Instructions on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is open to residents of Australia, aged 16 years and over, who can travel and redeem the prize on one of the following four set date options only:
Thursday the 22nd of July to Sunday the 25th of July 2017,
Thursday the 3rd of August to Sunday the 6th of August 2017,
Thursday the 7th of September to Sunday the 10th of September 2017
Thursday the 5th of October to Sunday the 8th of October 2017.
Entrants under the age of 18 years must have prior parental or legal guardian consent to enter (Employees of the Promoter, associated agencies and their immediate families, are not eligible to enter. If an entrant is under 18 years of age, they will be asked at time of winner notification to provide the contact details of a parent / legal guardian who (if the entrant is deemed a winner) will accompany them during the redemption of the prize. This person aged 18+ will need to provide the Promoter their full name and contact details as they appear on a photo identification. This person must accompany the under 18 winner (as their companion) when redeeming the prize, using one of the two (2) allocated prize winning tickets awarded in the prize.
One (1) entry per person will be permitted.
The promotion commences on the 1st of March 2017 and closes at 11:59pm (AEDST) on 31st March 2017. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at Bauer Media, Building 8, 658 Church Street, Richmond VIC, and will begin on 3rd of April 2017. The winner will be notified by telephone and by e-mail using the contact details given in their entry.
To enter, individuals must log onto www.cosmopolitan.com.au/vitalprotein during the promotional period, and follow the prompts to the competition page and complete the entry form including their full name, mailing address, current valid email address, daytime Telephone number and answer the competition question in 25 words or less “Why do you like taking a protein supplement?’ and submit the entry as instructed.
This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided and suitability to the promotion. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. No responsibility will be taken by the promoter in the event that the original entry is lost or damaged in editing.
Incomplete or incomprehensible entries will be ineligible and discarded.
An entry must not be, without limitation:
a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) discriminatory;
i) libellous;
j) threatening;
k) pornographic;
l) harassing;
m)hateful;
n) racially or ethnically offensive;
o) capable of encouraging of conduct that would be considered a criminal offence;
p) capable of violating any law;
q) capable of giving rise to civil liability.
Any entry which the judges deem inappropriate will be invalid.
All decisions relating to the conduct of the Promoter and Promotion, including, but not limited to, the selection of any and all parts of an entry to be published, and the awarding of prizes, are at the sole and exclusive discretion of Promoter and are final and not subject to appeal.
Failure to comply with any term or condition may result in disqualification and/or forfeiture of Prizes at the Promoter’s sole discretion.
The Promoter reserves the right to verify the validity of entries at anytime during or after the promotional period, and reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
USE OF ENTRIES
The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
Each entrant grants to the Promoter an irrevocable, worldwide and perpetual licence to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future Promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of any submitted entry.
The promoter will not be liable for any breach of copyright. The entrant will be solely responsible for their own entry and the consequences of submitting them. The entrant represents and warrants that:
Their entry is their own and:
a) They own or have all necessary licences, rights, consents and permissions to use and authorize the promoter to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all entries to enable inclusion and use of the entries in the manner contemplated by these terms and conditions.
It is a condition of entering the competition, that the entrant agrees to the use of their entry as determined by the Promoter to be used by the Promoter or their agents for a story or feature on the promotion to be developed and featured in Cosmopolitan magazine, website or social media pages (or any other form of media it deems suitable) without further remuneration or reference to the entrant. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.
The best (1) entry as determined by the judges will be deemed the major prize winner and will win:
Return economy flights for two (2) adults from winners nearest capital city to Gold Coast, valued at up to $1597.00 (depending on point of departure, including taxes)
Return airport transfers ( gold cost airport to Retreat only) for two (2) adults, valued at up to $550.00
Three (3) x nights’ accommodation for two (2) people at Gwinganna Lifestyle retreat, in a heritage room – twin share, valued at up to $3748.00 – accommodation includes:

Access to all facilities and scheduled activities
2 x Vital Health Packages (items are as stipulated in runner’s up prize package) valued at up to $203.85 (per person)
The next best five (5) valid entries as determined by the judges will be deemed the runner’s up prize winners and will win the following vital package valued at up to $203.85:

The total prize pool for the entire promotion is valued at up to $7,321.95 (including taxes) (depending on point of departure).
Major prize:
If the winner lives within 100km of the Brisbane or Gold coast area, the flight and transfers components of the prize will not be included and no alternative prize or cash will be awarded in lieu of the prize.
In the event that the winner is unable to redeem the prize on any of the dates stipulated in clause 2, and the winner is unable to transfer the prize to a nominated person, then the prize will be forfeited by the winner and neither cash nor another prize will be awarded in lieu of the forfeited prize. In the event that the entire prize is forfeited by the winner, the Promoter will award the prize to the next best valid entry as determined by the judges.
Prize is subject to availability at the time of booking. Prize must be booked 60 days prior to departure/scheduled package date. The booking time of the flights will be determined by the promoter in its complete discretion. Prize dates cannot be changed once booking is confirmed. All costs associated with any name or date changes once bookings are confirmed, will be the responsibility of the winner.
The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the any facilities or activities at Gwinganna Lifestyle retreat are closed, cancelled or postponed at the time of redeeming the prize for any reason whatsoever.
Prize does not include transfers to and from the winner’s place of residence to the departure point. These costs are the responsibility of the winner.
Redemption of prizes is subject to the standard terms and conditions of individual prize and service providers. Prizes do not include any ancillary costs associated with redeeming the prize.
The winner (and their companion) are responsible for all other expenses including spending money, additional meals or specific meal requirements (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs.
It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.
Two (2) flights must be utilized at the same time, for the same travel dates, to and from the same destination.
Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter.
The Promoter and prize supplier hereby expressly reserve the right to eject the winner for any inappropriate behaviour, including but not limited to intoxication, whilst redeeming the prize.
The winner must not engage in any illegal or unsafe behaviour whilst participating in the prize. To the extent allowable by law, the Promoter and its partners exclude any legal liability or responsibility for legal or otherwise incidents or activities engaged in by the winner during participation in the prize.
General:
Products included in prize package (including but not limited to titles, colour, design, sizing, model, finish, style etc) will be determined by the promoter in its complete discretion. All prizes must be taken as offered.
The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.
If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
In acceptance of the prize, the Winner acknowledges that they may incur on-going costs associated with the prize which are the entire responsibility of the winner.
In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize
