Terms and Conditions:
1. Information on how to enter the promotion and the prize form part of these terms and conditions. Entries not completed and submitted in accordance with these terms and conditions will not be accepted. Participation in this promotion is deemed acknowledgment and acceptance of these terms and conditions.
2. The promotion is being conducted by Food For Health Pty Ltd, 2 Duigan Drive, Moorabbin Airport, Victoria, 3194 (ABN 68 863 195 590) (“Promoter”).
3. Entry is only open to residents of Australia, aged 18 years and over. Employees and the immediate families of the Promoter (including its affiliates, related bodies corporate and its agencies) associated with this promotion are not eligible to enter this promotion.
4. The promotion commences on the 10th September, 2018 and ends at 11.59pm AEDST on 30th November, 2018. (“Promotional Period”). All entries must be submitted and received no later than the 11.59pm on the 2nd December, 2018. The Promoter will not accept any entries after this date, as they are considered ineligible.
5. To participate in the promotion and to enter into the draw, individuals must:
i.) Purchase 2 specially marked Food For Health products from an Australian Woolworths store within the Promotional Period: Any proof of purchase provided outside of these dates will not be accepted.
ii.) Complete the online entry form available at www.foodforhealth.com.au/ and attach proof of purchase within the Promotional Period. Failure to complete this form in full or to be able to provide an original proof of purchase when requested will lead to a rejection of the promotion entry. This form must be completed before 11:59pm AEDST, 2/12/2018. Forms completed after this date will not be accepted.
6. Multiple entries are permitted, subject to the following:
i. only one (1) entry permitted per transaction invoice showing eligible products purchased; and
ii. each entry must be made separately and in accordance with the entry requirements set out in these terms and conditions.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process or subject to any written directions of the relevant State and Territory Lottery or Gaming Departments, elect to modify, suspend, terminate or cancel the promotion, as appropriate. Errors and omissions may be accepted at the Promoter’s discretion. The Promoter reserves the right to waive any of the conditions set out in these terms in its absolute discretion subject to any written directions from all relevant State and Territory Lottery and Gaming Departments. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. The Promoter does not accept responsibility for late, lost, damaged, stolen or misdirected mail. Incomplete, indecipherable, or illegible submissions will be deemed invalid.
9. There is 1 prize to be awarded to the 1st valid entry drawn as follows:
A Wellness Weekend for 2 people at the Gwinganna Lifestyle Retreat in Queensland. Prize includes 2 return economy airfares from the winners nearest capital city to the Gold Coast (with an airline as determined by the Promoter), a 2-night Gwinganna Wellness Weekend package for two (2) people in Deluxe Orchard Suite including all organic meals, snacks and beverages, a 50 minute Classic Massage per person, access to all facilities and all scheduled activities and complimentary transfers at set times from Gold Coast Airport. All other costs associated with the travel prize are the responsibility of the winner including travel insurance and spending money. Bookings should be made at least 45 days in advance and is only available to Australian residents 18 years and older. Travel must also take place within 6 months of the prize draw. Booking subject to availability, block out dates may apply. Changes to your booking will incur cancellation or postponement fees. Prize valued up to $5,000.00.
The draw will take place at SAM Sales & Marketing, 272 Bay Street, Port Melbourne, VIC, 3207 on Wednesday the 5th December, 2018 at 10:00am AEDST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winners will be notified by telephone within two (2) business days of the draw and in writing via email. The winner’s name will be announced on the Food for Health Website at www.foodforhealth.com.au on Friday 7th December, 2018.
10. The Promoter’s decision is final and no correspondence will be entered into.
11. A draw for any prize, if unclaimed, may take place on the 14th March, 2019 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner if any, will be notified by telephone within two (2) business days of the draw and in writing via email and have their name published on the Promoters website at www.foodforhealth.com.au on the 16th March, 2019.
12. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority (including all relevant State and Territory Lottery or Gaming Departments).
13. The prize is not transferable or exchangeable and cannot be redeemed as cash. Any costs associated with the use of this prize are the sole responsibility of the winner. The Promoter does not take any responsibility for the prize being lost, stolen, damaged, cancelled or destroyed. The Promoter accepts no responsibility for any taxation implications that may arise for the winner in relation to the prize.
14. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority (including relevant State and Territory Lottery and Gaming Departments), to modify, suspend, terminate or cancel the promotion, as appropriate.
16. Any cost associated with accessing the Internet is the entrant’s responsibility and is dependent on the Internet service provider used.
17. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained in connection with the conduct of the promotion and/or redeeming or using the prize.
18. The Promoter will collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers and to all relevant State and Territory Lottery and Gaming Departments where required. The Promoter will also use and handle personal information as set out in its Privacy Policy, which can be viewed at www.foodforhealth.com.au. Entry is conditional on providing the requested personal information. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and the entrants consent to such collection and use. Entrants should direct any request to opt out, or access, update or correct information to the Promoter and direct any complaints regarding treatment of their personal information according to the Privacy Policy. All entries become the property of the Promoter. The Promoter will not disclose personal information to any overseas entity.
19. Each provision of this document is individually severable. If any provision is or becomes illegal, unenforceable or invalid in any jurisdiction, it is to be treated as being severed from this document in the relevant jurisdiction, but the rest of this document will not be affected. The legality, validity and enforceability of the provision in any other jurisdiction will not be affected.
