MacroTeff Creations Competition Terms and Conditions
This document sets out the terms and conditions for the Woolworths Macro Teff Creations Instagram Competition (the “Promotion”).  Information on how to enter and prizes form part of these terms and conditions.  By participating, entrants agree to be bound by these terms and conditions. Entries must comply with these terms and conditions to be valid. The Promoter reserves its absolute right to disqualify any entrant from the Promotion if entries do not comply with these terms and conditions.
The promoter is WOOLWORTHS LIMITED ABN 88 000 014 675 of 1 Woolworths Way, Bella Vista, NSW, 2153 (the “Promoter”).
The Promotion is open to all residents of Australia who are registered Instagram users.  Entrants who are under 18 years of age must seek permission from their parent or guardian to enter.  By providing permission, the parent or guardian accepts these terms and conditions.  If a winner is aged under 18 years of age, the Promoter reserves the right to liaise with the parent or guardian in relation to the prize in its absolute discretion.  Entry to this Promotion is free. These terms and conditions will be displayed on the Wholefood Simply webpage at https://wholefoodsimply.com for the duration of the Promotion.
Employees (and their immediate families) of the Promoter and its related companies and agencies involved in this Promotion are ineligible to enter.
The Competition commences on Wednesday 29th June 2016 at 12pm Australian Eastern Standard Time (“AEST”) and closes on Thursday 21 July 2016 at 12pm AEST (the “Competition Period”).
To be eligible to enter, entrants must, during the Competition Period:
Share a photo of your Teff creation on Instagram using the hashtag #MacroTeffCreations and tag @wholefoodsimply.
You must ensure that your Instagram profile is public to be eligible for the chance to win.  Only entries submitted via the Instagram application and which are appropriately hashtagged, will be accepted.
The Promoter reserves the right to disqualify any entry, if:
the Promoter cannot access your post of the image, for example, because your Instagram profile is not ‘public’ or your Instagram account is no longer ‘active’;
your entry contains inappropriate or offensive content as deemed so by the Promoter in its absolute discretion; or
your entry otherwise does not comply with these Terms and Conditions.
Entries must be completed during the Competition Period.  Entries completed after the end of the Competition Period will not be accepted.
There is a limit of one (1) entry that can be submitted per individual Instagram account.
Prize is one (1) Woolworths Wish Gift Card (“Prize”).  The Prize is valid for 12 months from the date of issue. The Prize will be sent out via post.  Visit https://everydaygiftcards.com.au/media/static/Docs/wish_tnc.pdf for full terms and conditions related to the Prize.
The total prize pool is valued at AUD$200.
Subject to the approval process required by any relevant gaming or lotteries authority, in the event that the Prize is unavailable despite the Promoter’s reasonable endeavours to procure it within Australia, the Promoter reserves the right to substitute it with a different prize item of equal or greater value.
This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its creative merit to select the winning entry. The judges’ decision in relation to any aspect of the Competition will be final and binding on every person who enters. No correspondence will be entered into.
By entering the Competition, participants agree that their Instagram username, profile picture and their entry (including the participant’s post in its entirety or in part) may be published (including by way of sharing or re-posting the post) on Wholefood Simply and may be viewed by all web users.
Entrants warrant that their entry is original and does not infringe the rights, including the intellectual property rights, of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Further, entrants agree that the Promoter has an unrestricted, irrevocable, transferable, divisible right and licence to use and modify their entry (including, without limitation, by re-sharing the entrant’s post) for the purposes of the Promoter’s business including for promotional purposes without the payment of any further fee or compensation. If requested by the Promoter, the entrant agrees to sign any further documentation required by the Promoter to give effect to this arrangement.  To the extent permitted by law, entrants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their entry.  Entrants warrant that they have consent from any third party they tag in their entry to tag them in that way.
Judging will take place on Thursday 21st July 2016 at the Promoter’s offices at 1 Woolworths Way Bella Vista NSW 2153. The judging will be carried out by a panel of 3 judges appointed by the Promoter.
The best entry as judged will win the Prize.
The Promoter may select additional reserve entries that they determine to be the next best in the event of an unclaimed prize or an invalid entry or ineligible entrant being selected as the winner. If a winner does not claim their Prize within 3 days from the date and time of determination of that winner, their entry will be deemed invalid and the Promoter may award the Prize to a reserve entry.
The winners will be notified on Friday 22nd July 2016 via a comment from @wholefoodsimply Instagram account on the winning Instagram post they entered. The winner must respond by contacting the Promoter by Instagram private inbox message within forty eight (48) hours after they have been notified by the Instagram comment on their post. In the event that the winner does not contact Promoter within forty eight (48) hours of being notified by the Promoter that they are the winner, their entry will be deemed invalid and the Promoter may award the Prize to a reserve entry.
The first initial, surname and suburb or city of residence and state of residence of the winner will be published on https://wholefoodsimply.com/giveaway-winners/ on Friday 22nd July 2016
If a winner is under 18 years of age, the Prize will be awarded to the winner’s parent or legal guardian.
The Prize will be sent by Australia Post to the address notified to Promoter by the Winner (which must be in Australia).  The Promoter and its associated agencies take no responsibility for the loss or damage of any Prizes whilst in transit. 
Prize must be taken as offered. The Prize, or any unused portion of the Prize, is not exchangeable and cannot be redeemed as cash.  All taxes (excluding GST) which may be payable as a consequence of receiving or redeeming a Prize are the sole responsibility of the winner. The Promoter will not be liable for any Prize that has been lost, stolen, forged, damaged or tampered with in any way. 
If for any reason the Competition is not capable of running as planned (including, but not limited to being due to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition), the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Competition. The Promoter reserves the right in its sole discretion to disqualify any entrant who tampers with the submission process.
    The Promoter is not responsible for any problems or technical malfunctions of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website or Instagram, or any combination thereof (collectively, “Technical Problems”) including, but not limited to any injury or damage to entrant’s or any other person’s computer related to or resulting from participation in or downloading any materials in this Competition.  Promoter assumes no responsibility for any failure to receive an entry as a result of Technical Problems.
Any cost associated with accessing the Competition website, Instagram or any promotional asset is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its related bodies corporate (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way in connection with the Competition.
The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information from entrants relevant to entry into or participation in this Competition.  Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise is involved in any way in manipulating, interfering or tampering with the conduct of this Competition.
Entries remain the property of the Promoter.  If you enter this competition, the Promoter will collect personal information about you so that you can participate in the competition and the Promoter can administer the Competition. The Promoter may use and disclose any personal information that an entrant has provided for the purpose of running the competition and also in advertisements, publications, media statements and other promotional material associated with the competition. To do this, the Promoter may disclose your personal information to its related bodies corporate and organisations to which the Promoter outsources functions, and organisations associated with this competition. If you are the winner, the Promoter will disclose your first initial, surname and suburb or city of residence and state of residence to operator of the Wholefood Simply webpage, and to the media, who will publish these details. If you do not provide your personal information you cannot participate in the competition. By entering this Competition entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media worldwide for future promotional purposes without any further reference or payment to the entrant.  The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). To request access to, or to update, personal information the Promoter holds about them, entrants can contact the Promoter in writing at privacy@wooloworths.com.au.
Entrants and participants in the Competition acknowledge that the Competition is in no way sponsored, endorsed or administered by or associated with Instagram and entrants and participants in the Competition release Instagram and its associated companies from all liability arising from the Competition.
