LawPath Promotion Official Rules
1. General.
The Sponsor is LawPath Operations Pty Ltd (ABN 74 163 055 954) of Level 1, 17-19 Bridge Street, Sydney NSW 2000. Telephone number (02) 80114188. Information on how to enter and prizes form part of the Terms and Conditions of Entry. Entry into this competition deems acceptance of these Terms and Conditions. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
2. Who can Enter.
Subject to this clause, entry is open to all residents of Australia between the ages of 18 and 79, as of the date of entry, who have fulfilled the requirements set out below.
Employees, and their immediate family members, of the Sponsor, LawPath Operation Pty Ltd www.lawpath.com / www.lawpath.com.au and associated agencies and companies are not eligible to enter this competition. Immediate family members means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.
3. How to Enter.
To enter the promotion, Users must enter their email address on http://sem.lawpath.com.au/competition and provide an answer to the following question, in 170 characters or less: “what is your business pitch?” (this questions will be sent to the user in a follow-up email upon submission of their email address) between 12:00 am ET 11/12/2014 and 11:59 pm ET 31/01/2015. All requested entry information must be provided. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email or addresses, accounts, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. In the event of a dispute as to any entrant, the authorized account holder of the email address associated with the entry will be deemed to be the entrant. The “authorised account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder. All entries must meet the following criteri · Entries must be original, exclusively created and owned by entrant, and the entrant must have all rights necessary to submit the entry. · Entries may be submitted by completing the Gleam form at http://sem.lawpath.com.au/competition-next-step/ and providing an answer to the following question, in 170 characters 25 or less: “What is your business pitch?”. The Gleam form will be sent as a follow-up email to each user who enters a valid email address. Entries may not contain material that is obscene, defamatory, libelous, threatening, pornographic, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, or violate any law. Entries must be appropriate for viewing by the general public; appropriateness will be determined by the Sponsor. The Sponsor reserves the right to reject any entry for any reason.
4. When to Enter.
This promotion begins at 12:00 am ET on 11/12/2014 and ends at 11:59 pm ET on 31/01/2015 (the “Promotion Period”). Sponsor’s computer is the official time-keeping device for the promotion. All entries must be received during the dates and times specified in the Promotion Period. This is a contest of skill. Odds of winning the promotion depend on the number and quality of eligible entries received during the Promotion Period.
5. Prize.
Winner will receive: one $499 AUD company registration from LawPath; one business legal documents bundle from LawPath ($1,050 value); One alcohol package from from Vinomofo ($179 AUD value); one 12 month Rackspace Startup Programme ($24,000 AUD value); $500 AUD credit towards a part-time course or workshop at General Assembly; one 6-month Startup Essentials package from Kelly + Partners ($4,000 AUD value) The aggregate retail value of the prize(s) is approximately $30,228 AUD. No substitution, assignment or transfer of the prize is permitted, except by the Sponsor, who has the right to substitute a prize with another of comparable or greater value. Winner is responsible for all taxes and fees associated with the receipt and/or use of the prize. The prizes may not be redeemed for cash, in whole or part, exchanged for any other item or transferred to any other person. The prizes do not include transportation or per diem costs, airport taxes or any other fees or costs, which the winner must pay. The winner is responsible for possessing all necessary ID, tax information other documents required by partners. The winner and his/her companion’s use of the Rackspace offer and subsequent start-up programmeat is subject to the Terms of Service applicable to the Rackspace platform, available at http://www.rackspace.com.au/startup/sign-up. If a winner cancels or shortens his/her agreement with the provided service, he/she will not be entitled to any refund on the whole or any part of the value.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize suppliers terms and conditions. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.
6. Winner.
The winner of the promotion will be determined based on the following: The object of the promotion is to provide the most creative answer and valid answer to the qualifying question, “What is your business pitch?” Because this is a contest of skill, winning the promotion is dependent on the quality and number of submissions received. The Sponsor or its designee will judge the promotion entries according to the following criteri Is this the correct answer to the question? Was the question answered in 170 character or less?.
6. Conditions of Participation.
By submitting an entry for this promotion, you agree to abide by these rules and any decision the Sponsor makes regarding this promotion, which the Sponsor shall make in its sole discretion. The Sponsor reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in the Sponsor’s reasonable suspicion, tampers with the Sponsor site, the entry process, intentionally submits more than a single entry, violates these rules, or acts in an unsportsmanlike or disruptive manner.
7. Intellectual Property.
Ownership of the pre-existing underlying intellectual property of the entrant remains the property of the entrant subject to the Sponsor’s rights to reprint, display, reproduce, perform, use, and exhibit the entry for the purpose of administering and promoting the promotion and for the Sponsor’s marketing and advertising purposes. By participating in the promotion, each entrant grants to the Sponsor a non-exclusive, worldwide, fully paid, royalty-free, perpetual, transferable license to reprint, display, reproduce, perform, use, and exhibit (including the right to make derivative works of) the entry and materials and information submitted on and in connection with the promotion or use or receipt of the prize for any and all purposes in any medium. Each participating entrant hereby warrants that any entry and other materials and information provided by entrant are original with entrant and do not violate or infringe upon the copyrights, trademarks, rights of privacy, publicity, moral rights or other intellectual property or other rights of any person or entity, and do not violate any rules or regulations. If the entry or information or materials provided by entrant contain any material or elements that are not owned by entrant and/or which are subject to the rights of third parties, entrant represents he or she has obtained, prior to submission of the entry and information or materials, any and all releases and consents necessary to permit use and exploitation of the entry and information and materials by the Sponsor in the manner set forth in the Official Rules without additional compensation. Each entrant warrants that the entry and materials and information provided do not contain information considered by entrant, its employees or personnel, or any other third party to be confidential, and that the entry, materials and information provided do not violate any laws or regulations. Entrant agrees that the Sponsor has the right to verify the ownership and originality of all entries and that, upon the Sponsor’s request, entrant must submit a written copy of any release or permission entrant has received from a third party granting entrant the right to use such property. Entrant understands and acknowledges that in the event a submission is selected as a winning entry, and entrant’s ownership, rights and the originality of the entry cannot be verified to the satisfaction of the Sponsor or is in any other way ineligible, the Sponsor may select an alternate winner based on the same judging criteria.
8. Disclaimer, Release and Limit of Liability.
THE SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE PROMOTION. BY ENTERING THE PROMOTION OR RECEIPT OF ANY PRIZE, EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS THE SPONSOR, AND ITS SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (1) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY ENTRANTS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE PROMOTION; (2) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE; (3) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE PROMOTION; (4) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE PROMOTION OR THE PROCESSING OF ENTRIES; OR (5) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANT’S PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the promotion, provided that if it is not possible to award another entry due to discontinuance of the promotion, or any part of it, for any reason, the Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed the Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
9. Privacy and Use of Promotion Information.
The Sponsor collects personal information from you when you enter this promotion. The Sponsor reserves the right to use any information collected in accordance with its privacy policy, which may be found at https://lawpath.com.au/privacy_policy. The Sponsor will share emails entered with the following partners: General Assembly; Kelly + Partners. Entrants may request access to their personal information, held by the Sponsor, by writing to The Privacy Officer, LawPath Operation Pty Ltd (ABN 74 163 055 954) of level 1, 17-19 Bridge Street, Sydney NSW 2000 Australia.
10. Further Terms and Conditions
Any entrant found to have used a third party (including online competition entry site) to enter on
their behalf will have all entries invalidated and any claim they have to any prize will be invalidated.
If such an entrant is awarded a prize and then found to have breached this clause, the entrant must
immediately return any prize awarded. The Sponsor has sole discretion to determine if this clause
has been breached by any entrant. The Sponsor reserves the right to request whatever
documentation it deems necessary to confirm if the entrant has breached this clause. An entrant
must provide any requested documentation to the Sponsor upon request.
Any entrant found to be entering incorrect contact details, including incorrect email contact details,
will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is
awarded a prize and then found to have breached this clause, the entrant must immediately return
any prize awarded. The Sponsor has sole discretion to determine if this clause has been breached
by any entrant. The Sponsor reserves the right to request whatever documentation it deems
necessary to confirm if the entrant has breached this clause. An entrant must provide any
requested documentation to the Sponsor upon request.
If the prize is unavailable, for whatever reason, the Sponsor reserves the right to substitute the
prize for a prize of equal or greater value, subject to State and Territory legislation. Cash will not
be awarded as a substitute.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of
the prize and prize supplier‟s requirements. Each prize must be taken as stated and no
compensation will be payable if a winner is unable to use the prize as stated.
The Sponsor highly recommends a current residential street address be provided when requested
for ease of correspondence and potential prize delivery. The Sponsor makes all reasonable efforts
to deliver prizes to the addresses provided by competition entrants. The Sponsor cannot guarantee
that any prizes returned to the Sponsor due to non-delivery at the provided address will be re-sent
to the prize winner.
The Sponsor reserves the right to request the winner to sign a winner‟s deed of release or any other
relevant forms or agreements that the Sponsor deems necessary, to provide proof of identity, proof
of age, proof of residency at the nominated prize delivery address and/or proof of entry validity in
order to claim a prize. Proof of identification, residency, age and entry considered suitable for
verification is at the discretion of the Sponsor. In the event that a winner cannot provide suitable
proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Sponsor reserves the right to conduct a redraw in the event that an entrant, claiming to be a
winner, is unable to satisfy these Terms and Conditions or has breached these Terms and
Conditions.
The Sponsor’s decision in relation to any aspect of the competition is subject to State and Territory
legislation but also final and binding on each person who enters. No correspondence will be entered
into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to
availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be
taken as cash. Prizes will be sent to the winner‟s nominated address as stated in their original entry.
The Sponsor and their associated agencies, and companies associated with this promotion will
take no responsibility for prizes damaged or lost in transit.
11. Copyright, Statutory guarantees, Waiver and liability
In participating in the prizes, the winner agrees to participate and co-operate as required in all
editorial activities relating to the Competition, including but not limited to being interviewed, writing blogs posts and photographed. The winner agrees to granting the Sponsor a perpetual and
non-exclusive licence to use such footage and photographs in all media worldwide, including online
social networking sites, and the winner will not be entitled to any fee for such use.
Prize-winner is advised that tax implications may arise from their prize winnings and they should
seek independent financial advice prior to acceptance of that prize.
The Sponsor (subject to State and Territory legislation) reserves the right to amend, cancel or
suspend this competition if an event beyond the control of the Sponsor corrupts or affect the
administration security, fairness, integrity or proper conduct of this competition. The Sponsor will
disqualify any individual who has tampered with the entry process or any other aspect of this
competition.
Any cost associated with accessing the promotional website is the entrant's responsibility and is
dependent on the Internet service provider used.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or
modify the statutory consumer guarantees as provided under the Competition and Consumer Act
2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer
protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for
any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the
Sponsor (including its respective officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether
direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,
the Sponsor (including its respective officers, employees and agents) is not responsible for and
excludes all liability (including negligence), for any personal injury; or any loss or damage (including
loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a)
any technical difficulties or equipment malfunction (whether or not under the Sponsor's control); (b)
any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late,
lost, altered, damaged or misdirected (whether or not after their receipt by the Sponsor) due to any
reason beyond the reasonable control of the Sponsor; (d) any variation in prize value to that stated
in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a
prize The Sponsor (including its‟ officers, employees and agents) excludes all liability for any loss
(including, without limitation, indirect, special or consequential loss or loss of profits or opportunity),
expense, damage, personal injury or death which is suffered or sustained (whether or not arising
from any person‟s negligence) in connection with this competition including taking or using a prize,
except for any liability which cannot be excluded by law (in which case that liability is limited to the
minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the
