Terms and Conditions
By entering the Toyota Hybrid AFL Grand Final Experiencecompetition (“the Competition”), the entrant agrees to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents 18 years of age and older in Australia where the Channel Seven signal is received.
2.2 Employees and their immediate families of Seven Network (Operations) Limited, and Toyota Motor Corporation Australia Limited and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Competition commences on Thursday 7 September 2017 5:00pm AEST and concludes on Sunday 24 September 2017 11:59pm AEST (“the Competition Period”).
3.2 In order to enter, entrants must:
a) Head to the competition page at https://www.toyotahybridcompetition.com.au OR https://www.facebook.com.au/7afl and select two players they believe to be the best on field pairing during the 2017 Toyota AFL Premiership Season and tell us in 25 words or less why.
b) Players selected must:
i) Have played during the 2017 Toyota AFL Premiership Season
ii) Have played in the same team as each other
3.3 Entries must be received within the Competition Period.
3.5 Entrants (including winners) in the Competition may enter as many times as they like but each entry must be unique and:
(a) the original independent creation of the entrant; and
(b) free from any claims, including copyright or trademark claims, by other parties.
3.6 Entry details remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use, distribute, broadcast and sub-licence their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.
4. PRIZES 4.1 There will be one (1) major prize winner who will receive the prize package detailed in clause 4.2.

The Major Prize Winner will win the following prize:

Total maximum value for major prize package is AUD$5,170 (inclusive of GST).Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
4.3 In the event that an element of a travel, event, concert or other similar prize outlined above is, for any reason, cancelled, postponed or not available, that element(s) of the prize will be considered as forfeited and no cash alternative offer will be granted in lieu of the part of the prize.
4.4 As a condition of entry the winner must be available to travel on Friday, 29th September to Sunday 1st October (inclusive).
4.5 If the winner’s ordinary residence is in Victoria, they agree to forfeit the flight component of the prize and acknowledge that no cash prize will be awarded in lieu of flights.
4.6 The winner may select guests of any age however, all guests under 18 years of age must travel with their parent or legal guardian.
4.7 Winner will be required to sign a prize acceptance form including liability and publicity waiver within 24 hours of being notified as the winner to formally accept the prize.
4.8 Guests will be required to sign a prize acceptance form including liability and publicity waiver before the prize booking can be made.
4.9 Winner must finalise the prize booking by 5:00pm AEST on Wednesday, 27 September 2017.
4.10 Prize is a single event holiday and cannot be separated into different holiday vacations.
4.11 All passengers must travel together on the same flights and stay at the same property.
4.12 No compensation or alternative travel plans will be arranged should the Prize winner and/ or their guest miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and travel partner.
4.13 A credit card imprint may be required from the winner at check-in to the hotel for all incidental charges.
4.14 Once booking is confirmed no changes are allowed, unless otherwise authorised by the Promoter in its absolute discretion and if permitted will incur a fee of $150 including GST plus supplier charges which is payable by the winner.
4.15 Travel suppliers/airlines to be chosen at the discretion of 33 Degrees Worldwide Pty Ltd (the Prizing Agency).
4.16 Comprehensive travel insurance is highly recommended and at the expense of the winner. If the winner chooses not to purchase travel insurance they will be required to complete a travel insurance waiver form acknowledging that they understand the benefits of travel insurance but decline to take out a policy.
4.18 Unless expressly stated in these terms and conditions all other expenses become the responsibility of the major prize winner and (where applicable) their companion, including but not limited to all meals, spending money, incidentals, mini-bar, laundry, room service, telephone calls and all other ancillary costs. A credit card imprint may be required by hotel or other accommodation providers for incidentals (which are not included in the prize unless otherwise expressly set out in clause 4.2 above. Once the prize is accepted, the prize winner must deal directly with the prize supplier should there be any specific requests, queries, concerns or complications.
4.19 In accepting the prize the winners agree to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.20 The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
4.21 It is a condition of accepting the prize that the winner’s must comply with all the conditions of use of the prize and Sponsor’s requirements.
4.22 Prizes cannot be redeemed for cash and are not transferable or exchangeable.
4.23 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

5.1 Entrants agree that they are fully responsible for any materials they submit via the Competition including but not limited to comments, videos and photographs (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. Entrants warrant and agree that:
i. they will not submit any Content that is unlawful or fraudulent, or in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
ii. their Content shall not contain viruses or cause injury or harm to any person or entity;
iii. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
iv. they are the parent or legal guardian of any child and/or children appearing in any Content and give consent to the use of the Content for the purposes described in these terms and conditions;
v. they are the owner of copyright in the Content, or they have obtained full prior consent from any person who has jointly created or has any rights in the Content, and the Content does not infringe the rights of any third party;
vi. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
vii. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
5.2 Entrants acknowledge that the public will have the capacity to comment on the Content, and will not hold the Promoter or Sponsor liable for the publication of any comments, whether derogatory, offensive, racist, defamatory or otherwise, posted in relation to the Content.
6. HOW TO WIN
6.1 There will be one (1) major prize winner. All entries will be judged by a panel of judges appointed by the Promoter in its absolute discretion at the offices of Seven Network (Operations) Limited, 160 Harbour Esplanade, Docklands VIC 3008 Australia on Monday 25 September 2017 11:00am AEST. The entrant(s) whose entry is deemed to be the entry that is judged by the panel of judges as the most persuasive and creative entryout of all entries received and will be deemed the winner. The Competition is a game of skill and chance plays no part in determining the winner.
6.2 The major prize winner(s) will be notified by a phone call from the Promoter on the day of the judging, and will receive an email advising them of their prize.
6.3 Entrants in the Competition may enter as many times as they like
6.4 The judges’ decision (including any decisions as to prize distribution) is final and the Sponsor/ Promoter will not enter into correspondence regarding the result. The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional judging will be conducted.
6.5 It is a condition of accepting the prize that the major prize winner(s) (and their companions) agrees to comply with all the conditions of use of the prize and prize supplier’s requirements.
6.6 It is a condition of accepting the prize that the major prize winner (and their companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
7. NO LIABILITY
7.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions.
7.2 Seven Network (Operations) Ltd, and its associated agencies and companies will take no responsibility for defective prizes or prizes damaged or lost in transit, or late, lost or misdirected mail.
7.3 Seven Network (Operations) Ltd, and its associated agencies and companies will not be liable for any claims, misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during entry into the competition
b) during the judging;
c) whilst undertaking any travel won on or connected with their entry into the Competition; or
d) in accepting of or participating in the prize;
e) as a consequence of late, lost or misdirected mail;
f) due to the broadcast or publication of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
g) in relation to failure of an entry to be received by the Promoter on account of technical problems, website or phone anomalies, or traffic congestion; or
h) to entrant or any other person's computer software, computer equipment or internet connection resulting from or related to participation in this Promotion;
i) any variation in Prize value to that stated in these Terms and Conditions that is not due to an intentional error by Seven and/or its agencies and affiliates;
j) any technical difficulties, technical error or equipment malfunction (whether or not under the Promoter’s control);
k) any error, omission, interruption, deletion, delay, defect, theft, unauthorised access or third party interference; or
l) due to any change in these terms and conditions or any change in Seven’s programming, scheduling or production of broadcast material.
7.4 By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel.
7.5 The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements.
7 PROMOTER’S DETAILS
