACY AND COPYRIGHT
By entering the competition, the prize winner agrees to the use of their name, image, videography and photograph/s for publicity and promotional purposes, without compensation, as Kate Spade New York Australia see fit.

DISCLAIMER AND INDEMNITY
To the extent permitted at law, the Company and its related entities, officers, employees, contractors and agents disclaim any liability of any kind (including in contract, tort and breach of statutory duty) for loss, personal injury, death, property damage or otherwise that you may suffer yourself or cause to other persons or property as a result of any activities related to the prize that you undertake or commence, whether inspired by the Promoter or its related entities, officers, employees, contractors and agents, or otherwise. The prize winner agrees to indemnify, defend and hold harmless the Promoter and its related entities and officers for any and all claims, demands, suits, loss, damage, injury, and liability, including costs, expenses, and reasonable solicitors fees arising from, or in any way connected with, the prize. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours, the Promoter reserves the right to substitute a different prize item of equal or greater value.
